THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section l . That Section 409. 08( 11 ) of the Legislative Co e be amended so as to add the following thereto: 409.08 - Regulations Generally. (11 )e - Modification of Parking Requirements . i ) The council may modify the off-street pa king requirements contained in this section u on application made for that purpose and up n findings made by the council that granti g of such modification would not have a su - stantial detrimental impact on the surro nd- ing neighborhood. Modification, if gran ed, shall be by resolution adopted by at lea t five affirmative votes. ii ) The council shall consider the applicati n at a public hearing following mailed not ce thereof to property owners within 350 fe t of the proposed licensed premises. The council may require , by resolution, the payment of an administrative processing ee for parking modification applications . ppli- cations and fees shall be made to the li ense inspector. In the event parking problem arise, the council may consider taking a verse action pursuant to the procedures set fo th in Chapter 310 of this code. Such adver e action may include requiring the license to do one or more of the following: a) Provide more off-street parking; b) Reduce the usable floor space ; c) Reduce patron capacity (seating or bar area) .
