WHEREAS , the owner of the property located at 59 Irvine Park,
Saint Paul , Minnesota, located in the Irvine Park Historic
District, made application for approval to const uct an exterior
stairway to the third floor of this property; and �
WHEREAS , the Saint Paul Heritage Preserva ion Commission
reviewed the application and by its Resolution No. 609 adopted
February 13 , 1986 , denied approval of this a plication based
on the following findings of fact:
(1 ) The proposed stairway is required by cod .
(2) The proposed stairway will be high y visible from
Chestnut Street.
(3) The proposed stairway is not integra ed for balance
and complete design conflicting with new constr ction guideline
IV, building elements, contained in the Irvin Park Historic
District Guidelines.
(4) The Heritage Preservation Commissio has approved
a stairway for 59 Irvine Park in 1984.
WHEREAS , acting pursuant to Chapter 73 of the Saint Paul
Legislative Code, James I . Berg on behalf of St. Paul Steel
Supply Company, appealed this denial by the Herit ge Preservation
Commission to the City Council and the City Council having
conducted a public hearing on the matter and h ving heard from
all interested parties , and having considered t e actions taken
. by the Commission, the minutes and findings of the Commission,
and the statements made by the Appellant, does he by
RESOLVE , that the Council of the City of Saint Paul does
hereby grant the appeal of James I . Berg and doe hereby reverse

SUBJECT: STAFF REPORT -- Appeal of the HPC denial of a rmit for the
construction of an exterior stair at 59 Irvine Park.

INTRODUCTION
On May l, 1986, the City Council will conduct a public heari g on the appeal of the
Heritage Preservation Commission (HPC) decision to deny a per it for construction of a
secondary egress stairway from the third floor at 59 Irvine Park. 59 Irvine Park is a very
prominent structure in the Irvine Park Heritage Preservation Distr'ct.
The staff has prepared a memorandum to provide background an to recommend a course
of action. Staff has reviewed the proposed development for consis ncy with the adopted
Irvine Park Heritage Preservation District guidelines. Staff findi gs and recommendation
are outlined in this document.
BACKGROUND
On August 1, 1984, Merle's Construction Company, for owner Jim erg, requested a permit
to construct a secondary egress stairway from the third floor a 59 Irvine Park. The
proposed stairway was reviewed by the HPC for conformance to th guidelines. On August
9, 1984, the HPC denied the permit request for the egress stai way based upon inap-
propriate design.
On August 31, 1984, architect Brooks Cavin, representing owner ames Berg, requested a
permit to construct a redesigned stairway at 59 Irvine Park. On September l3, 1984 the
HPC approved the permit request. The approved stairway was nev r constructed.
On January 29, 1986, Mr. George Rossbach requested a perm't to construct a newly
designed exterior stairway for 59 Irvine Park. The HPC, on Febru ry l3, 1986, denied the
new permit request. The denial noted that the proposed stairway had not relationship to
the design elements of the house.
On February 18, 1986 Mr. James Berg appealed the decision of th HPC to the Saint Paul
City Council. On February 27, 1986, the City Council referre the appeal to the City
Development and Transportation Committee for consideration and ecommendation.
ISSUES AND FINDING OF FACTS
Staff has reviewed the proposed stairway to determine if it is con istent with the adopted
Irvine Park Heritage Preservation District guidelines and has foun the following:

� ' 1. 59 Irvine Park is listed as a pivotal structure in the Irvin Park Heritage
Preservation District.
2. The proposed stairway, although on a secondary elevation will be highly visible
from Chestnut Street.
3. The proposed circular metal stairway does not incorporat the massing, materials,
and building elements of the main structure and therefor does not conform to
the adopted guideline C. New Construction (New construc ion should incorporate
the general massing, rhythm, materials, and building elem nts of historic Irvine
Park structures, and should be sensitive to the architectur 1 styles evident in the
Park.) and guideline IV. Building Elements (Individual ele ents of a building
should be integrated into its composition for a balanced a d complete design.)
STAFF RECOMMENDATION
PED staff recommends that the the City Council support the Her tage Preservation Com-
mission resolution and the Irvine Park guidelines, and deny a per it for the construction
of an exterior stairway at 59 Irvine Park.

August l, 1984 Merle's Construction Company, for owner Jim Berg, requested a
permit to construct a secondary egress stairwa from the third floor
at 59 Irvine Park.
August 9, 1984 The Heritage Preservation Commission denie the permit request for
the egress stairway at 59 Irvine Park. Denial as based upon
inappropriate design.
August 31, 1984 Mr, Brooks Cavin for owner Jim Berg, reques ed a permit to
construct a rear egress stairway from the thir floor of 59 Irvine
Park.
September 13, 1984 The Heritage Preservation Commission appro ed the permit request
for construction of the egress stairway at 59 rvine Park.
January 29, 1986 Mr. George Rossbach requested a permit to c nstruct an exterior
stairway to the 3rd floor of the house at 59 I vine Park.
February 5, 1986 The Design Review Committee recommended approval of the revised
permit request.
February 13, 1986 The Heritage Preservation Commission denie a new permit request
for the construction of an exterior rear stair t 59 Irvine Park.
The permit request was denied upon no relat oship to other design
elements on the house.
February 18, 1986 Mr. James Berg appealed the decision of the eritage Preservation
Commission to the St. Paul City Council.
February 27, 1986 The City Council referred the appeal to the ity Development and

The accompanying drawing for the above referenced structure ' llustrates the
proposed secondary stairway to the Attic.
It consists of a free-standing frame structure connected to he house by a
platform at the Attic level. The intermediate platforms (on he Northeast
elevation) are open, with horizontal railings and balluster . The two sides
of the structure are enclosed with vertical siding painted o blend with the
brickwork. The corner trim, opening trim and cornice member are to be
painted a lighter tone to blend with the limestone of the h use.
This scheme, with its historical recall of the qable roof a d arched side
openings, is in keeping with the existing architecture, whi e providing a
functional need for adaptive re-use.
We recommend approval of this modification to the Berg Resi ence.

