Section 6.
That Section 66.204 Subd. 1 ( 1 ) of the Saint P 1 Legislative
Code, Zoning Code, be and is hereby amended as follows :
Subdivision 1 . Identification Signs.
( 1 ) For one and two-family uses and ed and
breakfasts residences, one identification
sign not exceeding a total of tw square
feet in area.
Section 7.
This ordinance shall take effect and be in fo ce thirty(30)
days form and after its passage, approval and publication.

Section 3
That Section 60.423 of the Saint Paul Legis ative Code,
Zoning Code, be and is hereby amended so as to add he following
new Subsection (4) thereto and renumber present Subs ction (4) to
be Subsection (5) :
(4) Bed and breakfast residences subject o t e following
conditions:
(a) The bed and breakfast residenc may b established
in a one family detached dw ell ' ng or a two family
dwelling, located within a single main bui ding.
(b) One family detached dwelli gs may co tain no more
than four quest rooms.
(c) Two family dwellings, 1 cated within single main
building, and contain no mo e than three g est rooms.
(d) The zoning lot shall ave a minimum s ze according
to the following combi ation of dwelli g units and
guest rooms:

in Se tion 60.201.
(5) Accessory buildings, structures and uses customarily
incident to any of the above permitted uses.

Dear President Tedesco and Members of the City Council:
In December of 1985, the Planning Commission initiated a zoning amen ment which would
permit bed and breakfast residents in residentially zoned districts. On anuary 19, 1986,
the Commission held a public hearing on the amendment and on April 1 , 1986,
recommended adoption of it. The Commission's resolution is attached.
The amendment permits bed and breakfast residences, with up to four g est rooms, to
locate in residentially zoned districts. It varies the minimum lot size, d pending upon the
numbcr of guest rooms and dwelling units on the lot; requires off-street parking; restricts
the number of people who may be employed at the residence; and requi s residences with
2 through 4 guest rooms to be 1,000 feet from each other.
The amendment had required originally that the bed and breakfast resi ence must be
owner occupied. The City Attorney has issued an opinion that the City s not authorized
through zoning to regulate the ownership of bed and breakfast residenc s but that owner
occupancy could be addressed through City licensing regulations. A be and breakfast
licensing ordinance which requires owner occupancy has been drafted a d will be
transmitted to you so that the Council may consider the zoning and lice sing ordinances at
the same time.

WHEREAS, the Planning Comnission on December 6, 1985, adopt d a �esolution
initiating a 40-acre study of bed and breakfast residences f r the purpose of
amending the Zoning Code; and
WHEREAS, the Zoning Committee of the Planning Comnission rev'ewed and
suggested amendments and recorrnnended a public hearing; and
WHEREAS, pursuant to Minnesota Statutes 462.375(5) , the Plan ing Comnission
held a public hearing on the proposed amendment at its January 24, 1986
meeting; and
WHEREAS, the Planning Commission has determined:
1. That the number of real estate descriptions affected by he amendments
renders the obtaining of written consent impractical ;
2. That a survey of an area in excess of 40 acres has been ade;
3. That a determination has been made that the amendments t the Zoning Code
proposed are related to the overall needs of the communi y, to existing
land use, and to plans for futu�e land use; and
4. That pursuant to State Statutes proper notice of the hearing was given in
the Pioneer Press and Dispatch on January 3, 10, and 17, 1986.
NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission recommends
approval of the Zoning Code amendments attached hereto in th 40-acre study
proposing regulations for tied and breakfast residences and d rects the - -

Revision to Zoning Code Text
All of the language of the following amendment is
proposed to be added to the Zoning ode, with one
exception. The exception is the secti n on signs, where
only the underlined language is to b added.
Section 60.202. B (Definition)
New Section Bed and Breakfast Residence: A dw Iling unit, located
within a one or two family dwelling, in which four or
fewer guest rooms are rented on a ni htly basis for
periods of less than a week and whe e at least one meal is
offered in connection with the provi ion of sleeping
accommodations only.
Section 60.207 G (Definition)
New Section Guest Room: A room or a group of ooms forming a
single habitable unit which is locate within the walls of
a dwelling unit and which is used or intended to be used
for sleeping and living, but not for c oking or eating
purposes and which is let individual y as a unit.
Section 60.412. Principal Uses Permitted. (R-1 thro gh R-4)
New Section (10) Bed and breakfast residences s bject to the
following conditions:
(a) Only one guest room may be established in a
one-family detached dwe ling.
(b) The zoning lot must meet the minimum lot
size for single family dw llings in the district
in which it is located.
(c) The residents of the dwe ling, other than the
registered guests of the g est room, shall only
be comprised of the follo ing people: one or
two people or parents, wi h their direct lineal
descendants and adopted r legally cared for
children (and including t e domestic
employees thereof).

principal structure.

