WHE;�EAS , Reeni.ry Servic°s , Inc . was notified by the City' s
Build�ng Inspection and Design Division, Department of Comrnunity
Serviices , that it would be required to make application to
the !Saint Paul Planning Commission for a S�ecial Condition
Use permit for its community residen�ial racility located at
855 iWest 5eventh Street and 847 West Seven�h Street, Saint
Paul ; Minnesota, based upon a determination by the Division
-chat Reentry Services, Inc. had increased its permitted� number
of residents at t,hese facilities from 24 residents to 36 without
firs'� obtaining a permit �herefor from the Planning Commiss�on
as �equired by Section 60.423 (3) (f) oi the Saint Paul Legis-
latiive Code ; and
il WHEREAS , Reentry Services , Inc. , pursuant to Section 64.204
of ?�he Saint Paul Legislative Code , appealed tnis ao�ministra-cive
dec�sion to the Board or Zoning Appeals and the Board of Zoning
App�als following public hearings thereon did by its Resolution
No. 10053 aated April 28 , 1987 , find and deterimine that the
Zon;ing Admin-�sira�o� �i^e� in nis determination and tnerefore
fo�nd a�zc� �e�erraiizec� cha�c �ee:z-cry Services , Inc. would be per-
mi�t�d anc� allo�a�c� -co ope�^a�e a community residential facility
(cdrrec�cional nalfway facility) with up to 36 residents using
bo�h houses at 847 and 855 West Seven�h Street, and fuither
th�t any increase in number Ueyond 36 residents would require
a special con�it,ion use perrnit ; and
WHER�AS , acting pursuant to Section 64.206 the For� Road
F�deration filed an appeal to the Ci�y Council of the decision
p}t the Board of Zoning Appeals and the City Council following
a public hearing held on June 18 , 1987, at which time the City
Cpuncil considered the report and recommenda�ion of the staff
o� the Division of Planning, the minutes and resolution of
t�e public hearings of the Board of Zoning Appeals , -che tes�imony

hereby make the following determination:
RESOLVED, that the Council of the City of Saint Paul does
hereby find and determine that the decision of the Building
Insp�ction and Design Division, Department of Community Services,
datec� November 20, 1986 was not an error, and further that
the ! findings and decision of the Board of Zoning Appeals in
thisi ma�cter was in error, based upon the following findings
madeiby the City Council :
(1 ) Prior to 1980 the Saint Paul Zoning Code did not require
the issuance of special condition use zoning perinits for community
residential facilities.
(2) That prior to 1980 the facilities at 855 West Seventh
Str�et and 847 West Seventh Street were operated as a communi�y
res;idential facility by the Bremer House and had a maximum
occupancy of 24 resideni�s .
(3) That the facilities at 855 West Seventh and 847 West
Seventh Street were acquired �y Reentry Services , Inc. sometime
in 1983 and Lhat the resident capacity at these �acilities
was increased from 24 to a maximum of 36.
(4) That Reentry Services, Inc . did not apply for nor
r�ceive a special condii�ion use permit from the Planning Com-
mi;ssion of the City o�' Saint Paul which would authorize the
e�pansion of their community residential facility from 24 resi-
d�nts to 36 �,esidents.
(5) That Section 60.423 (3) (f) provides that in the case
o� community residential facilities serving seven or more facilii.y
riesidents permission for the special condition use would apply

� (6) That the Board of Zoning Appeals committed an error
in �finding and determining that the authorized community resident
fac;ility residential limit at 855 West Seventh and 847 West
Sev�enth at the time the zoning code requirements for a special
cor�dition use permit were adopted was 36 residents and thererore
�he Board of Zoning Appeals determined that a new special con-
di�ion use permit would not be required unless and until the
number ot residents at these facilities should increase beyond

' (7) That Reentry Services , Inc . must apply for and receive
a � special condition use permit from the Planning Commission
of ' �che City of Saint Paul in the event it wishes to increase
th¢ number of residents at the community residential iacility

;Background: The issue is whether Reentry Services has changed the size or
licensing of its facility and therefore needs a Special Condition Use Permit
for a Community Residential Facility.
`Reentry Services runs a correctional halfway house at 847 and 855 West Seventh
Street currently serving approximately 30 clients. It does not have a Special
Condition Use Permit because in 1980 when the Special Condition Use Permit
;system for Community Residential Facilities was established existing operations
were not required to obtain a permit. At that time an earlier halfway house
known as Bremer House was operating on the property.
The Zoning Code says that this type of facility must apply for a new Special
Condition Use Permit if it changes its "licensing, purpose, size or location."

