An Ordinance amending Chapter 60 of the Saint Pau
Legislative Code pertaining to zoning for the Cit
of Saint Paul and the zoning maps thereof.
WHEREAS, Pursuant to Minnesota Statutes, . 462.357 and . 64.2 0 of the
Legislative Code, Edward Kieger duly petitioned to rezone one par el located on
west side of Western Avenue between Atwater and Topping from RT- to I-1
for the purpose of constructing an office and warehouse the peti ion having been
certified by the Planning Division on December 3, 1985 as having een consented to
by at least 67% of the owners of the area of the property to be r zoned, and
further having been consented to by at least two-thirds of the ow ers of the
property situated within 100 feet of the total contiguous propert within one year
preceding the date of the petition; and
WHEREAS, The Zoning Committee on February 6, 1986 conducted a public hearing
for the purpose of considering the rezoning petition, and pursuan to Section
107.03 of the Administrative Code, submitted its recomnendation t the Planning
Commission that the petition be granted; and
WHEREAS, The Planning Comnission considered the rezoning peti ion at its
meeting held on Februry 14, 1986 and recorr�nended that the City Co ncil approve the
petition; and
WHEREAS, Notice of a public hearing before the City Council o the said
rezoning petition was duly published in the official newspaper of the City on
February 22, 1986 and notices were duly maiied to each owner of a fected property
and property situated wholly or partly within 350 feet of the pro erty sought to
be rezoned; and
WHEREAS, A public hearing before the City Council , having bee conducted on
March 6, 1986 where all interested persons were heard, and the Co ncil having
considered all the facts and recomnendations concerning the petit on; now,
therefore,

THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1.
That the zoning map of the City of Saint Paul , Sheet No. 12,a incorporated by
reference in Section 60.301 of the Saint Paul Legislative Code, a amended, is
hereby further amended as follows:
That property located on the west side of Western
between Atwater and Topping being more particularly
described as Lot 3, Block 12, Foundry Addn., Merria
and Morre's Rearrangement be and is hereby rezoned
from RT-1 to I-1
Section 2.
This ordinance shall take effect and be in force thirty (30) ays from and
after its passage, approval and publication.

On February 6, 1986 the Zoning Committee of the Planning Commission � eld a public hear-
ing on this rezoning. The petitioner testified. At the close of the public earing, the Com-
mittee voted 4 to 0 to approve the rezoning based on staff findings.
On February 14, 1986 the Planning Commission upheld the Zoning Com ittee's recommenda-
tion on a unanimous voice vote.
This rezoning is scheduled to be heard by the City Council on March 6, 1 86. Please notify
me by March 4, 1986 if any member of the City Council wishes to have s ides of the site
presented at the public hearing. '

WHEREAS, Edward Kieger, File #9843 has petitioned to rezone Lo 3, Block 12,
Foundry Addn. , Merriam and Morre's Rearrangement, Western Aven e situated
between Atwater Street and Topping Street from RT-1 to I-1 for the purpose of
permitting construction of an office and warehouse; and
WHEREAS, the Zoning Comnittee of the Planning Comnission, on F bruary 6, 1986,
held a public hearing at which all persons present were given n opportunity
to be heard pursuant to said petition in accordance with the r quirements of
Section 64.400 of the Saint Paul Legislative Code; and ,

WHEREAS, the Saint Paul Planning Corrmission, based on the evid nce presented
to the Zoning Cortmittee at the public hearing as substantially reflected in
the minutes, made the following find3ngs of fact:
1. The applicant plans to sell the vacant lot, the three ots to the
south and a large parcel to the west of this lot (whic are already
zoned I-1). �
2. The new owner intends to construct one building, two s ories high, for
office and warehouse use.
3. It is the intent of the I-1 district to allow wholesal and warehouse
activities as well as all principal uses permitted in he B-3 district
"whose external, physical effects are restricted to th area of the
district and in no manner affect the surrounding distr cts in a
detrimental way.° Sec. 60.611.
4. The new building will be home to Custom Drywall Inc. , hich is now
located on Atwater Street. It will provide warehouse pace for some
construction materials and office space. Egress and i gress for truck
traffic will occur on Atwater Street while office use ill have entry
on Western Avenue. This type of use will not affect t e residential
area to the north in a detrimental manner.
5. The City's comprehensive plan provides the following g idelines for
determining appropriate land use for vacant or underut lized

H. STAFF COMMENT: The City desires to keep growing firms by help ng them find the
sites they need in St. Paul . Where feasible, new sites may be created. The
comprehensive plan states that the City will encourage conditi ns which allow the
mixing of appropriate lignt industry with housing if separatio and buffering
requirements can be met.
In this case, the site plan provided indicates that all separa ion and buffering
requirements will be met by this development. In addition, a 5' front yard
setback will mirror the residential setback to the north on We tern Avenue.
Other, site-specific.considerations which may be a factor incl de topographical and
transportation considerations and the size and shape of the pa cel which may limit
its effectiveness for one or another use.
In this case, size and topographical considerations do not pre lude development for
two-family residential use. However, the situs of this parcel appears to indicate
that residential development is highly unlikely; while proximi y to other
industrially zoned land and rail and truck transportation rout s may be a boon to a
light industrial user.
