THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:

Section 1. ��
That Section 18.02 paragraph (1) of the Saint Paul Legis�:ative Code �
is amended to read as follows:
(1) Hearing, petition, filing fee, notice. Exeept-4n-ed��e-ef-emerqenep

tn-9eetren-�5.-96 With the following exceptions, any person affjected by
any order, notice of which has been issued in connection with �he enforcement
of any provision of the Housing, Building, or Fire �rebentien odes,
or any rule or regulation adopted pursuant thereto, may reques�t and shall
be granted a hearing before the board of appeals on all matter�; set forth
in such notice; provided that such person shall first file wit1� the board
of appeals a written petition requesting such hearinq and settltng forth
a brief statement of the grounds therefor within 30 calendar d�ys after
the original notice of code violations was served.
EXCEPTIONS: a. In the ease of condemnation as unfit for

human habitation, pursuant to Section 34.1�(2) ,

the written petition as described above sh�,ll be
made and €iled within ten calendar days fr �m the
date the placard was posted as required by �Section
34.19(3) .

b. In the case of emergency vacation of dwel�,ing
or rooming unit or units pursuant to Sect�.on
34.18(5) or condemnation of dangerous str�ctures
structures pursuant to Section 34.19(1) ,
appeals shall be made as provided for in t��hose
sections; or
c. In the case of the abatement of nuisances
pursuant to Chapte� 45, appeals shall be ,
made as provided for in Sections 45.04 and� 45.07.
The filing fee for such a petition shall be $10 except that wh�re there
is financial hardship and after recommendation of the enforcing officer,
the appeals board may waive the filing fee subject to the approval of
the city council. The filing fee may be refunded by the city council
after the appeals board has made such a recommendation under �� ny of
the following situations: (a) there is a financial hardship, (]�) it is
found and determined that the appeals board lacks jurisdictionito hear
the matter, (c) if the petitioner requests to withdraw the pet tion for
appeal after the petition is filed but before the appeals boar commences
the hearing on the matter, a�el or (d) where it is found and de �ermined
that it would be in the best interests of the city of Saint Pa �l to grant
such a refund. Upon receipt of such petition, the board of ap eals shall
set a time and place for such hearing and shall give the petit'!oner written
notice thereof. At such hearing the petitioner shall be given �'opportunity
to be heard and to show why such notice should be modified or v�ithdrawn.
The hearing shall be commenced not later than 30 days after thej day on
which the petition was filed; provided, that upon application di the
petitioner the board of appeals may postpone the date of hearing for
a reasonable time beyond such 30-day period if in its judgment �the petitioner
has submitted a good and sufficient reason for such postponement.