On; December� 19, 1986, Reentry filed an appeal of this decision.
The Board of Zoning Appeals heard public testimony on March 10 and April 14,
1987. Planning Staff recommended that the appeal be denied. Based on
co�versations with former employees at Bremer House and licensing information
from the Minnesota Department of Corrections staff found that the size had
increased. Two residents of District 9 testified that the area is already over
cancentrated with Community Residential Facilities. Two former employees of
Bremer House testified in support of Reentry Services, saying that it had up to
3f residents/clients at certain times. Reentry Services also pointed out
C�rtificate of Occupancy and other city records approving them as a rooming
h�use for 36 residents.
Tlie Board of Zoning Appeals voted 4-0 that the Zoning Administrator had erred
and that Reentry Services did not require a Special Condition Use Permit if it
d�d not go beyond 36 residents/clients.
On June 11, 1987, the Fort Road Federation filed a appeal of the decision by
the Board of Zoning Appeals.

A. PURPOSE: The applicant is appealing a decision of the Zoning Administrator which says
that a correctional halfway house run by Reentry Services at 847 and 855 requires a Special
,Condition Use Permit because the number of residents has increased. .
B. ZONING CODE CITATION: Section 60.423(3) lists a Community Residential Facility as a
permitted use subject to special conditions and states that the permission is valid only as long
as licensing, purpose, size and location do not change.
;Section 60.203.0 states that a Community Residential Facility must be located in one main
building on one zoning lot and that the term Community Residential Facility covers
community correctional facilities and adult halfway houses licensed by the Minnesota
Department of Corrections.
The full text of these sections is given in Appendix A.
C. ' SITE AND AREA CONDITIONS: Reentry Services operates facilities in two adjacent
buildings on a triangle shaped block bounded by West Seventh Street, Jefferson, Palace and
Webster. The combined property covers 42,187 square feet. Two other buildings are located
on the block: a duplex and the Oneid� Education Center. Other area land uses are the
Schmidt Brewery across West Seventh and across Webster to the west, commercial uses on West '�
Seventh, and residential in the area north and west. ��
D. FINDINGS:
1. Reentry Services runs a correctional halfway house at 847 and 855 West Seventh Street. It
currently serves approximately 30 clients. The staff operates in 3 shifts and does not live
on the premises. During the day and evening shift there are at least 2 staff people.
� During the night shift and weekends there is normally 1 staff person on duty.
The typical client is a 22-25 year old malc. Clients arc referred to the program and stay
an average of 60 to 90 days.
2. Reentry Services is operating without a Special Condition Use Permit (SCUP) at this time.
This is because in 1980 when the City established the SCUP system for Community
Residential Facilities existing operations were not required to obtain a permit. At that
time an earlier halfway house known as Bremer House was already operating on the
property.
3. The number of clients living at the property in question has increased since Reentry
Services took over from the Bremer House program in 1983 and the number of buildings
where the clients live has increased from one to two.
The following gives a chronology of the operations of Bremer House and Reentry Services
at this location:

a. Bremer House: 1970's - 1983
The property now used by Reentry Services for its program was used for Bremer
; House from the early 1970's to 1983 when Reentry Services took over. The Bremer
House served clients placed there by the courts in lieu of serving time in prison or
jail. (Prior to the Bremer House the property was used as a facility for emotionally
disturbed children.)

