The Resolution authorizes the City Clerk to submit an application to the Secretary of State for the registration of the City's official seal. The City Attorney's office has also prepared special state legislation whereby the Legislature would specifically authorize the City Council to adopt an official seal, and would provide criminal penalties for the use of the seal without the express permission of the City Council. Recently a member of the Board of a District Community Council in my Ward submitted a design for a logo for use on the Community Council letterhead and other publications. The proposed logo included and focused on the City seal. My office checked with the City Attorney and found that, though it has been commonly accepted practice that the seal appear only on official City materials and/or those specifically authorized by the City, in fact, the seal is not registered and there are no penalties for its use or misuse at this time. cc: A1 Olson, City Clerk Jerry Segal, Assistant City Attorney encls. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: Section l . Minnesota Statutes 1986 , chapter 333, is amended by adding a new section to read: 333. 55. USE OF SEAL OF CITY' OF SAINT PAUL LIMITED. The governing body of the city of Saint Paul may adopt an official city seal , and upon doing so shall file a copy of the official seal with the secretary of state. It shall be unlawful for any person to counterfeit or imitate or to sell , offer for sale , or in any way use or circulate the city of Saint Paul official seal without the consent of the governing body of the city. Violations of this section shall constitute a mis- demeanor. Sec . 2. (EFFECTIVE DATE) .
