An Ordinance amending Chapter 60 of the Saint Paul
Legislative Code pertaining to zoning for the City
of Saint Paul and the zoning maps thereof.
WHEREAS, Pursuant to Minnesota Statutes, . 462.357 and . 64. 10 of the
Legislative Code, Colleen Quinn Niemiec and Walter C. Niemiec dul petitioned to
rezone 1266 West Seventh Street located on the southeast side be ween Victoria and
Cantonfrom RM-2 to B-1 for the purpose of permitting an existin house to be used as
office residential and construction for a retail shop on the adj ent vacant lot;
the petition having been certified by the Planning Division on M ch 6, 1986 as
having been consented to by at least 67% of the owners of the are of the property
to be rezoned, and further having been consented to by at least t o-thirds of the
owners of the property situated within 100 feet of the total cont'guous property
within one year preceding the date of the petition; and
WHEREAS, The Zoning Committee on April 3, 1986 conducted a pu lic hearing
for the purpose of considering the rezoning petition, and pursuan to Section
107.03 of the Administrative Code, submitted its recomnendation t the Planning
Comnission that the petition be granted; and
WHEREAS, The Planning Commission considered the rezoning peti ion at its
meeting held on April li , 1986 and recomnended that the City Coun il approve the
petition; and
WHEREAS, Notice of a public hearing before the City Council o the said
rezoning petition was duly published in the official newspaper of the City on
April 26, 1986 and notices were duly mailed to each owner of affe ted property and
property situated wholiy or partly within 350 feet of the propert sought to be
rezoned; and
WHEREAS, A public hearing before the City Council, having bee conducted on
May 8, 1986 where all interested persons were heard, and the Coun il having
considered all the facts and recomnendations concerning the petit on; now,
therefore,

THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1.
That the zoning map of the City of Saint Paul, Sheet No. 35, s
incorporated by reference in Section 60.301 of the Saint Paul Leg slative Code, as
amended, is hereby further amended as follows:
That property located on the southeast side of West
Seventh being more particularly described as Lots 4
and 5 Block 9, Clarke's Addition be and is hereby
rezoned from RM-2 to B-1.
Section 2.
This ordinance shall take effect and be in force thirty (30) ays from and
after its passage, approval and publication.

On April 3, 1986, the Zoning Committee of the Planning Commission held a public hearing
on this rezoning. The petitioner testified. At the close of the public heari g, the Committee
voted 6 to 0 to approve the rezoning based on staff findings.
On April 11, 1986, the Planning Commission upheld the Zoning Committee s recommendation
on a unanimous voice vote.
This rezoning is scheduled to be heard by the City Council on May 8, 1986 Please notify me

WHEREAS, Colleen Quinn Niemiec & Walter C. Niemiec, file #9876, has etitioned to rezone 1266
W. Seventh Street, situated on the southeast side of West Seventh Street be ween Victoria and
Canton, from RM-2 to B-1 for the purpose of permitting an existing house to be used for office-
residential and to permit construction for a retail shop on the adjacent va ant lot; and
WHEREAS, the Zoning Committee of the Planning Commission on April 3 1986 held a public
hearing at which all persons present were given an opportunity to be hear pursuant to said ap-
plication in accordance with the requirements of Section 64.400 of the Sai t Paul Legislative
Code; and
WHEREAS, Saint Paul Planning Commission, based on the evidence presen ed to its Zoning Com-
mittee at the public hearing as subsequently reflected in the minutes, made the following findings
of fact:
1. The applicants would like to build a log cabin for a bait and tackl shop on the vacant
parcel and use the residence as a mixed commercial-residential str cture.
2. West Seventh Street is classified as a minor arterial B street; land u es adjacent to these
streets are generally commercial. West Seventh Street in this area i both commercial and
residential.
3. The Land Use section of the City's Comprehensive Plan recommen s development of
compatible mixed uses along existing commercial strips.
4. The District 9 Physical Plan recommends encouraging commercial ses along West Seventh.
S. Other uses permitted in the B-1 district include hardware, florist, b auty shops, repair
_ shops, officcs, banks, daycare and dance schools.
NOW, THEREFORE, BE IT RESOLVED, by the Saint Paul Planning Commi sion that the petition
of Colleen Quinn Niemiec & Walter C. Niemiec to rezone property at 1266 W st Seventh Str�et
more particularly described as Lots 4 and S, Block 9, Clark's Addn. from a R -2 zoning class-