Bremer House was licensed by the State Department of Corrections for 24 male
clients at 855 West Sevcnth Street. According to staff inembers who worked at
Bremer House, an internal upper limit of 20 clients was maintained. These staff
members said that the actual number of clients was normally less than 20 and one of
the reasons that Bremer House closed was that it was not able to keep enough clients
to break even financially. Records on file with the Wildcr Foundation, which owns
the buildings, show that the average number of clients at Bremer House was 16 in
� 1981 and 1982.
The other building, 847 West Seventh Street, was used to house staff inembers when
Bremer House was in operation. There were normally 11 or 12 staff people living
there. At times this number included 2 or 3 people who had recently graduated from
the program or who were just about to graduate and had been chosen to work as
staff. This building was not covered by the license frora the State Department of
Corrections since Bremer House used it for a staff residence.
b. Transition from Bremer House to Reentry Services: 1983
In 1983 Bremer House went out of operation. At this time there were only a few
clients still living at 855 West Seventh Street. During the transition period some
clients from Reentry Services moved into the house at 847 West Seventh Street which
had been used to house staff by Bremer House.
c. Reentry Services: 1983 to Present
Reentry Services began operating its program in 847 and 855 West Seventh Street in
late 1983. It applied to the Minnesota Department of Corrections for a license to
operate a correctional facility in December 1983 and was granted a license for 24
male clients at 855 and 12 female clients at 847.
Normally when a change is proposed in the number of clients for an adult
; correctional facility the State Department of Corrections attempts to verify that the
change meets the local zoning requirements. In this casc at the time of the change
from 24 to 36 clients Reentry Services submitted to the State forms from the City
Health and Fire Departments approving the houses as rooming houses with a capacity
of 24 at 855 and 12 at 847. According to the staff person from the State Department
of Corrections who handled state licensing for the facility, the State assumed from
these documents that the facility had the required City approval for,a community
correctional facility including zoning.
Since the initial state license for 24 males and 12 females was granted, two other
changes have been approved by the state. In April, 1985 approval was given to
increase the capacity at 855 from 24 to 28 males. This was done to accommodate
clients on the weekend from another facility run by Reentry Services. In September,
1986 the state approved a change to permit the house at 847 to be used for males
rather than females. Again the State did not check with the City about these changes
to see if they met City zoning requirements. (The City has recently requested that
the State Department of Corrections notify the City whenever licenses are applied for
involving new adult correctional facilities or changes of existing ones.) �
4. The property at 847 and 855 West Seventh Street was inspected or monitored by a number
of different state and city agcncies during the time it was used by Bremer House and
� Reentry Services. The State granted licenses for adult correctional facilities at this
location. Thc City inspccted and approved thc property for rooming and boarding housc
operations. However, the City never granted an SCUP giving zoning approval for a
Community Residential Facility at this location.
There was a lack of coordination between these agencies which resulted in some
confusion about what was and was not permitted. Part of this confusion came from the ��
fact that some of these agencies do not distinguish between community correctional
facilities and normal rooming houses.
The following paragraphs review the action oF the various state and city agencies dealing
with Bremer House and Reentry Services:
a. The Minnesota Department of Corrections has issued licenses for correctional
facilities since 1980. The Bremer was licensed as an adult correctional facility from
1980 to 1983 with a maximum capacity of 24 at 855 West Seventh Street.
Reentry Services was licensed for 24 males at 855 and 12 females at 847 in 1983 and
1984. The capacity was raised to 28 males and 12 females in 1986. In September,
1986 the capacity was changed to 40 males and no femal�s.

b. The City Firo Department and Health Department inspccted both buildings
periodically and issued Certificates of Occupancy. These inspections look at health
and safety issues and approved the properties for use as a roomin¢ house with a
capacity of 24 at 855 and 12 at 847. This approval did not distinguish between a
rooming house and a community correctional facility and therefore did not convey
city approval for operation of a community correctional facility.
c. The Department of Licenses and Permits issued licenses to both buildings for
' operation as rooming houses for up to SO people. Again, this agency did not deal with
issue of whether it was a community correctional facility.
; d. In October, 1984, the St. Paul Board of Appeals issued a variance for building issues
such as handrails and number of bathrooms. (The Board of Appeals is not the same
as the Board of Zoning Appeals. It deals with building code issues and does not
consider zoning matters.) The application form listed the number of occupants as 24
at 855 and 12 at 847.
e. In 1972 the Board of Zoning Appeals granted Bremer House a variance from parking
requirements as they pertained to rooming houses. In the request for the variance the
applicant asked that both 847 and 855 be included since it was "intended that the
two residential buildings at 847 and 855 West 7th Street be combined into one
residential community corrections facility."
Although Bremer House notified the City in 1972 of its intention to use both
buildings as one facility, 847 was only used to house staff until 1983 when Reentry
Services took over. Since no clients were housed there in 1980 when City aoning
regulations for Community Residential Facilities were put in effect, the building at
847 did not meet the definition for Community Residential Facility and therefore
was never grandfathered in.
f. The Planning Commission handles Special Condition Use Permits for Community
, Residential Facilities. SCUP's are required when a new facility is established or an
existing facility is expanded. In this case Bremer House was not required to obtain a
permit since it was already in existence in 1980 when SCUP's were first issued. Since
then a permit was not issued by the Planning Commission for expanded occupancy
for Reentry Services because the Planning Commission was not aware of the changes.
E. STAFF ANALYSIS: There are two issues here which would require r.eview by the Planning
Commission if Reentry Services was operating this facility under an SCUP for a Community
Residential Facility:
1. The size of the facility has increased from 24 clients in 1983 under Bremer House to 40
clients at the present time under Reentry Services.
,' 2. The facility has expanded from one building to two buildings. Under Bremer House all
clients stayed at 855 while staff lived at 847. Only 855 required a state license. Now,
however, clients occupy both buildings which violates thc requirement of Section 60.203.0
that such a facility be in one main building on one zonin� lot.

