WHEREAS, the Council of the City of Saint Paul by resolution
C.F. 99673 approved January 17, 1935, condemned an e sement for
slopes, cuts and fill in the grading, widening and construction
of East Third Street from Clarence Street to White B ar Avenue;
and,
WHEREAS, during the past 50 years, the land lyin southerly
of Third Street and in the slope easement area has bee filled in
and improved; and,
WHEREAS, the improvements upon the land are en umbered by
these easements for slopes, cuts and fill and as a esult, the
Title Company has taken exception to the title of this land;
THEREFORE, BE IT RESOLVED, that the City of aint Paul
hereby releases all of its interest in the easement or slopes,
cuts and fill from the widening of said East Third S reet over
the land described as follows:
All of the easement for slopes, cuts and fill o er Lot 1,
Block l, Birmingham Place 2nd Addition.
BE IT FURTHER RESOLVED, that the Council of he City of
Saint Paul hereby authorizes and directs the p oper City
Officials to execute a Quit Claim deed to release its ' nterest in
the easement described above to Gaughan Land, Inc.

SUBJECT: RELEASE OF EASEMENT FOR SLOPES, CUTS & FILLS IN THE
WIDENING OF EAST THIRD STREET '
In March, 1935, the Council took action to obtain a slope, cu and fill
easement in the widening of East Third Street. (C. F. 94673) . Doc. 4�154340.
The property , then known as Eret's Addition and Stinson's Fr ces Street
Addition (Block 18) , was a large gully, and probably needed m ch fill as
shown on the attachments to the copy of tk�e Council File. Th'rd Street
was widened 20 feet (i0 feet on either side of the right-of-w y lines) .
Subsequently, in 1956 , these two additions were replatted to astview
Addition No. 3. This plat shows only the ten (10) foot widen ng, which
was not included in the platted lots. In December, 1985 , the land was
again replatted over only that land included. in Eastview Addi ion No. 3,
and shows Third Street at 80 feet width.
The Title Company is making an exception to title in that the easement
taken in 1935 for the widening, covered much more land than w s included
in the ten (10) foot widening. The gully has been filled, an this is now
level land consistent with the level of East Third Street. I asmuch as all
tHe land needed for the widening of East Third Street is sho in the plat
for Birmingham Place Addition No. 2 as "E ast Third Street" an if the City
needed to exercise its rights under the easement taken , it wo ld not be for
"fill" as shown on the plans attached to the 1935 easement , w are asking
that the City release its easement on land described as follo .
The easer�ent for slopes , cuts and fills , contained in
Document N o. 154340, (Council File No. 94673,
approved March 27 , 1935) lying South of the North line
of Lot � l, Block 1, Birmingham Place 2nd Additian.
T1�e Title Company will then insure the units along Third Stre within the
plat, and allow the Developer's buyers to obtain mortgage fin cing to pur-
chase those units. The cleanest way to handle this matter at his time is
f or the City to Quit-Claim its interest by a deed to Gaughan and , Inc.
The units are now finished, �nd buyers are anxious to close, e would
appreciate your help in concluding this matter as soon as poss ble. If I
can assist in any, let me know.

Osceola Avenue southbound from Llnwood Avenue to Pleasant
Avenues.
Matter sent back to Ctty Council with recomnendations.
5. VACATION: Petltton of the Housing and Redevelopment
Authority for the vacatton of part of Stbley and Jackson I
Streets between Kellogg Blvd. and Fourth Street. The �
vacated area aill be used for the new KTCA Broadcasting
Station. (laid over from 2/19/B6)
Recortmended approval.
. 6. FINAL OROERs Acquisitton of certain property for the
Luella Stormwater Ponding area site legally descrtbed as
follows: The west 191.89 feet of Lot I. Block 2,
Kaulfolds Additlon, except the north 135 feet (bounded by -
the east-Nest alley south of Maryland, Luella Street and
the Raiiroad). (lald over from 2/19/86).

7. RESOLUTION: Offering reconveyance of Lots I-5, Block 6.
