WHEREAS, Diane Weinke has submitted the attached proposed lot s lit for City
Council approval ; and
WHEREAS, the Departments of Planning and Economic Development W rks have
reviewed the proposed lot split at 1641 East Fourth Street as d scribed on the
attached survey; and
WHEREAS, the proposed lot split meets the requirements of Secti n 67.304 and
67.406 of the Zoning Code, except for lot size and width; and
WHEREAS, the City Council on March 20, 1986 held a public heari g to determine
the advisability and necessity for the granting of variances fr m the strict
application of the provisions of Sections 67.304 and 6�406 of he Zoning Code
at which hearing all persons present were given an opportanity o testify; and
WHEREAS, following said public hearing, the City Council made t e following
findings of fact:
1. The property in question cannot be put to a reasonable use nder the
strict provisions of the code;
2. The plight of the landowner seeking to divide the property s due to
circumstances unique to her property, and these circumstanc s were not
created by the landowner; and
3. The variance� requested is in keeping with the spirit and in ent of the
code, and is consistent with the health, safety, comfort, m rals and
welfare of the inhabitants of the City of Saint Paul ; and

4. Granting the requested variance will not impair an adequat supply of
light and air to adjacent property, nor will it alter the ssential
character of the surrounding area or unreasonably diminish established
property values within the surrounding area; and
5. The variance, if granted will not permit any use of the la d that is
inconsistent with the provisions of the Zoning Code; and
6. The owners request for this variance is not based primaril on a desire to
increase the value of income potential of the parcels of 1 nd; and
NOW, THEREFORE, BE IT RESOLVED, that the City Council accepts d approves
this lot split with variance to reduce the west parcel lot area from 5,000
square feet to 4,153.75 square feet and reduce minimum lot widt from 40 feet
to 33.31 feet for property situated at 1641 East Fourth Street, legally
described as Lots 26 and 27, Dietz's Subdivision of Lot 10 of L e's Suburban
Homes.

the cost/benefit aspects of the decision. Costs and benefits related both to City

to side.
East parcel has a 2 1/2 story house located near the west proposed propert line and a
detached garage near the alley off the east property line.
West parcel is vacant with a large mature tree in the middle.
C. MINIMUM LOT REOUIREMENTS: 5,000 square feet and 40 foot width.
D. CURRENT WIDTH & AREA: 80.48' width and 10,035 square feet.
E. PROPOSED WIDTH & AREA: West Parcel: 33.31' width and 4153.75 sq. . East parcel:
47.17' and 5882.10 sq. ft.
F. REOUIRED FINDINGS:
1. The intent of this chapter is met.
2. The granting of the variance will not be detrimental to-the public saf ty, health or