The fact that the applicant believed he had zoning approval based on approval of health and
fire inspectors has complicated thc situation and is unfortunate. Reentry Scrvices was
; granted a Certificate of Occupancy and license to operate a rooming house for 24 pcople at
855 and 12 people at 847. However this did not confer City approval for a Community
Residential Facility for this number of people and it does not eliminate the requirement for a
review by the Planning Commission.
F. �TAFF RECOMMENDATION: Based on findings 1 through 4 and staff analysis, staff
recommends that the Board of Zoning Appeals uphold the determination of the Zoning
Admihistrator that the Planning Commission must review the increase in capacity at Reentry
Services and that a Special Condition Use Permit must be issued if Reentry Services is to
continue to operate with more than 24 clients.
Staff also recomments that the BZA request the Planning Commission to consider in its review
of Reentry Services the fact that since 1983 Reentry Services has been operating in two
; buildings on adjacent lots in violation of Section 60.203.0 which requires that Community
� Residential Facilities be located in one main building on one zoning lot.

Zoning Administrator , in her letter dated November 20, 1986. In

Reentry Services , Inc . has obtained and is currently operating
under a license issued by the City of St . Paul in addition to a
license issued by the State of Minnesota, Department of
Corrections . Both licenses provide that 36 residents may be
housed in the facility. The City of St . Paul has been aware of
the number of residents at the facility since is inception . On
� October 9 , 1984 , the facility petitioned the City of St . Paul for
a variance pertaining to shared bathrooms. The variance was
granted after it was reported to the City that the maximum number
of residents which would be housed at the facility was 36. The
variance was granted and at that time the City did not request
; that a Special Condition Use Permit be obtained .
Reentry Services , Inc . should be allowed to continue to operate `
its facility at 847 and 855 West 7th Street without the necessity
of obtaining a Special Condition Use Permit . The facility has
been in operation since the early 1970 ' s and , therefore, a
; Special Condition Use Permit is not required . A site plan will
be provided it it is required by the Board of Zoning Appeals .

Our records indicate that the referenced properties were occupied as the Bremer
, House, operated by the Wilder Foundation, from the early 1970s to 1983. Since
la�e 1983, the properties have been operated by Reentry Services as Reentry West.
Under both operations, the use has been as an adult correctional halfway house
' (k;nown as a "community residential facility" under St. Paul's zoning definition) .
As far as we can determine, the Bremer House license capacity for both buildings
was 24 residents. The residents were located in 855 W. 7th St. and the staff
were located in 847 W. 7th St. Since the properties were changed to Reentry
West, there have been 24 residents located in 855 W. 7th St. and 12 residents
` located in 847 W. 7th St.
The City adopted regulations pertaining to community residential facilities,
elffective December 22, 1980. At that time, a correctional halfway house was
�ncluded in the definition of a community residential facility and certain
�tandards were imposed. All new community residential facilities could only ` �,
be established by means of a special condition use permit issued by the
Planning Commission. One of the conditions added was "Permiasion for special
icondition use applies to the community residential facility only as long ae
licensing, purpose, size or location do not change." (Sec. 60.423. (3)(f) .)
� Althou h the Bremer House was established before a
g special condition use
`� permit was required, it is nevertheless sub�ect to the eame restrictions as
� facilities established under the new regulations. Therefore, because the
u
� size of the facility was increased from 24 residents to 36 residents with
Reentry Services, it is our opinion that the Planning Commission must review
� the additional capacity and issue a special condition use permit in order to
' continue operating at the current size.

On May 8, 1983 a pr.ovisional license was issued to the Lexington House facility
of the Reentry Services program, which runs through November 7, 1983. This
facility ran into opposition from a group of neighbors in the area. After
a period of time it was determined by the administration that a move to another
faCility would be in the best interest of the program. Arrangements were made
with the Wilder Foundation to lease the Bremer House facility on West 7th
Str'eet, which has been vacant since the closing of their program earlier this
ye�r.
On September 23, 1983, I met with Mr. Richard Williams, Executive Director
and Mr. Bruce Clendenan, Program Director of Reentry Services at the Bremer .
House facility. At this meeting, I received the new health and fire
in5pection approvals as well as a new license application. This facility at
855 West 7th, as well as the house next door at 847 West 7th which will house
a women's program will from this date forward be known as Reentry West. The
residents will be moving into 855 sometime during the week of September 26,
1983 and the women into 847 at a later date.
S�nce their current license at the Lexington House is due to expire on
November 7; 1983, I informed Mr. Williams and Mr. Clendenan to make their
m4ve, and once they were settled and all files and belongings were in place
I would conduct my six month inspection for this program. This inspection
will take place approximately the third week of October.

