n Or inance amending Chapter 60 of the Saint Paul
Legislative Code pertaining to zoning for the City
of Saint Paul and the zoning maps thereof.
�
WHEREAS, The Planning Commission has made a survey of the Irvine Park and
Leech-McBoal neighborhoods in Planning District 9 for the purpose of
considering amendments to the zoning ordinances of the city, and has determined
that the number of real estate descriptions being affected by the proposed
changes would render obtaining written consent to be impractical ; and
WHEREAS, The Planning Commission, following public hearings held for that
purpose, has recommended that the zoning code be amended, and the City Council ,
having considered the report and recommendations of the Planning Commission,
and having conducted a public hearing on the proposed zoning code amendments,
does hereby amend the Zoning Code pursuant to the authority granted by and in
accordance with the procedures set forth in Minnesota Statutes, Section
462.357.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1.
That the Council of the City of Saint Paul does hereby amend the Saint Paul
Zoning Ordinances by amending the zoning classifications for the following
properties on the zoning maps of the City of Saint Paul , Sheet Nos. 21, 28, and
29, as incorporated by reference in Section 60.301 of the Saint Paul Legislative
Code:

An Ordinance amending Chapter 60 of the Saint Paul -
Legislative Code pertaining to zoning for the City
of Saint Paul and the zoning maps thereof.

� WHEREAS, The Planning Commission has made a survey of the Irvine Park and
� Leech-McBoal neighborhoods in Planning District 9 for the purpose of
� considering amendments to the zoning ordinances of the city, and has determined
� tnat the number of real estate descriptions being affected by ti�e proposed
� changes would render obtaining written consent to be impractical ; and

WHEREAS, ihe P3anning Commission, following public hearings held for that
purpose, has recommended that the zoning code be amended, and the City Council ,
having considered the report and recommendations of the Planning C�mmfssion,
and having conducted a public hearing on the proposed zoning code amendments,
does hereby amend the Zoning Code pursuant to the authority granted by and in
accordance with the procedures set forth in Minnesota Statutes, Section
462.357.

Dear President Tedesco and Members of the City Council :
In the fall of 1983, the Housing and Redevelopment Authority �oard considered
selling a parcel of land to the owner of a single family home at 59 Irvine Park
so that the home could be converted into seven housing units. The Board decided
against selling the parcel . The proposed conversion created an awareness that,
although city development policy since 1975 has supported restoration of homes at
low and medium residential densities, the Irvine Park and the Leech-McBoal area
is zoned for medium and high density residential . On November 17, 1983, the City
Council initiated a 40-acre study of the area to consider zoning changes.
On September 14, 1984, the Planning Commission held a public hearing on a 40-acre
study which recommends rezoning the area to reflect existing land use. The
Commission adopted the study's recommendations on October 12, 1984. The Commission's
resolution is attached.
The existing zoning of the Irvine Park and Leech-McBoal area is based upon plans
which were developed in the 1960s. These plans proposed that the area be revitalized
at medium and high residential densities. Over the last decade the area was
revitalized by restoring homes, moving in homes, and building new housing at low and
medium residential densities. The study recommends that the zoning of the area be
changed to reflect the existing low and medium residential density land use.
At the Commission's public hearing there were four requests to change the proposed
zoning.
Three Hundred Exchange was requested to be zoned RT-1 and 169 McBoal was requested
to be zoned RM-1 . The Commission decided to keep 300 Exchange RM-1 and 169 McBoal
RT-1 since this zoning reflects existing land use.
The owners of two residential properties, 307 Walnut and 310 Sherman, requested
changes to the proposed zoning to allow conversion of the buildings to offices.
The properties are in the Ramsey House block. The Commission decided to r�commend

OS-1 office service zoning for these two properties along with an adjacent
property at 311 Walnut. The OS-1 zoning will permit the office conversion,
permit residential use to continue if the office conversion is not accomplished,
and act as a transition between the B-5 downtown zoning on Seventh Street and the
Ramsey House.

WHEREAS, the City Council on November 18, 1983, adopted a resolution initiating a 40-
acre study of the Irvine Park and Leech-McBoal area for the purpose of amending the
Zoning Code; and
WHEREAS, the Zaning Committee of the Planning Commission reviewed the suggested
amendment� and recommended a public hearing; and
WHEREAS, pursuant to Ntinnesota Statutes 462.357(5), the Planning Commission he7d a
public hearing on the proposed amendment at its September 14, 1984 meeting; and .
4JNEREAS, the Planning Commission has determined:
1. That the number of real estate descriptions affected by the amendments renders
obtaining of written consent impractical ;
2. That a survey of an area in excess of 40 acres has been made;
3. That a determination has been made that the amendments to the Zoning Code
proposed are related to the overall needs of the community, to existing land use, ,•.
and to plans for future land use; and
4. That pursuant to State Statutes proper notice of the hearing was given in the
Pioneer Press and Dispatch on August 24, August 31 and September 7; 1984.
NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission recommends approval of the
Zoning Code amendments in the Zoning Committee Staff report File #9529 and in the
Memorandum to the Zoning Committee, dated September 28, 1984, attached hereto, .

