86-654 WH17E - CITV CLERK PINK : - FINANCE GITY OF SAINT PALTL C cil � CANARV - DEPARTMENT / BLUE - MAVOR FII NO. �`� � � Cou cil e lution �-�- , � Presented By �ferred To (�� t�L L�- � '� ��"�� Committee: Da e �-S�'�' Out of Committee By Da e WHEREAS, The City of Saint Paul has requested that the Depar ment of Transportation grant a variance from the State's standards for desig of urban roadways for the reconstruction of EIGHTH STREET from St. Peter Street to W outa Street; and WHEREAS, The Commissioner of the Department of Transporta ion has by letter notified the City that the request for a variance has been granted up n condition that the City Council of the City of Saint Paul adopt a resolution indemnifyin , saving and holding harmless the State of Minnesota from any claims arising out of the ranting of this variance; and WHEREAS, The City has no other option availabie to it to rece' e the variance requested unless it complies with the demands of the Commissione of the Department of Transportation; now, therefore, be it RESOLVED, That as the sole condition to receiving a variance rom the provisions of State Aid Rules Section 8820.9912, the Council of the City of Sa nt Paul does hereby agree to indemnify, save, and hoid harmless the State of Minnesota nd all of its agents and employees of and from any and all ciaims, demands, actions or auses of actions of any nature or character arising out of or by reason of, in any manne , the reconstruction project on Eighth Street from Minnesota Street to Jackson Street, i any other manner than as a 72 foot wide curb to curb street in accordance with the 'nnesota Rules Section 8820.3300, and further agrees to defend at their sole cost nd expense any action or proceeding commenced for the purpose of asserting any c aim of whatsoever character arising as a result of the granting of this variance.