Wes� 7th Street. As you are aware, our women' s proqram was trans-
ferzed to 444 West Lynnhurst on 9/15/86. We do not intend to house
women at 847 West 7th Street at this time.
We Would like to request to have our license changed to twelve beds
for men. The program will essentially be the same as our men' s pro-
gram at 855 West 7th Street with an emphasis on Domestic Abuse.

Rscently you phoned to inquire about the leg$1 capacity of roomers for each
o� the facilities at 847�and 855 W. 7th Street. I reevaluated both facili-
ties for clarificatioa. Since our first communications in 1972 several ad-
d�,[ional sleeping rooms were added on the first floor at 847. Originally
only the four roouis on the second floor were utilized, which had a cocnbined
capacity of ten (10) roomers. The two additional rooms on the first floor
increases the toCal roomer capacity to fifteen (15) roomers, but the avail-
ability of just one full bathroom on each flaor places �a legal �limitation
of twelve (12) ropmers in the facility.
At 855 there are six (6) rooming units; all on the 2nd floor. A seventh
room, located at the 2nd floor southeast corner and pr�viously counted as

Professional Association in support of the Zoning Administrator's decision.
Gerald Frisch, 2350 W. 7th St. � representing Reentry Services, stated that his
client was grandfathered in. He referred to the letters and licenses in the
$oard's packets. He stated that the slides did not show that at W. 7th and
,�efferson there is a car lot and a McDonald's across the street. The area is
mostly business - not residential. PSR who operates nearby will no longer be
operating in the near future. His client operates the same as the Bremer
}iouse did. He stated there is confusion amongst the agencies of what is, and �
what is not allowed. He believes that his client is properly licensed. There
have never been any complaints from the Police Dept. It would be a
substantial detrimental affect on his client if the Board upholds the Zoning
Administrator's decision.
Mr. Zimniewicz asked Mr. Frisch if the residential home on the block has ever
complained� Mr. Frisch answered no.
Dave Bredemus� 371 Erie Street, representing the District Council, stated he
has lived in the neighborhood his whole life. He stated it is a residential
neighborhood and the neighborhood has had a lot of stress on it because of the
25 group homes in the immediate area. West Seventh is over concentrated in
group homes and has done more than its share in supporting the group homes.
For the first time the zoning process is on their side. There should not be
an expansion of this home.
Mr. Zimniewicz commented that there was no letter in the Board's packet from
the District. Betty Moran, 265 Oneida� Community Organizer for the District�
etated that they never send a letter to the Board if they come in person to
epeak.

Mr. $redemus stated that the neighborhood has been fighting this issue for
yearj� and are always asked to be the nice guys.
Mr. Grais asked Mr. Bredemus if the District has ever met with Mr. Frisch.
Mr. Bredemus stated that they had met with the Bremer House. Now they have
fourjd out that Reentry Services is using the other home and the population has
increased.
Mr. Woods asked if the District had ever invited Mr. Frisch to their meeting.
Ms. Moran stated that the had not. Reentry� as well as the City, is well
awa�e of the District's stance on the issue. •
Frank Marcoglies� 509 Jefferson, stated that he never received any notice from
the Bremer House. He stated that Mr. Frisch does not have his facts straight
in 'that the neighborhood is residential� not commercial. He understands that
these people need help but their neighborhood is over concentrated with 25
graup homes in the area already within 50 feet of his home. This is the first
timle he has every heard of the second home being used by Reentry Services at
gii.
Mr. Frisch stated that the issue before the Board is whether or not the Zoning
Administrator erred. His client was grandfathered in. If the Board is going
toihold a public hearing then lets open a hearing for all the homes in the
area and not single out his client. Anyone who states they did not know what I
was going on in the homes is a sham� there were public hearings held and they ;
are a public record.
Mr. Bredemus stated that the issue is not overconcentration. If the Board
doies not follow the zoning rules now what good does the Zoning Code do to the
pe,ople of St, Paul.
Mr. Kirk reminded Mr. Bredemus that the issue before the Board is whether or
nqt the Zoning Administrator erred in his decision.
Mr. Beach stated that the issue here is not if the facility can operate here

