McCormick ���/�.� SZ" Assistant City Attorney - Re : Assessment Appeal of Earl Stenberg for improvement of alley, Assessment File No. 2525, District Court File No. 470775 On December 6, 1984 the City Council levied an assessment in the amount of $860 . 67 for the improvement of an alley adjacent to Mr. Earl Stenberg' s property, Mr. Stenberg filed an apneal of the assessment on December 21, 1985 which was assigned Jistrict Court File No. 470775 . Mr. Stenberg' s property is unusually located in �that it is bounc�ed on its east and south side by alleys . The improvement which is the subject of this suit was for the alley located on Mr. Stenberg' s east side. In preparation for trial in this r:matter, Valuations Engineer J. William Donovan viewed the subject property and after recon- sideration believes that the amount already paid by Mr. Stenberg would be a fair amount to be assessed aqainst this property in terms of benefit received as a result of this improvement. The amount paid by Mr. Stenberg is $450 .00. As attorney for the Ci�y in this matter I concur with 1vir. Donovan' s analysis and believe the case should be settled for the $450 . 00 amount that has already been paid. That since the time of the assessment levy the Appellant has made one payment in the amount of $450 . 00 which was credited as a payment of $435.84 against the principal and $14 . 16 against the interest accrued. That the City of St. Paul has agreed to reduce the amount of the original assessment to $435 .84 . As a result Appellant' s payment of $450. 00 is sufficient to cover said amount plus the interest that has accrued � and in effect has paid the assessment in full . Any remaining amounts owed will be excused from payment and removed from the property tax roles.
