WHEREAS, Municipal State Aid funds are the primary source of monies for
city street building and repair projects; and,
WHEREAS, Municipal State Aid standards are set by Administrative Rule;
and
WHEREAS, the Administrative Rule setting forth street widths/parking re-
� strictions, Sections 8820.9912, 8820.9913, and 8820.9919, for urban state-aid
streets does not recognize that older built-up cities are limited in their
ability to widen a street due to lack of public right-of-way; lack of adequate
snow storage space; loss of existing trees and their high replacement cost; and
WHEREAS, the Administrative Rule setting forth street widths/parking re-
strictions does not recognize the severe hardship to residents due to the lack
of adequate on-street parking in high density or predominantly small lot size
or pre-garage era construction neighborhoods when requiring a parking ban on
one or two sides of a street; and
WHEREAS, the Administrative Rule setting forth street widths/parking re-
strictions does not allow a municipality the flexibility to respond to each
street's and neighborhood's individual characteristics and needs; and
WHEREAS, the variance process established by statute is costly and time
consuming for both the municipality and the Department of Transportation; and
WHEREAS, the variance process established by statute does not recognize
that older, built-up cities continually need variances for existing regulations
regarding street width/parking bans for urban state-aid streets; and

WHEREAS, state statute allows a petition process, which can request that
an agency or department adopt, suspend, amend or repeal an Administrative
Rule; now, therefore, be it
RESOLVED, that the City of Saint Paul file a valid petition with the
Department of Transportation, which will repeal street widths for urban state-
aid streets; and be it
FURTHER RESOLVED, that the Director of Public Works coordinate with the
City Attorney's Office, and file a legal petition with the Department of
Transportation, and follow the process to completion.