Mr. Frisch stated that the issue is whether or not the facility can operate
with 36 people and asked how many times his client has to come before the
Bbard on this issue. He referred to the documents attached to the Board's
pgckets. He stated that it is not an expansion� his client is already
a�proved for this number of residents. It is a sham that the Board is coming �
a�ter his client and they should not be required to obtain anymore permits. �
�r. Beach stated that it is true that the City agreed to a rooming house but

Mr. IQirk asked l�Ir. Segal how the Board is charged to proceed. I�Ir. Segal
stat�d that the Board's duty is to evaluate whether or not the Zoning
Administrator made an error.
Ms. I,.ane stated that their is a committee that reviews building code issues
but they do not look into the zoning issues. Staff is looking into a city
proc�ss to include zoning issues so that when these cases are reviewed by the
committee they will know what the zoning issues are.
Hear�ng no further testimony� Mr. Grais closed the public portion of the " ��
meet�ng.
Mr. psborn moved to approve the decision of the Zoning Administrator based on �
staf�f findings 1 through 4 and the staff analysis. Mr. Woods seconded the
moti;on� which failed on a roll call vote of 3-0-1 (Zimniewicz abstaining) .
Quorum for the Board of Zoning Appeals is four votes.
Mr. ;Woods moved to lay over the case until the April 14 meeting in hopes that
more members of the Board would be in attendance to vote on the serious issue.

REENTRY SERVICES. INC. (#10053) : The applicant ia appealing a decieion of the
Zon'�ng Administrator which says that a correctional halfway house run by
Reentry Services at 847 and 855 requires a Special Condition Use Permit
bec�suae the number of residents has increased.

th� Zoning Administrator. A letter was received from the West End Business
Pr4fess1onal Association in support of the Zoning Administrator'� decision.
Gerald Frisch� 2350 W. 7th St. � representing Reentry Servicea� Inc. stated
th�t at the last hearing there were some questions that aroas and today he has
brpught two additional witnessea with him that will give teatimony directly on
th� two issues which included size that has alleged to increase and whether or
not there has been an expansion from one to two buildings. He noted that
there were appearancea from the neighborhood at the last meeting but no ons i�
ob�ected to Reentry Service� operation. Reentry Servicea haa been a good
ne'ighborhood� they are in a mixed-use location. The only opposing iseue from
tlie neighborhood wea that they are over concentrated with aimilar type
facilities. Prior to this time PSR, Inc. operated in the area� they are no
longer in the area. He finda the ataff report incomplete� not at the fault of
the �tsff� but because of the lack of written information. He stated that his
c�ient was grandfathered in prior to 1980, haa not changed anything, has had
the authority to operate 24 units in 855 West Seventh Strest and 12 in 847
iJ�at Seventh Street. He apecifically asked the Board to look at sxhibit 22 in
tt�e packet which was an application to the Board of Appeal� back in 1984.
Tt�at application was approved by the City Council. In that application there
wa� 24 residing in 855 West Seventh Street and 12 in 847 West Seventh Street.
He believes that after the Board hears the testimony presented here today they
w�.11 believe without a doubt that Reentry Servicao� Inc. can remain without
application for a Bpecial condition uee permit.
J�ack Young, Director of Ramsey County Department of Community Corrections, has
s�erved as the chairman on the zoning commission in his local community, rtated
that he was a representative of the Amheret H. Wilder Foundation in 1972 at
�he time Bremer House waa opened. Bremer Houae was opened so the result of

