WHEREAS, Gregory Hotzler has submitted the attached proposed lot split for
City Council approval ; and
WHEREAS, the Departments of Planning and Economic Development and Public Works
have reviewed the proposed lot split at the northwest corner of Laurel Avenue
and Virginia Street as described on the attached survey; and
WHEREAS, the proposed lot split meets the requirements of Sections 67.304 and
67.406 of the Zoning Code, except for lot area; and
WHEREAS, the City Council on July 2, 1987 held a public hearing to determine
the advisability and necessity for the granting of variances from the strict
application of the provisions of Sections 67.304 and 67.406 of the Zoning Code
at which hearing all persons present were given an opportunity to testify; and
WHEREAS, following said public hearing, the City Council made the following
findings of fact:
1 . The property in question cannot be put to a reasonable use under the
strict provisions of the code;
2. The plight of the landowner seeking to divide the property is due to
circumstances unique to his property, and these circumstances were not
created by the landowner; and
3. The variance requested is in keeping with the spirit and intent of the
code, and is consistent with the health, safety, comfort, morals and
welfare of the inhabitants of the City of Saint Paul ; and

4. Granting the requested variance will not impair an adequate supply of
light and air to adjacent property, nor will it alter the essential
character of the surrounding area or unreasonably diminish established
property values within the surrounding area; and
5. The variance, if granted will not permit any use of the land that is
inconsistent with the provisions of the Zoning Code; and
6. The owners request for this variance is not based primarily on a desire
to increase the value of income potential of the parcels of land; and
NOW, THEREFORE, BE IT RESOLVED, that the City Council accepts and approves
this lot split for property situated at the northwest corner of Laurel Avenue
and Virginia Street legally described as Lots 5, 6, Block 75, Dayton &
Irvine's Addition, with the following variances and conditions:
Parcel A: Reduce lot area from 5,000 square feet to 4,140 square feet with
the condition that a driveway easement be incorporated into the
deed.
Parcel B: Reduce lot area from 5,000 square feet to 4,140 square feet with the
condition that a driveway easement be incorporated into the deed.
Parcel C: Reduce lot area from 10,000 square feet to 8,340 square feet with
the condition that a driveway easement be incorporated into the

A. PURPOSE: To consider a lot split with variance to split two adjoining
lots into three undersize lots. This subdivision with variance is part
of a total variance package that included variances for front and rear
. yard setbacks and for total lot coverage for two single family homes
being constructed on lot 6. BZA held a public hearing on those
variances on June 23, 1987.
Parcel A: Reduce lot area from 5,000 square feet to 4,140 square feet.
Parcel B: Reduce lot area from 5,000 square feet to 4,140 square feet.
Parcel C: Reduce lot area from 10,000 square feet to 8,340 square feet.

B. SITE & AREA CONDITIONS: This property is in the Historic Hill .district.
There is an existing four-plex on lot S with lot 6 its current side
yard. The site is level with some oak trees near the center of lot 6.
The proposed single family homes will need to share the driveway with
the four-plex as shown on the site plan.
C. MINIMUM LOT REOUIREMENTS: For a four-plex, 10,000 square feet. For a
single family home, 5,000 square feet.
D. CURRENT WIDTH & AREA: 120 feet wide and 16,680 square feet in area.
E. �'ROPOSED W�DTH & AREA: For the four-plex, 60 feet in width and 8,340
square feet in area. For the single family homes, 69 feet in width and
4,140 square feet in area.
F. FINDINGS:
1. The intent of this chapter is met. :
2. The granting of the variance will not be detrimental to the public •
safety, health or welfare or injurious to other property or improvements
in the neighborhood in which the property is located.
3. The conditions upon which the request for a variance is based are
generally not applicable to other property. The decision to construct
� the single family homes instead of a duplex will help save some oak
trees in the middle of the lot that would have been destroyed if a •
duplex was built.
4. The literal interpretation of the provisions of this chapter would
deprive the applicant of rights commonly enjoyed by other properties in

