WHEREAS, The Heritage House Apartments Limited Partnership has submitted
for City Council approval the attached proposed Registered Land Survey of
property located at 218 E. Seventh Street, on the south side of East
Seventh Street between Sibley and Wacouta Streets currently described as:
"The Easterly 1/3 of Lots 11 and 12, block 7, Whitney and Smith's
Addition to Saint Paul as recorded in Book 129 of Deeds, Page 108 and
195 and marked by Judicial Landmarks set pursuant to Case P.S. 1337;
and subject to an easement for alley purposes as to the Southerly
10 feet of sai d 1 and;" and
WHEREAS, the appropriate City departments have reviewed the proposed
Registered Land Survey; and
WHEREAS, the proposed Registered Land Survey has been determined to meet
the requirements of Section 67.705 of the St. Paul Zoning Code;
NOW, THEREFORE, BE IT RESOLVED, that the City Council accepts and approves
the attached Registered Land Survey.

A. PURPOSE: To create divisions of land that f acilitate conveyance of certain
spaces within the existing building. ,
B. SITE & AREA CONDITIONS: The site is currently occupied by a 5-story brick
building with a retail furniture store on the basement and street levels, and
apartments on the upper levels.
C. FINDINGS:
1 . Butwinick,operators of the furniture store, will receive those parts of
Tract C between elevations 58.63 and 66.30 (basement) and between elevations
67.50 and 81 .50 (street level ) : Also Tract B between elevations 67.50 and
81 .50; this because the front wall of the building at street level is mostly
display window and not as thick as the foundation walls): Also Tract E below
elevation 81 .50 and above an inclined plane having an elevation of 67.50 at
the westerly line of Tract E and an elevation of 67.95 at the easterly line
of Tract E; this last to accommodate a ramp leading up to the slightly higher
floor of a connecting building to the East.
2. Heritage House Apartments, current owners of the building, will retain all of
Tracts C, B and E except those parts described above and all of Tracts A, D
and F, so that they retain ownership of the exterior walls of the building,
all of the space within the building above the street level ceiling, and the
loading dock behind the building.
3. The proposal does not involve any new development, nor will it change the
existing development in any way other than the ownership.
4. The proposal meets the requirements of Sections 67.405 and 67.705 of the St.
Paul Zoning Code and will not be detrimental to the present or potential
surrounding land uses.
D. STAFF RECOMMENDATION: Based on findings 1 through 4, staff recomnends the
Registered Land Survey be approved.
