WHEREAS, Donald Jones had applied for a non-conforming use
permit under the provisions of Section 62.102 (5) (11 ) of the
Saint Paul Legislative Code for the purpose of continuing an
auto repair business in an R-4 zoning district on property
located at 483 W. Lawson and legally described as the west
1/3 of Lots 8 , 9 and 10, Block 3 , Alabama Addition No. 1 to
the City of Saint Paul ; and
WHEREAS , following a public hearing with notice of affected
property owners the Planning Commission of the City of Saint
Paul by its Resolution No. 85-89 dated October 25 , 1985 , denied
the said application; and
WHEREAS , the decision of the Planning Commission was appealed
by Donald Jones to the Saint Paul City Council and the City
Council , acting pursuant to Section 64. 205 through 64. 208,
and upon notice to appellant and other affected property owners
conducted a public hearing on December 12 , 1985 wherein all
interested parties were given an opportunity to be heard; and
WHEREAS , the Council having heard the statements made
and having considered the application, the report of staff,
the minutes and findings of the Planning Commission and its
Zoning Committee does hereby
RESOLVE , that the Council of the City of Saint Paul does
hereby reverse the decision of the Board of Zoning Appeals
in this matter and does hereby grant the application for a non-
conforming use permit so as to allow the applicant to continue
to operate an auto repair business in the R-4 zoning district
in his property at 483 West Lawson; and, be it
FURTHER RESOLVED, that the appeal of Donald Jones be and
is hereby granted; and, be it

On October 17, 1985, the Zoniny Committee of the Planning Commission held a

C. GROUNDS FOR APPEAL
1. Refusal to grant non-conforming use permit to Mr. Jones
was contrary to Zoning Code 62. 102 (5 ) ( 11) , since following
a public hearing, the Zoning Committee of the Planning
Commission determined, by a 5-1 vote, that this permit
should be granted.
2 . Planning Commission members made misstatements of fact at
their discussion of this permit regarding Applicant' s hard-
ship and the character of his neighborhood, facts which had
been clearly explained at the public hearing portion of
this matter. Applicant and his counsel could not comment at
the time of discussion because staff indicated that was only
appropriate at the time of public hearing. Applicant or
his counsel, who were present for the Commission meeting,
should have been offered time to respond to these misstatements.
3 . The Planning Commission erred in deciding this permit on
the basis of subjective views of commission members at the
time of the full commission' s discussion of this matter,
rather than based on the information presented at the
public hearing, at which time no neighborhood residents
appeared after all had received notice.
4 . The Planning Commission' s decision was arbitrary and capri-
cious, adn counter to the weight of the testimony presented
at the public hearing. In addition, the Commission inappro-
priately considered cosmetic factors relating to this prop-
erty rather than following the analysis of Zoning Code Section
62 . 102 ( 5 ) ( 11) .
5 . The Commission failed to consider the impact of local heavy
industrial uses on applicant' s neighborhood, and applicant' s
unique personal hardship if use is discontinued.

WHEREAS, Donald Jones, File #9817 has applied for an application for a non-
conforming use permit under the provisions of Section 62.102(5)(11) of the
Saint Paul Legislative Code, for the purpose of continuing an auto repair
business in an R-4 zoning district on property located at 483 West Lawson
legally described as west 1/3 of Lots 8, 9, and 10, Block 3, Alabama Addition
No. 1; and
WHEREAS, the Zoning Cormnittee of the Planning Comnission, on October 17 , 1985,
held a public hearing at which all persons present were given an opportunity '
to be heard pursuant to said application in accordance with the requirements
of Section 64.300 of the Saint Paul Legislative Code; and
WHEREAS, the Saint Paul Planning Commission, based on the evidence presented
to its Zoning Committee at the public hearing as substantially reflected in
the minutes, made the following findings of fact:
1. The auto repair business is not similar to other uses permitted within the
R-4 One-Family Residential District. Permitted uses in the district are
one-family homes and compatible neighborhood uses such as parks, schools,
and churches. An auto repair business is first permitted as a special
condition use in the B-3 General Business District. .
2. The use is a commercial use which is neither similar nor appropriate to
adjacent residential property and the community.
3. The three stall auto repair use requires six off-street parking spaces and
the duplex requires three off-street parking spaces for a total of nine
spaces. The applicant's site plan shows six off-street parking spaces.
However, two of the spaces, on the side of the house, are located in a
required side yard. Parking is not allowed in a side yard. Consequently,
only four off-street parking spaces are available. Four spaces are
inadequate to serve an auto repair use and a duplex.

4. The District 6 Plan's Proposed Land Use recommends residential use for the
parcel and surrounding area.
5. That the show of hardship was not sufficient.
6. That approval of the permit would be spot zoning. .
NOW, THEREFORE, BE IT RESOLVED, by the Saint Paul Planning Commission that
under the authority of the City's Legislative Code, the application for a non-
conforming use permit for continuance of an auto repair business at 483 Lawson
be denied.