T'he applicant was present. There was no opposition present at the hearin .
Walter and Colleen Niemiec, 2086 Princeton, testified. Mr. Niemiec stated that he felt a log cabin
would be in keeping with the neighborhood's character. He stated that th y want to have an
apartment upstairs, and a business in the lower level. Ms. Niemiec stated hat they have submitted
a letter to the zoning committee addressing any possible questions, and inc uded a drawing in-
dicating what the cabin would look like. She stated that they would have referred more
landscaping on the property, but that staff did not recommend this.
Ms. Zieman asked if the applicants have met with the West 7th Street Fede ation.
Ms. Niemiec stated that she spoke with Betty Moran, but they weren't able to get a meeting
together. She said that neighbors on both sides of this property have signe a petition in favor of
the rezoning.
Hearing no further testimony, Mr. Pangal closed the public hearing portio of the meeting.
Ms. Summers moved approval of the rezoning from RM-2 to B-1 based on f ndings l through 5 and
the staff analysis. Ms. Morton seconded the motion, which passed on a roll call vote of 6 to 0.

Dear ponna,
My husband and I are the owners of 1266 W. Seventh Street, lso known as
Lot 4 and Lot 5, Clarkes Addition. This property is locat on a busy
comrr�ercial street, in the middle of a spot-zoned block. We ope to
have the proi.-�erty re-zoned from an RM-2 classification to a B-1.
Specifically, we would li;ce to build a log cabin for Wally's Live Bait
and Tackle Shop on this property, complete with pine trees d a
"northwoods" atmosphere. No�a this brings up a few questions namely:
1) W:-iY REZONE; WHY NOT BUY AN EXISTING COI�RCIAL PROPERTY?
First of all,we chose the West 7th/ Old Fort Road area ause of
the nwnUer of anglers living in it, the lack of such a usiness
and the convenient access to both our potential customer as well as
our own home. Although we could have purchased an alrea y existing
commercial property near our lot, we feel that building n actual
log cabin is the key to the successs o'f this business. en though
the lot must be re-zoned to do this, we feel our log cab'n will fit
in and enhance the mix of commercial and residential pro rties
already existing along tne block.
2) WHY 470ULD A BAIT SHOP B�FIT TI� PUBLIC?
We feel there are several benefits. As already stated, re are
many anglers in the area and no live bait and tackle stor to serve
their needs. (For instance, it's not uncommon to drive ou to
White Bear or Rice Street to buy bait for fishing at Cros y Lake.)
Being a log cabin, we also feel our business would help 1 n� a
historic feeling to Old Fort Road.
3) HOW WILL IT B�TEFIT TI� NEIGIiBORH00D?
Because of the recreational aspect of this shop, �ae will a
neighborhood resource for everything from licenses to org ized
fishing trips for senior citizens..and more. We also feel it is
unlikely that anything other than another apartment build ng would
be built on this spot were we not able to build our loq abin. An
apartment building of up to five stories would not only a d more
concrete to the neighborhood, but cause additional parkin problems.
Our bait shop would function during the "off hours". We w uld �e ooen
while our neighbors are at wor;c, and likewise closed when Mitch's Bar
is busy on Friday and Saturday nights.

Due to the small size, poor floor plan and condition of ' e house,
as well as the busy nature of West 7th Street/Old Fort R ad, we feel
this house is no longer suitable or adequate for a singl far�ily. ihe
cost of renovation is also going to be substantial, mak' g the
rent more affordable and more attractive for a small, pr fessional
off ice.
In summary, my husband and I, as lifelong minnesotans, have a keen
interest in fishing, natural resources and the enviro:l�nent. Proud
of this, we want to promote and preserve it. Our log cabin it shop
would give area residents a taste of Minnesota's outdoor he itage while
providing a needed service.

cn WHEREAS, Pursuant to Minnesota Statutes, . 462.357 and . 64. 10 of the
� Legislative Code, Colleen Quinn Niemiec and Waiter C. Niemiec dul petitioned ta
rezone 1266 West Seventh Street located on the southeast side be ween Victoria and
Cantonfrom RM-2 to B-1 for the purpose of permitting an existin house to be used as
office residential and construction for a retail shop on the adj ent vacant lot;
the petition having been certified by the Planning Division on M ch 6, 1986 as
having been consented to by at least 67% of the owners of the are of the property
to be rezoned, and further having been consented to by at least t o-thirds of the
owners of the property situated within 100 feet of the total cont'guous property
within one year preceding the date of the petition; and
WHEREAS, The Zoning Committee on April 3, 1986 conducted a pu lic hearing
for the purpose of considering the rezoning petition, and pursuan to Section
107.03 of the Administrative Code, submitted its recommendation t the Planning
Corrmission that the petition be granted; and
WHEREAS, The Planning Corr�nission considered the rezoning peti ion at_its
-�t�eeti ng he7 d �n�Apri i l i, 1986 and recommended that the City Coun i l approve the
petition; and
WHEREAS, Notice of a public hearing before the City Council o the said :
rezoning petition was duly published in the official newspaper of the City on :
