WI�REAS, the Legislative Hearing Officer recommends that license application (ID # 19490002930} for a
Second Hand Dealer-Motor Vehicle License by Clinton Marshall, DBA Marshall Motors, Inc., 1265 Arcade
Street, be approved with the following condirions:
1) There shall be no more than fourteen "For Sale" cazs on the lot at any one time. Eight off-street pazking
spaces, inciuding maneuvering azea, must be maintained for customers in accordance with city
requirements. "Thru-access" must be provided at all times to allow vehicles entering or exiting the site to
be traveling forwazd.
2) An obscuring fence, 6'0" high must be installed along the west property line between the building and a11ey.
If a new fence is installed, it must be constructed of wood materials. Plastic slats inserted in the existing
chain link is also acceptable as a screening device. This condition must be complied with by September 1,
1999.
3) Use of the driveway on Arcade Street nnmediately north of Orange Avenue must be discontinued. Wheel
stops or similar devices must be installed at the property line to prevent vehicular access to the property
from this driveway.
4) No outside storage is perxnitted. No cars that are For Sale shall be parked on the street.
5) No auto repair or auto body repair is allowed on the licensed premises. Washing, waacing, and cleaning
vehicles intended for sale is aliowed.

The meeting was called to order at 4:16 p.m.
3ohn Nesheim, President of Marshall Motors, appeared.
Gerry Strathman stated this heazing is being held to hear objecrions to the issuance of a second
hand dealer-motor vehicle license to Marshall Motors, Inc., 1265 Arcade Street. LIEP is
recommending approval of the license with conditions. Mr. Strathman received a letter with a
petition attached to it signed by 18 people. They raise objections to past experiences as follows:
lack of street pazking, high volume of tr�c, snow pile up, lack of cleanliness, failure to repair
fence, using alley way as an entrance(exit, and constant noise. The letter also sites crime
potential and the lot being too small. Mr. Strathman has read the response letter from Mr.
Nesheim. In addition, Mr. Strathman received a phone call from Kernut Bergendahl, one of the
signers of the pefition, who reiterated his objections to the issuance of the license and citing the
same reasons as mentioned in the letter.
Mr. Strathman asked did Mr. Nesheim receive a copy of the letter with the petition. Mr.
Nesheun responded he did.
Do the conditions address the legitimate concerns of the neighbors, asked Mr. Strathman. Larry
Zangs responded they do. LTEP is trying to provide for a fixed number of vehicles for sale and
for customer pazking. It should work.
Steve Wewerka, 780 Orange Avenue East, appeared and stated there was a car dealership at 1265
Arcade Street previously and it increased traffic. There are 16 kids that live in the 2 block area.
Sometimes the stop signs get passed by. Mr. Wewerka talked to five neighbors who all had the
same concerns: increased traffic, not being aware of the stop s3gns, being unaware of the children
in the neighborhood. There seemed to be a lot of kids loitering in the lot.
Did he see the letter from John Nesheim. Mr. Wewerka responded he did not.
(Mr. Nesheim gave Mr. Wewerka several capies of his letter.)
Mr. Strathman asked is there something about this business that creates mare traffic than another
business. Mr. Wewerka responded yes because it is a caz dealership. There is only room on the
lot for about ten cars. There were a number of oazs that were always parked on the side of the
road. Having that many cars there meant that customers had to go fizrther down the sireet to find
a place to park.

Mr. Nesheim stated he is sensifive to parking issues because he lives near St. Thomas College
and has had problems pazking neaz his home. He signed a condition on the license that only
fourteen cars can be pazked for sale on 1265 Arcade S�eet. His business must provide eight
customer pazking spots. He has also agreed to hang signs on the door and desks telling people
that if their car is pazked on the street, to bring it to the lot. The business has thought about
telling customers to drive down Arcade Street to test drive a vehicle.
As for crime, Mr. Nesheim does not know if his type of business increases crnne. There are
some key items people look for in vehicles. If there are cars with expensive wheels on the lot,
they wili store them off site. Nice stereos will be taken out. They pian to install additional
outdoor lighting. Also, a security system will be installed on the building.
He is concerned that things will not be adhered to, stated Mr. Wewerka. He suggested the
neighborhood have a way to address Mr. Nesheim or the manager on site personally. Mr.
Nesheim responded he would be open to doing that. He sent a letter to Ali and Bonnie
Noghabaie (the people who sent in the objection letter with the petition). Mr. Nesheim just gave
Mr. Wewerka ten copies of this letter with the five conditions, so that other neighbors can get
copies.
Mr. Nesheim stated he noticed some of the problems when attempting to purchase the properry:
the refuse, the fence, and the lighting. He hopes to be a conscientious neighbor. He will keep
snow off the sidewalks.

He is concerned that things will not be adhered to, stated Mr. Wewerka. He suggested the
neighborhood have a way to address Mr. Nesheim or the manager on site personally. Mr.
Nesheim responded he would be open to doing that. He sent a letter to Ali and Bonnie
Noghabaie (the people who sent in the objection letter with the petition). Mr. Nesheim just gave
Mr. Wewerka ten copies of this letter with the five conditions, so that other neighbors can get
copies.
Mr. Nesheim stated he noticed some of the problems when attempting to purchase the properry:
the refuse, the fence, and the lighting. He hopes to be a conscientious neighbor. He will keep
snow off the sidewalks.
Gerry Sirathman recommended approval of the license with the foilowing conditions:
1) There sha11 be no more than fourteen "For Sale" cars on the lot at any one time. Eight off-
street pazking spaces, including maneuvering area, must be maintained for customers in
accordance with city requirements. "Thru-access" must be provided at all times to allow
vehicles entering or exiting the sit� to be traveling forwazd.
2) An obscuring fence 6'0" high must be installed along the west property line between the
building and alley. If a new fence is installed, it must be conshucted of wood materials.
Plastic slats inserted in the existing chain link is also acceptable as a screening device. This
condition must be complied with by 5eptember 1, 1999.
3) Use of the driveway on Arcade Street immediately north of Orange Avenue must be
discontinued. Whee1 stops or similar devices must be installed at the property line to prevent
vehicular access to the properry from this driveway.
4) No outside storage is pernutted. No cars that are For Sale sha11 be parked on the street.
5} No auto repair or auto body repair is allowed on the licensed premises. Washing, waYing,
and cleaning vehicles intended for sale is allowed.
