Rr,SOLVED, that upon the petition of Space Center, Inc. per file
No. 20-1984, that part of Grove Street, that part of 13th street and
that part of the alley in Block 3, Bass ' Addition to the Town of
St. Paul hereinafter described be and the same are hereby vacated
and discontinued as public streets and alley:
All that part of Grove 5treet lying East of the southerly
extension of the West line of Lot 5, Block 3, Bass ' Addition
to the Town of St. Paul and West of the Northwesterly
extension of the Northeasterly line of Willius Street and
lying north of the following described line:
Beginning at a point on the West line of said Block 3
distance of 30. 85 feet north of the east-west 1/4 line
of Section 32, Township 29 Ilorth, Range 22 West, when
measured at right angles to said quarter line; thence
east to a point on the east line of said block 3 distance
of 30. 69 feet north of said 1/4 line when measured at
right angles to said 1/4 line and there terminating.
Also, all that part of Grove Street lying west of the
southerly extension of the centerline of vacated Madison
Street and east of the northwesterly extension of the
northeasterly line of Willius Street.
Also all that part of a seven-tenths foot (0. 7 ' ) strip
of Thirteenth Street adjoining and abutting the north
line of Block 3 and its easterly extension of said
north line, Bass ' Addition to the Town of St. Paul and
lying between the northerly extension of a line seven
feet (7 ' ) east of and parallel to the west line of Lot 2,
of said Block 3 and west of the center line of vacated
Madison Street.

Also all that part of the east-west alley in Block 3
lying west of a line two feet (2 ' ) west of and parallel
to the southerly extended east line of Lot 2 in Block 3
Bass ' Addition to the Town of St. Paul .
Also all of the easements for slopes, cuts and fills
necessary in the grading and paving of the streets and
or alley contiguous to the above vacated land.
Subject expres5ly to the following conditions and reservations :
l. That the vacation be subject to all the terms and condi-
tions of Chapter 130, codified March l, 1981, of the St. Paul
Legislative Code, as amended.
2 . That a permanent Water Utility Easement be retained over,
under and across the south 30 feet of the north 40 feet and lying
west of the southerly extension of the center line of vacated
Madison Street and east of the northwesterly extension of the
northeasterly line of Williu� Street within the vacated area of
Grove Street and subject to the following restrictions:
a, No buildings, structures (other than the existing
loading dock), or trees are permitted within the
easement area, or any temporary structure, material
storage, fixture or other objects that will prohibit
normal access to water facilities for maintenance
purposes without written permission from the Water
Utility.
b. No change from the existing grade is permitted
without written permission from the Water Utility .
c. No change in surfacing within the easement area is
permitted without written permission from the Water
Utility.
d. That the petitioner, its successors and assigns
shall fully indemnify, defend and save harmless
the Board of Water Conunissioners, its officers,
agents, employees, and servants from all suits,
actions or claims which shall arise from any injuries
or damages received or sustained by any break in any
service pipe, water main, or connection in said
reserved easement, arising out of or resulting from
any action or negligence of the petitioner, its
employees, agents or business invitees.

3 . That a permanent sewer easement be retained over, under
and across the south sixty-two feet (62 ' ) of vacated Grove
Street lying west of the southerly extended center line of vacated
Madison Street and east of the northwesterly extension of the
northeasterly line of Willius Street and subject to the following
restrictions:
a. No buildings, structures, or trees are permitted
within the easement area, or any temporary structure,
material storage, fixture or other objects that will
prohibit normal access to sewer facilities for
maintenance purposes without the written permission
from the Director of the Department of Public Works.
b. No change from the existing grade is permitted with-
out written permission from the Director of the
Department of Public Works.
c. No change in surfacing within the easement area is
. permitted without written permission from the
Director of the Department of Public Works .
d, That the petitioner, its successors and assigns shall
indemnify, defend and save harmless the City of Saint
Paul, its officers, agents, employees, and servants
from all suits, actions or claims which shall arise
from any injuries or damages received or sustained
by any break in any service pipe, or connection in
said reserved easement, arising out of or resulting
from any action or negligence of the petitioner, its
employees, agents or business invitees .
4 . That the petitioner pay $11,7�0 to the City as compensation
for the vacation within 60 days of the effective date of this
resolution.
5 . Based upon utility easement Certificates of Intended Non-
Use filed on behalf of Northwestern Bell Telephone Company, Northern
5tates Power Company, Western Union, Department of Public Works and
the Water Utility attached hereto and made a part hereof, the City
hereby waives the utility easements or portion thereof to be
vacated for itself and behalf of these corporations .
6 . That the vacated land accommodate certain encroachments
along parts of Thirteenth Street and Grove Street and that upon re-
moval, demolitions or otherwise non-existence, said vacated land
shall automatically revert to the C��y of Saint Paul as street
right-of-way without cost or charges to the City. Said vacated
land which will revertto the City is described as follows ;

this vacation; or because of any act or omission, neglect or misconduct
of said petitioner, or because of any claims or liability arising from
or based on any violation of any law or regulation made in accordance
with the law whether by the petitioner or any of its agents or
employees .