A. PURPOSE: In the f all of 1983, the Housing and Redevelopment Authority Board
considered selling a parcel of land to the owner of a single f amily home at 59
Irvine Park so that the home could be converted into seven housing units. The
Board decided against selling the parcel . The proposed conversion created an
awareness that, although the city development policy since 1975 has supported
� restoration of homes at low and moderate residential densities, the Irvine Park
and the Leech-McBoal area is zoned for medium and high density residential . On
November 17, 1983, the City Council initiated a 40-acre study of the area to -
consider zoning changes. Staff findings and recommended zoning changes are
contained in this document.
B. 40-ACRE STUDY: Minnesota Statutes Section 462.357, Subd. 5 permits St. Paul to
amen its oning Code without obtaining consent petitions k�hen all of the .
following conditions are met: - ,:
1. The whole area of the city or an area of not less than 40 acres has been
surveyed.
� 2. The number of real estate descriptions affected by the zoning changes and
alterations renders the obtaining of written consent impractical .
3. The Planning Comnission reports in writing as to the proposal 's relationship
to the overall needs of the community, to existing land use, or to a plan
for future land use. �
4. A public hearing on the proposed ordinance, changes, or alterations is
conducted with notice of the time, place and purpose of the hearing published
at least once a week for three successive weeks prior to the public hearing.
C. FINDINGS•
1. The area surveyed for the study is 53 acres (see Map lj.
2. The number of real estate descriptions affected by this change is 162,
making it impractical to obtain written consent.
3. Land use plans and zoning controls for Irvine Park and Leech-i�icBoal have
promoted medium and high density housing, but revitalization through
restoration of homes, moving homes into the area, and new housing
construction, have bee� at lovr and medium residential densities. The
proposed zoning changes aligns zoning controls with the existing land use
resulting from revitalization.

Both the City's 1y63 �omprehensive Plan and the F;octsing and
P,e�!evelopment Autharity's 1.36� Land Jse Plan proposed medium and h;gh
dens�ty f or tt�e area.

The City's 1963 Plan proposed one ar�d two f amily housing, townhouses,
and walk-up ap�rtments around Irvine Park and along the bluff in Leech-
P•1cBoa1 . Maximum residential density v�as 25 units �er acre. The plan
proposed townhouses, walk-up apartments, and highrise apartments for the
rest of the area. Maximum dens�ity was 87 units per acre.
The HRA's 1968 Plan proposed townhouses, walk-up apartments, and
highrise apartments north of Forbes and east of Wilkins . Pfaximum
density was 72 units per acre. Most of Leech-McBoal was pr�posed for
one and two family housing, tovrnhouses, walk-up apartments, and highrise
apartments. Maximum density was 72 units per acre.
b. Revitalization
The HRA Plan �was to be the guide for redevelopment activities. Blighted
land was to be acquired and reused according to the plan. One of the first
redevelopment activities was to acquire the land for Sherman-Forbes, a
medium density apartment development on West 7th Street. By 1972, the HRA
had acquired most of the land and buildings around Irvine Park and along
Ryan Avenue and Exchange Streets, to the west of the Park. The buildings,
, many of which were historically significant, were to be demolished and
replaced with medium and high density housing. A developer was chosen to
build the housing. However, during 1973-1574, the HRA, residents, and
historic preservation advocates debated the desirability of demolishing the
historic buildings. The residents and preservationists won. The HRA
changed its policy and decided to sell the buildings to people who would �
restore them for low density use and to move in other historically
compatible buildings. In 1975, the first buildings were sold. In 1976,
the HRA adopted design guidelines and a land use policy not to subdivide
buildings into apartments.
Two medium density housing developments were eventually built on vacant � �
land in Irvine Park - the Upper Landing duplexes on ityan Avenue, and the
Panama Flats townhouses north of the Park.
Meanwhile, in 1974 Leech-McBoal was designated an Identified Treatment
Area. Rehabilitation of residential buildings and streets, 'not
redevelopment, was emphasized. Six buildings were rehabilitated with
publicly financed, low interest loans. Two buildings which were infeasible
to rehabilitate were demolished and the land sold to adjoining property
owners for yard space.
Over the last two decades, revitalization policy changed from one promoting
a high degree of clearance and redevelopment at medium and high
residential densities, to one employing rehabilitation, restoration, and new
construction on vacant land at low and medium densities. Today there are
140 fewer housing units in the area than in 1970, a 27� decline, reflecting
the lower densities at which the area is now built.
c. Zonin
In 1975, the City Council adopted a new city-wide zoning code. The code
was adopted in the middle of the change in land use policy for Irvine
Park and at the beginning of the ITA program in 'Leech-McEoal . The area
was not zoned to reflect the altered direction of r�evitalization. The
city and HRA land use plans proposing medium and high density housing
v;ere the guide for re2oning the area (see map 2). Tt�e area was zoned
medium and high density residential (RM-2 and RM-3) because of the
uncertainity of the success of restoring the historic buildings, the
potential for some medium density development on vacant parcels, and the
ability of the city to change the zoning later when the pattern of
revitalization t��as complete.
The District 9 Plan, in 1980, was the first reco���t�on that zoning and
r�vitalization needed to be brought clase together. The plan

RE: Irvine Park and Leech-McBoal 40 Acre Study Testimony
There are four requests to change the proposed zoning of the Irvine Park
and Leech-McBoal 40 Acre study. A revised proposed zoning map with the
addresses of the properties discussed is attached.
A. Bobby Zick requested that 300 Exchange be zoned RT-1. This planned 8
unit development consists to two 3-unit buildings and two 1-unit
buildings. The three unit buildings have been moved onto the site and
one building has been restored and is for sale. The two 1-unit
buildings have yet to be constructed. The Board of Zoning Appeals
approved yard variances for the development in March, 1982. Upon an • • . •
appeal to the HPC' s approval of the development, the City Council �
approved the development in November, 1982. The development meets RM-1
density standards. Staff recommends the property be zoned RM-1.
6. Two property owners in the Ramsey House block requested changes. Their
' property is now zoned B-5 and was proposed to be zoned RM-2. These
requests were considered by the Irvine Park and Leech-McBoal task
force.
The owners of the 6-unit condominium at 307 Walnut requested that their
property remain B-5 so that their building can be converted to an
office building. Owners have been unable to sell their residential
units. John and Sandy Karlath, one of the condominium owners, attended
the task force meeting.
Elk White Way cleaners requested that 310 Sherman be zoned OS-1 so that
the building can be restored and converted to an office.
The staff and task force recommends that the two properties and the
property at 311 Walnut be zoned OS-l. OS-1 zoning will permit the
proposed conversion to office use, permit residential use to continue
as a conforming use if the conversion is not accomplished, and act as a
transition between the B-5 central business district zoning and the
Ramsey House.

C. Rondon Associates requested that 169 hicBoal remain RM-2 so that one
more dwelling unit can be added to the existing two family use in the
future. The lot is only 9,227 feet in area and does not meet the 10,000
square foot minimum lot siie for a 3-unit building. The property is
proposed to be zoned RT-1 because it is in an area predominatly one and
two family. Staff and the task force recommends the property be zoned
� RT-1.

Dear President Tedesco and Members of the City Council :
In tl�e fa11 of 1983, the Housing and Redevelopment Authority Board considered
selling a parcel of land to the owner of a single family home at 59 Irvine Park
so that the home could be converted into seven housing units. The Board decided
against selling the parcel . The proposed conversion created an �wareness that,
although city development policy since 1975 has supported restoration of homes at
low -and medium residential densit�es, the Irvine Park and the Leech-Mc6oa1 area
is zoned for medium and high density residential . On November 11., 1983, the City
Council initiated a 40-acre study of the area to consider zoning changes.
On September 14, �1984, the Planning Commission held a public hearing on a 40-acre
study which recommends rezoning the area to reflect existing land use. The
Commission adopted the study's recommendations on October 12, 1984. The Commission's
resolution is attached. -
The existing zoning of the Irvine Park and Leech-McSoal area is based upon plans
which were developed in the 1960s. These plans proposed that the area be revitalized
at medium and high residential densities. Over the last decade the area was
revitalized by restoring homes, moving in homes, and� building new housing at low and
medium residential densities. The study recommends that the zoning of the area be
changed to reflect the existing low and medium residential density land use.
At the Commission's public hearing there were four requests to change the proposed
zoning.
Three Hundred Exchange was requested to be zoned RT-1 and 169 Mc°oal was requested
to be zoned RM-I. The Commission decided to keep 300 Exchange RM-1 and 169 Mc5oa1
RT-I since this zoning reflects existing land use.
The owners of two residen��ial properties, 307 Walnut and 310 Sherman, requested
changes to the proposed zoning to allow conversion of the buildings to offices .
The properties are in the Ramsey House block. The Commission decided to recommend
