WHEREAS , John McQuillan requested a building pe mit on October
31 , 1985 to construct a 30-unit apartment building t 455 Dayton
Avenue; and
WHEREAS , 455 Dayton Avenue is located within the historic
Hill Heritage Preservation District and there re pursuant
to Chapter 73 of the Saint Paul Legislative Code t e application
was subject to the review and approval of the He itage Preser-
vation Commission; and
WHEREAS , the Heritage Preservation Commission by its Reso-
lution No. 580 dated November 14, 1985 approved the issuance
of the building permit for the construction of the 30-unit
apartment building at 455 Dayton Avenue continge t upon staff
approval of the details of the entrance, railings, ight fixtures .
and bay configuration; and
WHEREAS , a group of neighboring property ow ers appealed
this decision of the Heritage Preservation Commission to the
City Council and the City Council following p blic hearing
held for that purpose and having considered the r commendations
of staff, the findings and recommendations of the Heritage
Preservation Commission, the applicant and the ap ellant, does
hereby
RESOLVE, that the Council of the City of Sa nt Paul does
hereby affirm the decision of the Heritage Preservat on Commission
in this matter and does hereby approve the is ance of the
appropriate building permits to John McQuillan fo the 30-unit
apartment building to be located at 455 Dayton venue, Saint
Paul , Minnesota, subject to the following conditions
(1 ) The visual massing of the building e reduced by

INTRODUCTION
On April 15, the City Council will conduct a public hearing on the ppeal of the Heritage
Preservation Commission (HPC) decision to approve the constructi n of a 30-unit apart-
ment building at 455 Dayton Avenue. This property is within the Historic Hill Heritage
Preservation District.
. Because of confusion on this project, staff has prepared a memorand m to provide
background and to recommend a course of action. Staff has viewed the proposed
development for: (1) consistency with the Comprehensive Plan and the Zoning Code; (2)
consistency with the Historic Hill guidelines; and (3) issues raised the appellant. Staff
findings and recommendations are outlined in this document.
BACKGROUND
On September 26, 1985 Mr. John McQuillan requested a permit construct a 30-unit
• apartment building at 455 Dayton Avenue. The proposed location, being within the His-
toric Hill Preservation District, required Heritage Preservation Com ission review for con-
formance to the Hill District guidelines. On October 10, the HPC enied the permit ap-
plication because the applicant proposed the demolition of an exis ing carriage house at
217 Arundel Street, and provided inadequately detailed plans.
Mr. McQuillan submitted plans with revisions and on Noveinber 14, he HPC approved the
McQuillan permit request. That HPC decision of approval was appe led to the City Coun-
cil by a group of neighboring property owners. On December 19, t e City Council held a
public hearing on the appeal of the HPC decision. Keith McCormi k, then c�air of the
HPC, noting inaccuracies in the submitted plans, requested that the a plication be referred
back to the HPC for review.
- On February 28, 1986, Mr. McQuillan submitted revised plans to th HPC. On March l3,
198b, the HPC reversed its original decision and denied the applicati n. That decision was
subsequently appealed to the City Council by Mr. McQuillan.
The issue coming before the City Council on April IS is the appeal b the meighborhood of
the �pnroval by the HPC.

