TO: CITY COUNCIL

The attached resolution authorizes payment of $5 ,000.00 to
Albert Baisi and Gesella Baisi , d/b/a Alary' s Bar for damages
sustained by them for the loss of business caused by the City' s
denial of their request to transfer licenses from 457 Wabasha
to 249 W. 7th Street. The City Council denied the license
transfers in November of 1984. Following a hearing, Judge
Schultz found that the actions of the City were unauthorized
and issued an order requiring the granting of the license trans-
fers . In a pre-hearing conference Judge Mulally indicated
that Judge Schultz ' s decision was final , and the matter was
then to be tried to determine the amount of damages that the
Plaintiffs had sustained. The City Attorney has recommended
that the claim be compromised and settled for the sum of $5 ,000,
representing the amount of claimed loss earnings for the period
of time that the licensee-Plaintiffs were not allowed to operate
their business at the new location.
