An administrative Resolution amending the Civil
Service Rules concerning Leave of Absence.
RESOLVED, that the Civil Service Rules shall be amended in S ction 19,
Leave of Absence, by adding �he following sentence to the third p ragraph
in Subsection 19.A, Requirements for Leave of Absence.
"A full—time employee may be granted up to 160 hours of vol tary leave
of absence without pay during the fiscal year (IRS report ar) .
During such leave of absence without pay, the employee sha 1 continue
to earn and accrue vacation, sick leave and seniority cred'ts as they
relate to eligibility for merit increases. If such leave 's taken
during the qualifying pay period as it relates to the elig'bility
for city paid Health and Welfare benefits, the employee sh 11 be
considered, for Health and Welfare eligibility purposes, a though
he/she was on the p3yroll for such period. Any leave of a sence
granted under this provision is subject to the approval of the
Department Head.
The above provision does not apply to employees of the Sch ol District."

Dear Ms. Sobania:
Several days ago I received a copy of a resolution ado ed by the City
Council on January 9, 1986, regarding amendment of Civi Service rules
concerning leave of absence. This administrative resolution am nds the rules by
adding a provision which I believe has been covered for sev ral years by a
series of Memoranda of Agreement between the City and numerous argaining units
of Civil Service employees. The amendment to the rules p ovides for the
possibility of continuation of health insurance premium paymen and earning of
vacation, sick leave, and seniority for merit increases by empl ees who take up
to 160 hours voluntary leave of absence without pay. I belie e I recall that
the City instituted this practice several years ago in an effo to secure some
salary savings.
The School District has never entered into any such me oranda with the
bargaining units representing Civil Service personnel employe by the School
District. As a practical matter, it would be exceedingly dis ptive to. School
District operations to attempt to provide for and manage such eaves. This is
why we have not copied the City's practice in this matter.
The effect of the action by the Council in moving thi provision from
collectively bargained Memoranda of Agreement into Civil Servic Rules is to set
up a situation in which an argument might be made by an employe or a union that
the School District is now obligated to provide a benefit for e loyees which it
has never bargained.
I understand, based on our telephone conversation a few d ys ago, that it
was not the intention of the City to provide for School Dist ict employees a
benefit which has never been bargained by the School District nd which is not
desired by the School District. Therefore, I am requesting that an amendment to
this resolution be introduced immediately excluding the School istrict and all
School District Civil Service emploqees from the effect of this provision.
