1 WHEREAS, Buiiding Permit Nos. 182487 and 182988 were issued to Dan Brown Builders for homes
2 to be built at 1695 Idaho Avenue East and 1694 Califomia Avenue East, for which Sewer Availability
3 Charges of $2,100.00 ($1,050.00 for each lot) was collected by the Department of Technology and
4 Management Services (Real Estate Division), as evidenced by Receipt Nos. A5653 and A5654, dated

WHEREAS, Dan Brown Builders found that the potential sites were unsuitable to build without
extensive work to correct the poor soil conditions on the lots resulting in a cancellation of said building
pernuts; and
NOW THEREFORE BE IT RESOLVED, In view of the foregoing, that the proper City Officials are
authorized to issue a refund of the Sewer Availability Charges to Dan Brown Builders in the amount of
$2,100.00.

I am writing in reference to the properties known as 1694 California Avenue East and 1695
Tdaho Avenue East. We applied for a Sewer Availability Charge {SAC} on May 19. 1999,
and had been issued a permit on June 3, 1999.
However, after breaking gound on the lots earlier this week, we found that the sites are
not up to building standards. Both lots were filled with lazge remnants of concrete and
other large debris. Due to the high costs of soil conections and material removal, we have
decided not to proceed with our plans to buitd at tivs time.
In order to acquire the permits, it was necessary to pay $1,050.00 for each lot as the SAC
fee. For both lots we paid a total of $2,100.00, but now no longer need those services.
We would like to request a refund for the fees with the cancellation of the pernuts. If you
have any questions or concerns, please contact myself or Joe O'Brien at 651- 773-9916.
