Hancock' .vi ; - Assistant City Attorney ___ DATE: February 18, 1986 RE: Judy Miller v. Rent A Bug and City of St. Paul This action was filed by Judy Miller in 1984 alleging she injured her back and neck on December 6, 1983 when she fell on the sidewalk at 1614 University Avenue. The commercial tenant at that location, codefendant Scott' s Imports, is contributing $4 , 500 in settlement while the City has agreed to pay $500 . The plaintiff claims the sidewalk was unshaeled for a substantial time in that there was no significant snowfall or thawing/refreezing for at least 10 days to 2 weeks prior to her fall. Although the City attempts to delegate snow-shoveling responsibility by ordinance because of ownership, the city is ultimately liable where the adjacent property owner/tenant fails to shovel. Ms. Miller sustained a cervical and lumbar strain with no permanent injury. She was treated with physical therapy and her total medical bills were $264 . 59 . c r;; _, w rr;- .
