That Section 175. 05, subdivision 1 of the St. Paul Legislative Code be and the same is hereby amended by deleting the same in its entirety and substituting, in lieu and in place thereof, the follow- inge 175. 05. /ABATEM�;NT, PROCEDURE�S.� Subdivision 1. /NOTIFICATION TO OWNEP., ETC.,7 tiVhenever the city forester has reason to believe that a nuisance as defined in Section 175 . 02 exists on any private property in the city, he snall mail a wri�ten order to the last known address of the owner of the real property involved. For the purpose of this chapter, '`owners" and �heir addresses shall be those shown to be such on the records of the Rarasey Caanty aepartment of property taxation, but other approp�iate recoras �n��� �e used. The written order shall notify the owner of the existence of the nuisance and direct that it be removed wit'�in 20 da�s after receipt of such notice. That Section 175. 05, subdivision 2 of the St. Paul Legislative Code be and the same is hereby amended as follows: Subd. 2 � /FAILURE TO ACT; CITY MAY ABATE.j If the owner or person in control of any private premises fails to have such a ��ee nuisance so removed and b���e�-e�-e��e��a�se-e€�ee���e�p pro�e�'^'�y d posed of within �e� twenty days after receipt of notification by mail, or when the owner or person in control cannot be located, the department of community services may proceed to have 9�e1�-��ee the nuisance removed and ����ee�-e�-e�ke�w�se-e�€ee���e�� ��ea�e�l disposed o"�,and any expense incurred by the city in so doing may be a charge and lien upon the said property and shall be collected as a special assessment against the property concerned. Included as part of the assessment shall be those administrative costs incurred by the de artment o finance an management services in processing the co lection o the abatement, Section 3. That Section 175.05 of the St. Paul Legislative Code is here- by further amended by deleting subdivisions 3 and 4 therefrom in their entirety and substituting, in lieu and in place thereof, the following; Subd. 3 . /COSTS TO BE ASSESSED.7 The city forester shall keep a record o� the cost of abatements done under this section and, on or before September 1 of each year, shall report to the depart- ment of finance and management services all work done for which assessments are to be made, stating and certifying the description of the lots and parcels involved and the amount chargeable to each lot and parcel . The total costs of this abatement including the administrative costs incurred by the finance department in process- ing the abatement shall then be assessed against the affected real property in the manner provided for in Chapter 14 of the City Charter and shall be collected in accordance with those applicable pro- visions contained in Chapter 64 of the St. Paul Administrative Code, provided, however, that these assessments shall be payable in not to exceed five annual installments . Section 4 . This ordinance shall take effect and be in force 30 days after its passage, approval and publication. 2 .