The Planning Commission received testimony on the Bed and Breakfast Zoning
Code Amendment from the Summit Avenue Task Force, Merriam Park Community
Council , Bed and Breakfast Registry, Donna Gustafson, and Fir Marshal Steve
Zuccard.
The City Attorney has issued a written opinion that the City is not authorized
through zoning to regulate the ownership of bed and breakfast residences but
that ownership could be addressed through City licensing laws. Consequently,
a bed and breakfast license has been drafted. It is attached.
Attached is a revised zoning amendment which incorporates my ecorrgnended changes.
The changes include most of the recommendations given in the estimony and
changes which dovetail with the new license and the housing c e.
The changes:
1) Renames and rewords bed and breakfast and bed and breakfast units;
2) Require that at least one meal be provided at a bed and b eakfast
residence;
3) Removes proposed revision to boarding, rooming, or roomin and boarding
house definition. Needed changes will be made in licensi g code;
4) Removes owner occupancy requirement;
5) Reduces the maximum number of bed and breakfast guest roo s permitted in
RT-1 through RM-2 districts to 4;
6) In RT-1 through RM-2 districts, permits bed and breakfast guest rooms in
one and two family dwellings; permits a combination of gu st rooms and one
and two family dwelling units not to exceed 5; varies the minimum lot size
between 6,000 and 8,000 square feet, depending upon the n mber of guest

The proposed bed and breakfast residence licensing ordinance:
1) Requires owner occupancy;
2) Requires compliance with the housing and fire codes;
3) Incorporates Fire Marshal Zuccard's recommendations; and
4) Enables bed and breakfast residences to be exempt from co ercial kitchen
requirements.
The licensing ordinance will be considered by the City Council at the same
time as the zoning amendments.

THE COUNCIL OF THE CITY OF 5AINT PAUL BOES ORDAIN:
Section 1 .
That Sections 60. 202B and 60. 207G of the Saint aul
Legislative Code , Zoning Code , be and hereby amende so
as to add the following new definitions thereto :
60.202B.
Bed and Breakrast �esidence . A dwelling un' t,
located within a one or two family dwelling, in
which four or fewer guest rooms are rented n a
nightly basis for periods of less than a we r and
where at least one meal is offered in conne -tion
wif�h the provision of sleeping accommodatio s only.
60.207G. "
Guest Room. A room or a group of rooms for ing a
single habitable unit which is located with'n the
walls of a dwelling unit and which is used r intended �
to '�� used for sleeping and living, but not for
cooking or eating p�rposes and which is let
individually as a unit.

Section 2 .
That Section 6P1.412 of the Saint Paul Legis ative Code,
Zoning Code, be and is hereby amended so as to add t e following
new Subsection, (10) there to and renumber presen Subsection
(10) to be Subsection (11) :
(14!) Bed and breakfast residences subject to t e following
conditions:
(a) Only one guest room may be establish d in a one-
family detached dwelling.
(b) The zoning lot must meet the minimum ot size for
single family dwellings in the district in which it is
located.
(c) The residents of the dwelling , oth r than the
registered quests of the quest room, s all only be
comprised of the following people: one or wo people or
parents, with their direct lineal desc ndants and
adopted or legally cared for children (a d including
the domestic employees thereof).
(d) All guest rooms shall be contained within the
principal structure.
(e) There shall be no more than one person employed by
the bed and breakfast residence who is no a resident
of the dwelling.
(f) Dining and other facilities shall no be open to
the public, but shall be used exclusi ely by the
residents and registered quests.
(g) No additional exterior entrances shall be added to
the structure.
(11) Accessory buildings, structures and uses a defined in
Section 60.2011.

That Section 6�1.423 of the Saint Paul Legisl tive Code,
Zoning Code, be and is hereby amended so as to add t e following
new 5ubsection (4) thereto and renumber present Subse tion (4) to
be Subsection (5) :
(4) Bed and breakfast residences subject to th following
conditions:
(a) The bed and breakfast residence may be established
in a one family detached dwelling or a two family
dwelling, located within a single main buil ing.
(b) One family detached dwellings may cont in no more
than four quest rooms.
(c) Two family dwellings, located within a single main
building, may contain no more than three gu st rooms.
(d) The zoning lot shall have a minimum size according
to the following combination of dwellin units and
guest rooms:

(f) The conditions of Section 60.142 (10) (c) through (g)
are met.
(5) Accessory buildings, structures and uses c stomarily
incident to any of the above permitted uses.

Zoning Code, be and is hereby amended so as to add the followi g
new Subsection, (14) thereto and renumber present Subsection

That Section 62.103, Subd. 6 (1 ) and (3) of the Saint �R�ul
Legislative code is hereby amended so as to add the following
thereto:
62.103. Parking Requirements.
Subd. 6. Parking Requirements by use.
(1 ) Residential
(e) Bed and breakfast residence in residential
districts.
One and one-half for each dwelling unit and one for e ch bed
and breakfast unit up to and incliading three uest ro ms.-
(3) Business and Commercial
(0) Bed and breakfast residence in commercial districts.
One and one-half for each dwelling unit and 1/2 for ea h
guest room.