PRESENT: Nknes. Morton, Summers, Tracy and Zieman; Messrs. Levy and ��
Pangal of the Zoning Comnittee; Mr. Segal, Assistant City
Attorney; Ms. Lane of the Division of Housing and Building
Code Enforcement; Ms. Synstegard, Mr. Ryan and Mr. McGuire of
the Planning Division Staff.
ABSENT: Messrs. Galles and Lanegran.
The meeting was chaired by Joseph Pangal , Chairman.
DONALD JONES (#9817�: Application for a non-conforming use permit to
continue an auto repair business at property located at 483 West Lawson
(north side of Lawson between Norton and P1ackubin). '
The applicant was present. There was no opposition present at the
hearing.
Roger Ryan showed slides of the site and reviewed the staff report with
a recommendation for denial.
Mark Ginereux, 817 Commerce Bldg., applicant's attorney, stated that he
had not been retained for this matter at the time the applicant filed
f or a petition. He stated that his client does not wish to operate an
auto repair business. His client is merely doing waxing, buffing, and
the general cleaning of the automobile before it is brought back to the
car lot in Minneapolis of which he is a partial owner. He stated that
the staff report, therefore, does not apply to his client's application.
He stated that there is only one home to the west and that Union Brass
owns the lot to the west and other vacant lots along Mackubin. He has
found 12 particular pl_aces in the area where non-conforming uses are and
that this is not your classic neighborhood. He then passed out a letter
from his client's doctor explaining his client's hardship. The business
allows his client to take care of his daughter, without having to send
her to an institution.
The Committee discussed the nature of the use, the number of cars on the
property, the appearance of the duplex, spot zoning, and lack of
parking.
Mr. Pangal stated that two additional letters in opposition were passed
out at the meeting today.
Ms. Lane stated that they have received complaints on this property for
years. There is a lot next door from Mr. Jones where he parks some of
his cars. When the inspectors went out to Mr. Jones's home there were
no cars parked on the lot next door. "
Hearing no further testimony, Mr. Pangal closed the public hearing
portion of the meeting.

Ms. Tracy moved for denial of the application for a non-conforming use
permit based on findings 2 b., c., e., f., and h. Mr. Levy seconded the ;
motion, which f ailed on a roll cal] vote of 4 to 2.
Ms. Zieman moved approval based on findings 2 g. and 2 i. on the
conditions that only 2 business related cars be allowed on the property,
that all work be done in his garage, and that no outside storage of auto
parts be allowed. Mr. Levy seconded the motion, which passed on a roll
call vote of 5 to 1 (Pangal ).

Mr. Donald Jones has been under care at our Clinics for a Service related disability
for 15 years. He was advised by us to quit driving over-the-road trucks, because of
the constant exacerbations to his Chronic Lumbar problems. His chronic low-back pain ,
makes it impossible for him to work at a conventional, full-time job. When Mr. Jones
is symptom-free, he can do his work, but when he is experiencing one of his frequent
exacerbations, he is confined to hame with no exertion, except for walking.
Mr. Jones also has a daughter who has a history of seizures, and who has just recently
been diagnosised as having Progressive Dystonia. Because of these two factors, Mr.
Jones' daughter, Charmin, needs to have a parent available at all times. This need
exists due to the circumstances that the symptomology warrants. These symptoms include:
seizures and complications due to the medications that the physicians are presently
trying out. Mr. Jones also needs to be available to pick his daughter up at school
in case the school nurse should call because of the any of the above symptoms to
bring Charmin to the hospital or to the doctor.
Due to Mr. Jones 20% service connected disability, and his inability to hold a full-
time job, his not being able to work at home does indeed create a hardship for this
family. The only person able to work full-time is Mr. Jones' wife, Loucina. Her
income is not sufficient to provide for a family of four, especially considering
their sizeable medical bills.

C. PARCEL SIZE: The parcel has 39.04 feet of frontage on Lawson and a depth of 114
feet for an area of 4,450.56 square feet.

The auto repair business is not similar to other uses permitted within the
R-4 One-Family Residential District. Permitted uses in the district are
one-f amily homes and compatible neighborhood uses such as parks, schools,
and churches. An auto repair business is first permitted as a special
condition use in the B-3 General Business District.
c. The use is appropriate and consistent with the general welfare of the
community and the enjoyment of adjacent property.
The use is a commercial use which is neither similar nor appropriate to
adjacent residential property and the community.
d. The use has been existence for a period of at least 10 years prior to
application.

The three stall auto repair use requires six off-street spaces and the
duplex requires three off-street spaces for a total of nine spaces. The
applicant's site plan shows six off-street spaces. However, two of the
spaces, on the side of the house, are located in a required side yard.
Parking is not allowed in a side yard. Consequently, only four spaces are
available. Four spaces are inadequate to serve a auto repair use and a
duplex.