In l�arch 13� 1972 he wrote a letter to the Mayor and City Council to request
for 'a variance for off-street parking issues. It was intended that both
buildings be combined in one correctional facility. The matter was looked at
tho�oughly. 855 West Seventh Street was licensed from 24 to 30 residents
apptoximately. It was not their intention to have more 24 residents in that
building. The facility at 847 West Seventh Street was licensed from 10 to 12
res�dents. The plan was to use 847 West Seventh Street to house residents,
coumselors and staff. He had responaibility for that program for aeven years
witli the Wilder Foundation until 1979. In 1979 he requeated a re-evaluation
from the city of room capacities of both facilities. He received a letter
from the Department of Community Services� Division of Public Health in which
the�r indicated that they had re-evaluated both facilities and indicated that
SSS� West Seventh Street total legal capacity was 24 residents and 847 West
Sev�enth Street total legal capacity was 12 reaidents. In 1980 there was
leg,'islation enacted by the state legislature that provided that the state
comrniseioner of corrections establish minimum �tandarda for any type of
cor,'rectional facility and provide for the licensing of correctional
fac�ilities. He was serving as the state corrections commissioner at that time
and licensed the Bremer House facilities both at 855 West Seventh Street for - �`
24 ;residents and licensed 847 West Seventh Street for 12 residents. There was
a consistency of licensing. Both facilities have always been used for
residents. In the seven years he was at the Wilder Foundation 847 West
SeVenth Street was a part of the program. It was a aix-etep program. 847
West Seventh Street was used for residents that had more freedom and housed
interns that were doing work in the program. Ramsey County� of which he is
re�resenting� is the primary user of the program, they averaged 7600 client
days there last year. They use it heavily. Last year they budgeted $235,000
fox Reentry Services� Inc. There have been amall modifications within the
pr�grsm over the years from when the Wilder Foundation operated it. The use
the program ia substantially the same now aa when it opened.
Ro�d Johnson, Director of the Wilder Community Assistance Program� a program he
he�lped atart in 1980. Prior to that he worked at the Bremer House as the
As;ei�tant Director from July 1976 through November of 1980. He was
re�sponsible for the treatment program and monitoring the residents as they
went through the various steps of the program. In 847 West Seventh Street
tt�ere were clients there the day he arrived and laft. The number of clients
di�ffered at times. They always had 4 clisnta on the low aide and 8 to 10
residents in the last two phases of the program. Only in the last phase of
ttle program could they live at 847 West Seventh Street. Later that was
ctnanged and allowed to go over there sooner. The residents were under very
s�rict supervision. As they earned and demonstrated they could handle
responsibility they were given increased amounts of freedom. There have ��
a�ways been residents in 847 West Seventh Street. The only nwnbers he was
aware of that they were licensed for was 24 residents at 855 West Seventb
Street and 12 reaidenta at 847 Weat Seventh Street, When Wilder declded to
c�loa• thst facility he wsa aaked for hio recommandstion on whwt ohould be dond

facility aa a correctional facility, They had a very good roputation in the
neighborhood. They were vdry concerned who would take over Che operation of

they looked at various options� but felt Reentry Services was the best program
to gp in there to operate the kind of �ervicea that were needed and to
�ain�ain the image Bremer House had.
Mr. Lloods asked Mr. Johnson who operates the facility. Mr. Johnson stated
that; Wilder owns the property and it is leased to Reentry Services at the
present time. Bremer House had s purchase of service contract with Ramsey
Coun�ty Community Corrections Department. The initial funding came from some
fede;ral grants. After that it was a purchase of service contract from the
Rams'ey County Community Corrections Department� a per diem for each client
thaC was placed there. The Wilder Foundation continued to aubsidize thet
program throughout ita existence depending on the occupancy. In the later
yea�s it was between $100�000 to $150�000 a year. The clients also
conCributed at that time when they got in the latter •tages of the program and
were working.
Mr. ;Woods asked Mr. Johnson what the occupancy of the main building was. Mr,
Johdson stated that it never exceeded 24 in 855 West Seventh Street.
Mr. Frisch summarized by saying Mr. Young stated that the facilities were
combined into one community residential facility as opposed to two. Any
indication in the staff'a report that there are two facilities is �in error.
The number of clients has not changed� the operation has not changed. He
cant�ot understand why hi� client has to appear before every level of the City
of St. Paul recontesting the same issue. He atated he would like to Board to
over rule the Zoning Adminiatrator's decision� not because ahe didn't do
thipgs properly� but because she failed to have the type of evidence and
tesiCimony which the Board has before them today.
Mr. Kirk asked Mr. Frisch if at the time they were licensed back in the 70's
for; both units� was the 2oning Administrator aware of thia aituation. What he
has� been able to obtain from Mr. Young and Mr. Johnson indicates thst Reentry
wae licensed from the proper authoritiea. He does not know if the Zoning
Administrator new that.
Mr. Peteraon referred to exhibit 21 which waa 4 rooming house cla�aification
and asked etaff if it was properly licensed. Mr. Beach atated that that house
is ,licensed as a rooming house. The other city departments that have
inslpected the house were looking at it otrictly as a rooming house to see if `�
it meets building code.
John Hardwick� Building Inspection and Design� atated that in checking with
Catchedi'� office he understands that the Reentry's license covera both
facilYtieB.
Mr: Peterson asked what the difference was between a rooming houae and a
community residential facility license. Mr. Hardwick stated that a community
reaidential facility can be located in a zoning diatrict that doea not permit

conl�ition use permit would be required because the new owner of the facility
was' increasing the number of residents, Based on the teatimony heard today he
ask�d Mr. Hardwick if he agreed with Ms. Lane's deciaion now. Mr. �iardwick
stated that Reentry Services stated that both buildings were used. 847 West
Sev�nth Street was sstablished to hold clienta. The application for a �tate
license in 1985 requested an increase of residents from 24 to 28. The Zoning
Code otates that when there is a change in the number of residents the
app�icant must go before the Planning Commission for a special condition use
pe nlnit. At this time the Zoning Administrator has no svidence to change its
decision.
Mr. � Peterson atated that 847 West Seventh Street was used to house staff. Mr.
Fri�ch etated that if you look at the license you will eee that Reentry
Seryices two buildings were licensed as one.