PROPOSED APARTMENT DEVELOPMEI'VT
Mr. John McQuillan is proposing to develop a 30-unit apartment bui ding with a mix of one
and two bedroom units. The development would include 31 unde ground parking places
and 14 surface parking places. The site is located between two tructures designated as
supportive to the Historic Hill District. The proposal includes the enovation of an exist-
ing carriage house on the site.
ISSUES AND STAFF FINDINGS
�+ Staff has reviewed the proposed development to determine cons stency with the Com-
prehensive Plan, Zoning Code, and the Hill District guidelines. S aff also addresses the
concerns raised by the appellant.
A, Consistency with the Comprehensive Plan and Zoning Code.
The proposal is substantially in conformanee with the Compr hensive Plan, as
detailed below:
l. Land Use Plan (adopted 11-20-80). This Plan, in th housing component,
recognizing the projected large increases in separate households in Saint
Paul, strongly supports the construction of inedium
o high densit
housin wherever a y
S ppropriately zoned.
2. District�8 Plan (adopted 4-10-80). The land use com onent of this Plan
maps 455 Dayton Avenue on a block designated for edium-high density
residential use. This classification calls for predom' ately 3-5 story
apartments, some high-rises, some single family and uplex.
3. The site is zoned RM-2, a medium density/low-rise ultiple-family
residential district. Zoning allows 30 units on the .8 acre site.
B. Consistency with the Historic Hill guidelines
The proposal is substantially in conformance with the Histori Hill District
guidelines.
1. The plans include the preservation of the existing ca riage house.
2. The surface parking is adequat�ly buffered from Da ton Avenue and
Arundel Street.
3. The entrance is defined by a courtyard similar to ot er apartment
buildings in the Hill district.
_ 4. The height of the proposed foundation has been scre ned significantly
with site regrading. - .
5. The proposa] generally conforms to the Historic Hill istrict New
Construction guidelines on Massing, Rhythm, Material and Details,
Building Elements. and Site.

C. Concerns raised by the appellants
The major concera raised in the appeal was that the HPC wa not following its own
guidelines in approving this project. Specifically the neighb rhood objected to the
massing, aluminum siding, and the density of the developme t.
1. The appellants have contended that the massing of the building is too
great and visually overpowers the neighboring stru tures. They note
that the structure is much larger than other buildi gs on the block.
StaJj Jeels that if the building was moved back on th site that the vise�al
massing would be greatly reduced.
2. The allellants believe that the use of aluminum sid ng on a building of
this size is inappropriate. Aluminum siding is allo ed in the Hill district
if it is appropriately detailed. Although aluminun si ing is allowed within
the district, slaff recom»:ends the use oJ brick on the ayton Avenue Jacade.
Most burldings of this size within the Hill District are onstructed oj brick.
3. The appellants have also noted that although zoned appropriately (RM-2)
for a 30-unit apartment building, the proposed dev opment has a much
higher density than its neighboring structures. In a dition, the
development would greatly increase the traffic usin the 15-foot alley
between Dayton and Marshall. The site is currently oned to permit the
proposed de�:sity. However stafJ feels that the increas d alley lraJjic could be

STAFF CONCLUSIONS AND RECOMMENDATIONS
PED staff finds that the proposed development is in conformance w th the Comprehenstve
Plan, the Zoning Code, and the Hill District guidelines. We rec mmend that the City
Council approve the issuance of this permit upon the following conti enctes:
1. The visual massing of the building be reduced by moving t e structure
back on the site. The new building shouid be built at, or n rth of a line
connecting the building faces of the two adjacent structure to the east and west.
2. The Dayton Avenue facade, including the courtyard, be br k venecred
to be materially compatible with buildings of similar size ithin the Hill district.

within the Hill District. In staff's opinion, much of the debate on thi project emanates
from the neighborhood's concern that the current zoning of the Hil District is too dense.
� This issue should be evaluated by the City Planning Commission thr ugh the process of a
40-acre study to determine what zoning is appropriate to guide future redevelopment of the
area.

On March 13, 19$6 the Heritage Preservation Commission denied a p mit request by John
McQuillan to construct a 30-unit apartment building at 455 Dayton venue. 'This project,
with modifications has been denied, approved, appealed by the nei hborhood, and sub-
sequently denied by the HPC a second time. The March 13th motion deny reads: "In or-
der for the Commission to reconsider the applicants permit applicat on, it is our recom-
mendation that the applicant screen the concrete block wall in front f the building to sig-
nificantly reduce the amount of visible block."
On March 26, 1986, John McQuillan submitted modified plans as re uested by the HPC.
These plans will be reviewed by the Design Review Committee on Ap il 2, and by the full
HPC on April 10.