WHEREAS, the Saint Paul Heritage Preservation Commission is aut rized by Saint Paul
Ordinance �16006 to review building permit applications for exterior alteration, new
construction or demolition on or within designated Heritage Preservation Sites or
Heritage Preservation Districts; and
WHEREAS, Brooks Cavin requested a permit on August 31 , 1984, to construct a rear
egress stairway from the third floor of 59 Irvine Park; and
k�4EREAS, 59 Irvine Park is a 22 story brick Queen Anne style ho se, built in 1889,
and is categorized as being pivotal to the character of the Irv ne Park District; and
WHEREAS, the Saint Paul Heritage Preservation Commission conduc ed a public hearing
on said permit application on September 13, 1 984, pursuant to t e requirements of
Saint Paul Ordinance #16006; and
�IHEREAS, the Saint Paul Heritage Preservaion Commission , based pon evidence pre-
sented by the public hearing, made the following findings of fa t;
1 . The proposed egress stairway is required by code .
2. The proposed stairway will be �ighly visible from Chestnut treet.
3. The architectural details on the proposed stairway minimize the visual impact
it has on the main structure.
4. The proposed stairway is free standing and has minimal phys'cal contact with the
main structure .
NQW, THEREFORE, BE IT RESOLVED, TNAT, based on the above findin s of fact, the
Heritage Preservation Commission approves the permit for constr ction of the egress
stairway at 59 Irvine Park.

WHEREAS,the Saint Paul Heritage Preservation Commission is auth rized by Saint Paul
Ordinance #16006 to review building permit applications for exterio alterations, new con-
struction or demolition on or within designated Heritage Preservatio Sites or Heritage
Preservation Districts; and
WHEREAS, George Rossbach requested a permit on January 29, 198 to construct an
exterior stairway to the 3rd floor of the house at 59 Irvine Park; an
WHEREAS, 59 Irvine Park is a 2 1/2 story brick Queen Anne house uilt in 1889 and listed
as pivotal to the Irvine Park Historic District; and
WHEREAS, the Saint Paul Heritage Preservation Commission condu ted a public hearing
on the said permit application on February 13, 1986, pursuant to the requirements of Saint
Paul Ordinance #]6006, and
WHEREAS, the Saint Paul Heritage Preservation Commission, based upon evidence
presented by the public hearing, made the following findings of fac :
1. The proposed stairway is required by code.
2. The proposed stairway will be highly visible from Chestnut Stre t.
3. The proposed stairway is not integrated for balance and complet design conflicting with
New Construction Guideline IV., Building Elements.
4. The Heritage Preservation Commission has approved a stairway or 59 Irvine Park in
1984.
NOW, THEREFORE, BE IT RESOLVED, that based on the above fi dings the Saint Paul
Heritage Preservation Commission denies a new permit for the cons ruction of an exterior
rear stair at 59 Irvine Park.

Mannillo presented a motion to approve the January minutes. Glines otioned approval; it
was seconded by Frank. Thc motion to approve passed unanimously.
PUBLIC HEARING:
59 Irvine Park
Tom Zahn read tho staff report. George Rossbach wishes to construct an exterior stairway
for a 3rd floor apartment. Frank gave the design review report which tated that the
proposed stairway was more transparent than a stairway which the HP approved in 1984.
Angell read thc minutes from the 1984 meeting. During the 1984 meeti g, the northeast
elevation of the house, where the stairway is to be placed, was declared a primary facade,
due to its visibility from downtown.
Rossbach stated that the stairway would be painted tan, the same color as thc house, to
minimize its impact. Owner, Jim Berg, stated that the staircase could o ly be constructed
in the rear of the house. McCormick stated that the proposed design b re no r�lationship to
other design elements on the house. McCormick also asked about an in crior staircase.
Rossbach replied that it wasn't possible at this time. Mannillo called f r a vote on the
motion to approve the staircasc.

WHEREAS, the owner of the property locat d at 270 West
Seventh Street, Saint Paul , Minnesota, commoni known as the
Bleick House, made application to the City of Saint Paul for
permission to restore the front porch and to landscape the
front yard at this property; and
WHEREAS , the Bleick House is located in t e Irvine Park
Historic District established by the Council o the City of
Saint Paul pursuant to Chapter 73 of the Saint P ul Legislative
Code; and
WHEREAS , the Saint Paul Heritage Preserva ion Commission
acting pursuant to Section 73 . 07 reviewed the pplication for
a permit and by its resolution No. 608 dated Fe ruary 13 , 1986
approved the issuance of the permit for the estoration of
270 West Seventh Street contingent upon the ow er maintaining
the front elevation of the building as designe and upon the
elimination of the proposed circle drive, based upo the following
findings made by the Commission:
(1 ) The proposed front porch will be r stored to its
original design.
(2) The proposed chimney does not appea in the 1932
photograph of 270 West Seventh Street, however, i adds symmetry
typical to this style of architecture.
(3) The proposed bay windows on the front ele ation conflict
with the general principles for restoration and rehabilitation
No. 4 of the Irvine Park Historic District Gu' delines. (In
general it is expected that buildings will be re tored to their
original appearance) .
