per File No. 21-1985, to vacate part of Summit L ne between
Lawton Street and F3eather Drive, that section of pu lic street
hereinafter described be and the same is hereby aca'�ed and
discon�inued as a �ublic street:
That part of Summit Lane lying adjacent to Lots and 2,
Block 2, Terrace Park Addition to the City of 5t Paul,
Ramsey County, Psinnesota, described as follows:
Commencing at the Southeast corner of said ot 1;
thence iaest (assumed bearing) along the Sou h
line of said Lot 1 and 2 a clistance of 62 .3
feet to the point of beginning of that part of
Summit Lane �to be described; thence South a
distance of 5. 90 feet; thence East a aistan e
of 9 . 50 feet; thence North a distance of 0 .
feet; thence East a distance of 4 .40 feet; hence
North a distance of 2 . 90 feet; thence West
distance of 4 .40 feet; thence North a dis�a ce
of 2 . 50 feet to the South line of said Lot ;

l . That the vacation be sulbject to all the terms and
conditions of Chapter 130, codified P�tarch 1, 19 l, of the
St. Paul Legislative Code, as amended.
2 . That the peti�ioners, at their own exp nse, must
construct and maintain at each corner of the all y (lane) ,
4" diameter x 8 ' long concrete filled pipe posts placed 4 '
deep into the ground, cemented in conerete filled holes and
wrapped with Scotchlite over the top 3 ' of said osts a

5 . That a specific easement be retained ithin the
vacated area to �ro-tect the interest of Northwe tern Bell
Telephone Company.
6 . That �he vacation accornmodate certain en roachments
wi�thin the vacated area and that upon reznoval, demolition
or otherwise non-exis�.ence, said vacated land shall a �tomatical-
ly revert to the City of Saint Paul as public r ght-of-way
without cost to the City.
7 . That the petitioners pay to the City of Saint Paul
$500 . 00 as administra'tive costs for this vacation.
8 . That the petitioners, their successors o assigns,
by acceptance of the terms and conditions of this vacation,
agree to indemnify, defend and save harmless th City of
Saint Paul, its officers ana employees from all suit , actions
or claims of any character, including but not imited to
a claim brouqht because of any injuries or damage received
or sustained on account of this vacation, by a y persons
or property; or because of any act of omission; eglect or
misconduc� of said petitioners; or because of y claims
or liability arising fran or based on any violation of any law or regula-