WHEREAS, Hotzler Development has applied for a variance from the strict application of
the provisions of Section 61.101 of the Saint Paul Legislative Code pertaining to front and
rear setbacks and lot coverage in the RM-2 zoning district; and
WHEREAS, the Saint Paul Board of Zoning Appeals conducted a public hearing on
June 23, 1987, pursuant to said appeal in accordance with the requirements of Section
62.204 of the Legislative Code; and
WHEREAS, the Saint Paul Board of Zoning Appeals based upon evidence presented at the
� public hearing, as substantially reflected in the minutes, made the following findings of
fact:
, 1. The applicant proposes to divide the property into two parcels and construct a single
family home on each. Variances are needed for front and side yard setbacks and lot
coverage.
2. Building two single family homes rather than a duplex will allow the developer to save
some of the oak trees on the site.
3. The proposed variance is in keeping with the spirit and intent of the code. It will not
impair an adequate supply of light and air to adjacent property, nor will it alter the
essential character of the surrounding area or unreasonably diminish established
property values within the surrounding area.
4. The variance, if granted, would not permit any use that is not permitted in the zoning
district where the property is located.
� 1 5. The request for variance is based primarily on a desire to fully utilize the site rather
� than economic gain.
NOW, THEREFORE, BE IT RESOLVED, by the Saint Paul Board of Zoning Appeals that
, the provisions of Section 61.101 be hereby waived to allow construction of two single �
family homes, where each home would be on a lot of 4,140 square feet with a front yard •
setback of 15 feet, rear yard setback of 5 feet and lot coverage of 3896 on property located
at the northwest corner of Laurel and Virginia and legally described as Lot 6, Block 75,
Dayton and Irvine's Addition; in accordance with the application for variance and the site
� plan on file with the Saint Paul Planning Division subject to the City Council approving
the subdividing of the property into two parcels as shown on the site plan.

VI'HEREAS, the Saint Paul Heritage Preservation Commission is authorized by Chapter 73
of the Saint Paul Legislative Code to review building permit applications for exterior
alterations, new construction or demolition on or within designated Heritage Preservation
Sites or Heritage Preservation Districts; and
VI'HEREAS, Hotzler Renovation has applied for a building permit to construct two single
family homes on the vacant lot at the northwest corner of Laurel and Virginia; and -
WHEREAS, the northwest corner of Laurel and Virginia is within the Historic Hill
Heritage Preservation District; and .
VI'HEREAS, the Design Review Committee of the Heritage Preservation Commission met on
June 3, 1987, and voted unanimously to recommcnd approval of the application for a
building permit for the proposed single family homes subject to the condition below; and
WHEREAS, the Saint Paul Heritage Preservation Commission conducted a public heating
on said permit application on June 11, 1987, pursuant to the requirements of Chapter473�of
the Saint Paul Legislative Code; and
WHEREAS, the Saint Paul Heritage Preservation Commission, based upon evidence
presented at the public hearing, made the following findings of fact:
l. The height, massing, setback, materials and quality of design of the proposed new
construction are compatible with existing surrounding structures; i
2. The proposed garage doors and driveway are screened from the street and sidewalk by
landscaping;
3. The roofs of the proposed houses relate to the predominant roof shape of existing
nearby buildings;
4. The proportion, size, and detailing of the windows of the proposed new construction
relate to that of existing nearby buildings;
5. Elevations have been submitted only for the corner building; elevations of the other •
house would be similar with somewhat different detailing;
NOW, THEREFORE, BE IT RESOLVED, that based on the above findings the Heritage ,
Preservation Commission approves the application for a building permit for two single
family houses on the northwest corner of Laurel Avenue and Virginia Street subject to the
condition that the detailed elevations of the second building be submitted to the
commission and approved.

conditions of the specific property involved, unusual hardship to the
owner would result , as distinguished from a mere inconvenience, if the
strict letter of these regulations were carried out. The placement of

WHEREAS, Gk'egory Hotzler has submitted the attached proposed lot split for
City Council approval ; and
WHEREAS, the Departments of Planning and Economic Development and Public Works
have reviewed the proposed lot split at the northwest corner of Laurel Avenue
and Virginjia Street as described on the attached survey; and
WHEREAS, the proposed lot split meets the requirements of Sections 67.304 and
67.406 of �the Zoning Code, except for lot area; and
WHEREAS, the City Council on July 2, 1987 held a public hearing to determine
the advisay'bility and necessity for the granting of variances from the strict
application of the provisions of Sections 67.304 and 67.406 of the Zoning Code

A. URPOSE• To consider a lot split with variance to split two adjoining
lots into three undersize lots. This subdivision with variance is part
bf a total variance package that included variances for front and rear
. yard setbacks and for total lot coverage for two single family homes
�eing constructed on lot 6. BZA held a public hearing on those
variances on June 23, 1987.
Parcel A: Reduce lot area from 5,000 square feet to 4,140 square feet.
Parcel B: Reduce lot area from 5,000 square feet to 4,140 square feet.
Parcel C: Reduce lot area from 10,000 square feet to 8,340 square feet.

