WHEREAS, the Board of County Commissioners of Ram ey County
Resolution No. 85-893 dated December 23, 1985, classi ied as non-
conservation land certain tax-forfeited properties ly ng within
the City of Saint Paul, said properties set forth on he list
attached hereto and made a part hereof; and
WHEREAS, a certified copy of the classification r solution
together with a list of the land classified has been ubmitted
for approval of the City of Saint Paul in accordance ith MSA,
Section 282 . 01, sub. l;
NOW, THEREFORE, BE IT RESOLVED, that the classifi ation of
the land shown on said list as non-conservation land nd the sale
thereof be and hereby is approved, except for th following

Attached hereto is a list of lands which have forfeited to he State of
Minnesota on August 12, 1985 for non-payment of real estate taxes. Said
lands have been declared as non-conservation lands by Resol tion No.
85-893 dated December 23, 1985 by the Ramsey County Board o Commissioners.
A copy is attached.
Approval by local government of the classification and sale of tax
forfeited lands is required by law.
Attached is a sheet of genexal information and a suggested esolution
Form for submission to your City Council.
When Council action has been taken, please return a certifi copy of
the resolution to the Office af the Land Commissioner, Room 09, Court
House, St. Paul, Minnesota 55IO2.

WHEREAS, MSA Section. 282 provides that forfeited lan s be classified
as conservation or non-conservation lands and that the classi ication be sub-
mitted to the governing body of the governmental subdivision n which the
parcels lie for approval of the classification and sale there f; and
WHEREAS, The Land Commissioner has prepared a list d ted
December 16, 1985yof parcels which forfeited for non-payment f taxes on
August 12, 1985y and recommends that said parcels be classifie as non-
conservation lands; Now, Therefore, Be It
RESOLVED, That the Board of Ramsey County Commissio rs hereby
recommends that the parcels of forfeited land as shown on sa list be
and hereby are classified as non-conservation lands; and, Be It Further
RESOLVED, That the classification be submitted to t e governing body
of the subdivision wherein the parcels lie for approval of t e classification
and sale of the lands involved.

The Classification of tax forfeited lands is governed by Min esota
Statutes Chapter 282.01, which reads in part:
"All parcels of land becoming the property of the state in t ust under
the provisions of any law now existing or hereafter enacted eclaring
the forfeiture of lands to the state for taxes, shall be cla sified by
the county board of the county wherein such parcels lie as c nservation
or non-conservation."
� As Ramsey County is basically urban, forfeited lands usually lie in
developed areas and are classified as non-conservation lands by the
County Board. Such classification .is subject to the approva of the
local governing body.
After classification by the county board, lists of forfeitur s are nre-
sented to the political subdivision wherein the land� l.ie, f r approval
of the classification. The local governing body then determ nes whether
such lands should be acquired for a public purpose or give a proval of
sale.
If the lands are to be acquired for public purposes, your at orney will
advise you about the procedure for applying for a deed, or y u can call
this office. Attached is a copy of County Board Resolution o. 80-485
dated May 19, 1980, which states that local governmental sub ivisions
shall pay an appraisal value for conveyance of tax forfeited lands which
� are to be used for re-sale purposes. If it is determined sa d lands are
to be acquired for re-sale purposes, please contact us so th t appraised
values may be set.
Following is the policy of maintenance of such forfeited lan s:
Costs incurred by local government for removal of buildings, trees, weeds
or debris should be certified to the county auditor for coll ction.
When the tax forfeited land is sold, such charges may then b recovered
as other charges for local improvements in the distribution f receipts
from sales income.
Munici alities are obli ated to maintain tax forfeited lands consistent
with ad'oinin ro erties until such time as the Land Commis ioner's
Office receives approval of sale bv Council Resolution.

All parcels of land becoming the property of the state in trust, under the pro-
� visions of any law now existing or hereafter enacted declaring t e forfeiture of
lands to the state for taxes, shall be classified by the county oard of the
county wherein such parcels lie as conservation or non-conservat on. The town
board of the town or the governing body of the municipality will be deemed to
have approved the classification or reclassification and sale wi hin 90 days of
the date the request for approval was Cransmitted to the town bo rd of the town
or governing body of the municipality. If the town board or gov rning body
desires to acquire any parcel lying in the town or municipality y procedures
authorized in this subdivision, it shall, within 90 days of the equest for
classification or reclassification and sale, file a written appl cation with the
county board to withhold the parcel from public sale. The count board shall
then withhold the parcel from public sale for one year.
Conservation Lands
Under this section, the county board may by resolution declare 1 ds so classifi-
. ed as primarily suitable for timber production, and which should e sold for such
purposes, subject to the approval of the commissioner of natural esources.
The county board may also by resolution resolve that certain lan classified as
conservation lands be devoted to conservation uses, and may subm' such resolut-
� ion to the commissioner of natural resources. Lands so accepted y .the state
will be placed under the jurisdiction of the department of natura resources,
and will be held by the state free from any trust in favor of any and all taxing
districlxs,
Non-Conservation Lands
Lands so classified may be offered for sale if it shall be determ'ned by the
county board that it is advisable to do so, subject to the approv 1 of the
local governing body wherein such lands lie or in accordance with MS 282,0�,
Sub.l.
Lands so classified may be withheld from sale by the county board for a period of
one year, if the board is of the opinion that such lands may be r quired by the
state or any municipal subdivision thereof for public purposes.
Lands so classified may be acquired by any governmental subdivisi n of the state
by direction of the county board upon payment of the appraised va ue,. or� by dir-
ection of the commissioner of revenue, subject to the approval of the county
board, without payment of any consideration, but subject to certa n restrictions
as to public use.

Since the County of Ramsey does not have timber lands, or state c nservation areas
within its boundaries, all tax forfeited lands are classified as on-conservatiori
lands so that jurisdiction oNer such lands remains with the count and its sub-

Immediately after forfeiture, the lists of lands forfeited to th State for
non-payment of taxes are certified to the Office of the Land Co issioner by
the Office of the County Auditor, Department of Taxation and Rec rds Administration.
Appropriate records are prepared and maintained for the purpose accounting for
all such land.s, the properties are inspected as soon as possible fter forfeiture,
and as often as necessary thereafter. This procedure, along wit the information
received from the various sources cited hereafter, is used to pre are the Land Comm-

Costs incurred by loc:al government for removal of buildings trees, weeds
or debris should be certified to the county auditor for col ection.
When the tr�.x forfeited land is sold, such charges may then e recovered
as other charges for local improvements in the distribution of receipts
from sales income. ` .
Municipalities are obligated to maintain tax forfeited land consistent
with ad,joining properties until such time as the Land Commi. sioner's
Office receives approval of sale by Council Resolution.