October 10, 1985 The Heritage Preservation Commission (H C) denied the permit
request to construct a 30-unit apartment uilding at 455 Dayton
Avenue. Denial was based upon the prop sal request to demolish
an existing carriage house at 217 Arundel and the submitted
plans were inadequately detailed.
October 31,1985 Mr. John McQuillan resubmitted a permit equested to construct a
30-unit apartment building at 455 Dayton venue
November 6, 1985 The Design Review committee recommend d denial for the
proposal because the submitted plans lacke detail in the
entrance area, railings, light fixtures, and ay configration.
November 14, 1985 The Heritage Preservation Commission ap roved a permit for the
construction of a 30-unit apartment buildi g at 455 Dayton

November 20, 1985 A group of neighboring property owners a pealed the HPC
approval of the.
December 19, 1985 City Council held a public hearing on the ppeal of the HPC
decision. Shortly before the scheduled pu lic hearing the staff
was made aware of certain inaccuracies of the submitted plans.
The concerns issued were over the indicat first floor elevation
number, and the drawn height of the two d jacent structures.
Keith McCormick, then HPC Chair, notin the inaccuracies
requested that the application be referred ack to the HPC for
full review.
February 28, 1986 Mr. John McQuillan resubmitted a request o construct a 30-unit
apartment building at 455 Dayton Avenue.
March 5, 1986 The Design Review referred request on to he full Heritage
Preservation Commission without recomme dation. Accurate
plans had not yet been submitted. McQuill n stated that they
would be complete and accurate for the M rch l3 meeting.
March 13, 1986 The Heritage Preservation Commission hel a public hearing and
after hearing testimony, voted to deny the ermit request.
March 26, 1986 Mr. John McQuillan resubmitted the permi request with the
HPC suggested changes.

This letter is to inform you of our intent to develop 30 unit apartment
building on Dayton Avenue , West of Arundel , in St . Pau . The addesses
of the lots that we propose to use are 447 to 465 Dayt n Avenue and 21 ?
Arundel . It is our plan to construct a building that ' s compatible
and complimentary to the design and character of the H' storic Hill
District . Plans and elevations shall be submitted for your immediate
consideration.
We have consulted the planning department and been advised that our
proposed developmnet conforms to the zoning regulations and requirements .
The building shall be a full 3� stories to match up with the structure
on either side . Construction of the exterior shall co sist of aluminum
siding with brick accent . Color of the siding shall be conservative
and of a nature to blend with the surrounding buildings . Windows for
this development shall be double hung as is common to t e area. Exposed
walls cf masonary for the basement shall �e :ock iaced blocks . Every
e�fort will be made to respect the integerity of the Historic Hill
District .
The buildin� itse�f shall contain 30 units with the mi ture being 18
L�so bedroom and 12 one bedroom apartl�ents . There will e 38 indoor "
underground parking stalls and 18 surface parking spaces for a total
of 56 stalls . This is 11 parking space's more than the code requires
and is almost 2 spaces per unit .
Construction of this development shall be on the lotc c own on the
accomnanving survey. An existin¢ carriaQe house on one lot shall be
demolished_. This buildin¢ was a seuarate unit and did ot belonQ
with the house proper at 443 Dayton . It had a separate lot that
faced Arundel and an Arundel adre�S •