B. jSITE & AREA CONDITIONS: This property is in the Historic Hill .district.
There is an existing four-plex on lot 5 with lot 6 its current side
yard. The site is level with some oak trees near the center of lot 6.
The proposed single family homes will need to share the driveway with
the four-plex as shown on the site plan.
C. MINIMUM LOT REQUIREMENTS: For a four-plex, 10,000 square feet. For a
single family home, 5,000 square feet.
D. CU�2RENT WIDTH & AREA: 120 feet wide and 16,680 square feet in area.
E. PROPOSED WIDTH & AREA: For the four-plex, 60 feet in width and 8,340
square feet in area. For the single family homes, 69 feet in width and
4,140 square feet in area.
F. FINDINGS:
1. The intent of this chapter is met. �
2. The granting of the variance will not be detrimental to the public •
safety, health or welfare or injurious to other property or improvements
in the neighborhood in which the property is located.
3. The conditions upon which the request for a variance is based are
generally not applicable to other property. The decision to construct
the single family homes instead of a duplex will help save some oak
trees in the middle of the 1ot that would have been destroyed if a •
duplex was built.
4. � The literal interpretation of the provisions of this chapter would
deprive the applicant of rights commonly enjoyed by other properties in
the same zoning district.
5.; The special conditions and circumstances do not result from the actions
of the applicant. Tlte existing building was converted from � units
down to 4. The new density of 12 zoning rooms (1 three bedroom, 2 two
bedroom and 1 one bedroora units) falls below the density limits for this

VVHEREAS, the Saint Paul Heritage Preservation Commission is authorized by Chapter 73
of the Saint Paul Legislative Code to review building permit applications for exterior
alterations, new construction or demolition on or within designated Heritage Preservation
Sites or Heritage Preservation Districts; and
VI'HEREAS, Hotzler Renovation has applied for a building permit to construct two single
family homes on the vacant lot at the northwest corner of Laurel and Virginia; and �
WHEREAS, the northwest corner of Laurel and Virginia is within the Historic Hill
Heritage Preservation District; and , .
V1'HEREAS, the Design Review Committee of the Heritage Preservation Commission met on
June 3, 1987, and voted unanimously to recommcnd approval of the application for a
building permit for the proposed single family homes subject to the condition below; and
WHEREAS, the Saint Paul Heritage Preservation Commission conducted a public heating
on said permit application on June 11, 1987, pursuant to the requirements of ChapterE73�of
the Saint Paul Legislative Code; and
WHEREAS, the Saint Paul Heritage Preservation Commission, based upon evidence
presented at the public hearing, made the following findings of fact:
1. The height, massing, setback, materials and quality of design of the proposed new
construction are compatible with existing surrounding structures; i
2. The proposed garage doors and driveway are screened from the street and sidewalk by
landscaping;
3. The roofs of the proposed houses relate to the predominant roof shape of existing
nearby buildings;
4. The proportion, size, and detailing of the windows of the proposed new construction
relate to that of existing nearby buildings;
5. Elevations have been submitted only for the corner buiiding; elevations of the other •
house would be similar with somewhat different detailing;
NOW, THEREFORE, BE IT RESOLVED, that based on the above findings the Heritage ,
Preservation Commission approves the application for a building permit for two single
family houses on the northwest corner of Laurel Avenue and Virginia Street subject to the
condition that the detailed elevations of the second building be submitted to the
commission and approved.

� 6. Because of the particular natural surroundings, shape or topographical
conditions of the specific property involved, unusual hardship to the
_ owner would result , as distinguished from a mere inconvenience, if the
strict letter of these regulations were carried out. The placement of
the homes will help save some large oak trees from being removed.
7. On June 23, 1987, the Board of Zoning Appeals approved variances for the
. construction of two single family homes on the vacant site. The
� variances approved are -�or front and rear yard setbacks and for lot
coverage.
8. On June 11, 1987, the HPC approved the design of these single family
homes with slight modifications.
9. The applicant claims that single family homes are much more marketable
than a duplex condo units. .
G. STAFF RECOMMENDATION: Based on the above findings, Staff recommends ap-
proval of this lot split with the following variances and condition:
, Parcel A: Reduce lot area from 5,000 square feet to 4,140 square feet with
the condition that a driveway easement be incorporated into the deed.
Parcel B: Reduce lot area from 5,000 square feet to 4,140 square feet with
the condition that a driveway easement be incorporated into the deed.
Parcel C: Reduce lot area from 10,000 square feet to 8,340 square feet with
the condition that a driveway easement be incorporated into the deed.
