RE: Claim against the City of Saint Paul

The plaintiff in this action was sixteen years ol in 1982 when
he fell off a ropeswing at Phalen Lake and broke is leg. The
swing was evidently not put up by plaintiff but w s of a type
which had been taken down before by Parks personn l. Various
such swings were put up in trees in the past, by nknown individ-
uals, and used to swing out over the water.
Plaintiff suffered a fractured tibia and fibula a d currently is
given a 10% permanent partial disability of the 1 g. Plaintiff ' s
medical expenses were slightly over $1, 300 .
It was the opinion of the staff that liability in this case is
somewhat questionable however, the injuries were erious and becuase
the plaintiff was a minor, a sympathy verdict is lways possible.
The City Attorney' s office has agreed to settle t e case for $500 .
