WHEREAS , The Council of the City of Saint Paul, by Council
Resolution C.F. 273361 approved July 23, 1979, did vacate certain
public land located in the City of Saint Paul, and specifically
described as follows:
That part ofthe alley as platted in Block 4 of
Snelling Park to St. Paul, Minnesota lying between
the south line of Iglehart Avenue and a straight
line connecting the southeast corner of Lot 7 and
the southwest corner , as .platted, of Lot 5 all in
same said plat; also
Commencing at the southeast corner of Lot Seven (7)
in Block Four (4) of Snelling Park to St. Paul,
according to the plat thereof on file and of
record in the office of the Register of Deeds
in and for said County, for a place of beginning;
thence east 25 feet to a point; thence north
25 feet to a point; thence north 45 degrees west
to a point on the westerly line of Lot Five (5)
in Block Four (4) of said Snelling Parkf thence
south along said westerly line of said Lot Five
(5) , to the southwest corner of said Lot Five (5) ;
thence southwesterly to the place of beginning;
WHEREAS, based upon utility easement Certificates of Intended
Non-Use filed voluntarily on behalf of Northwestern Bell
Telephone Company, the Department of Public Works , the Water
Utility, Continental Cablevision, District Heating Development
Company and Western Union attached hereto and made a part hereof
by this reference, the City for itself and on behalf of these
corporations and departments waives the right to utility
easements in the vacated areas as described in the Certificate of
Intended Non-Use.

NOW THEREFORE BE IT RESOLVED, pursuant to Section 130.06 of
the Saint Paul Legislative Code and on behalf of the City of Saint
Paul and those persons for whom the City has reserved easements,
the Council of the City of Saint Paul does hereby waive and
release the retained utility easements in the vacated public
property as specified in the Certificates of Intended Non-Use
which are attached hereto and made a part hereof; and
BE IT FURTHER RESOLVED, that upon passage of this Resolution
the City Clerk is hereby authorized and directed to file a copy
of this resolution for recording in the office of the Register of
Deeds of Ramsey County.

The Public Works Committee at its meeting of February 19, 1986 took the
following action:

1 . 3/6/86 VACATION: Petition of the American National Bank for the
vacation of part of tf�e alley in Block l , St. Catherine
Park located at Highland Parkway and Cleveland Avenue for
the purpose of a drive thru bank.
Recommended approval with caveat before public
hearing Mr. Senger has option of ineeting with Councilman
Drew and the Bank to see if his concerns can be
addressed.
2. 2/25/86 VACATION: Petition of Tibor and Olga Zoitai for the
vacation of part of Summit Lane located between Lawton
Street and Neather Drive for the purpose of constructing
a wood deck at the rear entry way.
Recommended approval .
3. RESOLUTION: waiving retained utility easements in the
alley in Block 4 of Snelling Park as vacated by C.F.
273361 . (2-4-86)
Recommended approval .
4. RESOLUTION: authorizing the Mayor to appty to the
Metropolitan Council for a short-term loan to the City to
cover costs of base-mapping needed to rebuild Shepard
Road, Harriet Island Levy and other Riverfront studies.