Mannillo called the meeting to order. He asked the Commissioners f r comments regarding
the February Minutes. Hearing none, he asked for a motion of app val. lt was made b��
Glines and seconded by Frank. The minutes passed on a vote of 7-0.
Mannillo then asked the Commissioners, and then sta,ff, if they ha any announcements.
When none were oftered, he opened the public hearing.
PUBLIC HEAR�NG:
2. 45S Dayton Ave.
Tom Zahn gave the staff report. Applicant John McQuillan wants o construct a 30-unit
apartment building on the vacant lot st 455 Dayton Ave. Before d scussing thc proposal,
City Attorney Terry Sullivan stated that the Commission should only hear arguments
regarding the elevation of the first floor in plan, and the accuracy o the height of the two
adjacent structures. Concern over thesc two issuses resulted in the ity Council reterring
the projcct back to thc HPC.
McQuillan and his architect, Robert Roscoe, stated that hc had mea ured the two existing
atructures. He and McQuillan found that the proposed building wou d be similar in height
to the 6uilding on the east and lower then the one on the west. Fra k stated that the first
floor level was very high above the strect grade. Frank also felt th t the amount of con-
crete block coursing was excessive. The plans show 22 inches more e posed block then thc
existing structures. McQuillan stated that landscaping and regradi g could address this
probicm.
Testimony was presented by neighborhood residents. Laurie Fore berg of 223 Arundel
wantcd to sddress morc issues thcn thc two stated by the City Attorn y. Bill Manning, also
of 223 Arundal, challcnged Sullivans' decision. However the Chair ollowed the advicc of
the attorney and permitted only testimony regarding the two issuses.
Peter Csrlson of 482 Dayton Ave. stated that the Commission had e ceeded its guidel;nes.
Carlson also stated that the guidelines called for a review of workin drawings rather then
schematic drawings. Hc felt that the review process hadn't procccded properly and that thc
process gave no assurance that what was sta.ted would be built.
Frank felt that thc issuc of schcmatic drawings versus working draw ngs was an important
one. Sullivan cautioned the Commission to follow its own rules. Zahn notcd that the
preservation ordinance does not require working drawings for a omplctc application-
Roscoe stated that his plans were working drawings.
! Mitchell Rubinstein of 442 Dayton testited that he supportcd his n ighbors on this issue.
, Commissioner Glincs stated that he still opposcd the project, whil Commissioner Reetz
• expressed support for it. Frank claimed that the building was 9 tim s larger than anything
( on the block and thcrefore was inappropriate for the neighborhood. McQuillan voiced ob-
ijection to this remark.

a written statcmcnt on why the permit was denied. Sullivan again c utioned the Commis-
sion to only consider the two issuses.
Angell moved to ammend the motion to read that the tirst floor eleva ion and th� elevation
of the proposed build;ng to thc existing ones are accurate as presen ed. Glines seconded
this motion. The admenment passed, S-4.
, Manillo called for a vote on the Frank motion with the Angell am ndment. The motion

project was denied. Thc motion, presented by Commissioner Faric , stated: "In order for
the Commission to reconsider the applicants permit application, it i our recommendation
that the applicant screen the concrete block wall in the front o the building to sig-
nificantly reduce the amount of visible block" Farnan seconded. Th motion passed 8-l.
Frank made a motion that the Commission recommend to the ap licant that the scale,
volume and massing of the proposed building be reduced so that the tructure relates to the
adjacant buildings. Markowitz secondcd. Thc motion was dcteated 7 2.

Mannillo asked the Commissioners to read for the next HPC mee ing the hand out on
procecdures prepared by staff. The Chair noted that staff was pre aring a fee structure
for design review snd permit approval. The fee stucture is based o aimilar fees that are
prescntly in effect in other large cities. Glines cautioned extrcme are on this issue and
felt that the economic bcnefits might not justify the bad feelings ge erated in the historic
districts. Zahn notcd that fees were commonplace in cities with more seasoned programs.

At the March 13th HPC hearing, your permit request for the construc ion of a 30-unit
apartment building at 455 Dayton Avenue was denied. The Commissi n found the proposed
building in nonconformance with the Historic Hill Heritage Preserva 'on District guidelines
III. (Massing, Volume, and Height) and IV. (Rhythm and Directional mphasis). The Com-
missions motion to deny read: "In view of the new facts submitted co cerning the height of
the building and the height of the proposed foundation wall, we feel hat there is a suf-
ficant reason to deny the permit". This motion passed on a vote of 5- .
Following the advice of the city attorney, the Commission drafted a otion on what the ap-
plicant should do in order to satisfy the requirements of the guidelin . The motion read:
