The garage at 2015 Stillwater (Lot 15) encroaches 7.5 feet onto the neighboring property to the west. C. MINIMUM_LOT RE�UIREMENTS: 5,000 sq. ft. area ; 40 ft. width. D. CURRENT_WIDTH^& AREA: Two lots. 2009 Stillwater: 5,991. 18 sq. ft. area ; 45.02 ft. frontage on Stillwater; 55.02 ft. average lot width. 2015 Stillwater: 5,500 sq. ft. area ; 50 ft. frontage on Stillwater; 50 ft. average lot width. F. FINDINGS: 1 . Section 62.106 requires detached garages to be setback at least three feet from all interior lot lines unless a maintenance easement is recorded on the deeds of all affected properties. - 2. The applicant proposes moving the back lot line 9 feet to the west which will rectify the 7.5 foot garage encroachment and leave a nonconforming setback of 1 .5 feet between the garage and the adjacent property line. 3. The recording of a maintenance easement agreement between the owners of the properties at 2009 and 2015 Stillwater Avenue would meet the intent of the Zoning Code and comply with Section 62.106. 4. The division meets all other requirements of the Zoning Code. 5. The division will not alter the existing development nor is there any new development proposed. 6. The division will not be detrimental to the present or potential surrounding land uses. � G. STAFF RECOMMENDATION: Based on the above findings, staff recommends the lot �sp�it berapproved contingent on the applicant recording a maintenance easement agreement with the property owner to the west (2009 Stillwater) at the time of the recording of this lot split.