Mr. , Peterson asked Mr. Hardwick if what he was saying is that the only
building needing licensing is 855 West Seventh Street. Mr. Hardwick answered
no� � that 855 West Seventh Street has been licensed.
Mr. � peterson esked Mr. Hardwick how Mr. Carchedi could have licensed it. Mr.
Hardwick stated that it was a typographical error. Obviously 847 West Seventh
Street could not house 25 to 60 residents as indicated on the licer►se.
Mr. � Friach stated that it was disturbing to have the witness's testimony
qus�tioned when they are high quality individuala.
Mr. ''Hardwick raferred to the license documenta within the Board'a packet,
�teting that it appears to him that Reentry was proposing to change in
cap�city and sex of residents occupying buildings.
Mr. 'Peterson stated that he understood Mr. Hardwick's oint
the ,'license capacity was �o they couldn't exceed that numberbof residentsthat
Mr. �Woods asked Mr. Beach to clarify staff's recommendation and asked that Mr.
Fri�ch to clarify why Reentry does not want to comply with getting a �pecial
condition use permit.
Mr. ,Beach atated that a special condition use permit i� required for Reentry.

Ricrhard Williams� Executive Director of Reentry Services� atated that capacity
ig 12 residents at 847 Weat Seventh Street and 24 reaidenta at 855 West
Sewenth Street. They have never exceeded those number�. The residents go
baak and forth between the buildings. They have a facility at 531 Ashland and
the reason they eaked for an increase ia because sometimea these residents
would come over for the weekend.
Mr; Peterson asked Mr. Williams if they are licensed for 12 residents' at 847
We�t Seventh Street and 24 reaidenta at 855 Weat Seventh Street. Mr. Williams
an�werad yea, they have a certificate of occupancy hanging on their wall. Mr.
Pekerson asked if the have been issued the �ame type of license. Mr. Williams
an�wered yes. .
Mr. Segal ststed that in the Board's packet there i� a license from the State
referring to 24 male reaidents at 855 West Seventh Street� then a memo stating
847 will house women� then a state license atating Reentry will house 12
female residents at 847 West Seventh Street and 24 male residents at 855 West
Seirenth Street� then a letter from Reentry requeating increase fxom 24 to 28�
th'en a state license stating Reentry will house 12 female residents at 847
West Seventh Street and 28 male residents at 855 We�t Seventh Street. He
atated that if the issue is 855 West Seventh Street having 28 or 24 residents
R�entry has had a state licenae �ince 1983. If the iesue is Ms. Lane's letter
i� would be important to know when the amendment requiring Planning Commission ,
r�view of any changes was added to the Zoning Code. �
Mr. Hardwick stated that the question remeins if 847 West Seventh Street was a
cmmmunity reaidential facility or used to houee ataff. The licensing by State
indicates the facility is in state of flux. He has aeen no evidence of number
of clientele or sex of clientele.
Mr. Williams stated that Reentry is in a state of flux. They have been
c�►anging for the last ten yeara. The fact that it ia a man or women resident
nske� no difference. They are growing because they ara needed.
M'r. Woods asked Mr. Williams the number of clienta they are allowed. Mr.
W;illiams answered 36 between the two facilitiea.
l�r. Woods asked Mr. Williams why it ia �o hard for them to apply for a special
c'ondition use permit. Mr. Williams atated that they feel they are operating
legally and it is sxpensive to hire attorneys and consultants to do ao.
Mr. Peterson asked why the Board ia to take action on something that heppened
tthree years ago, Mr. Hardwick stated that there are different definitions
within the city departmente of community reaidential facilitie� and rooming

special condition use permit is needed if changes occur in the operation of
the facility.

Mr. Frisch stated that the testimony given before the Board was by individuals
who had first hand knowledge of Reentry Services. There ie no question about
it that Reentry has not changed ita operation in any way, He does not
undexatand why the Zoning Admini�trator repreaentative doea not admit that
they had second hand information. He atated that if you search through the
docu�oents and all witnese testimony you will �ee there is no opposition to
Aeentry.
Mr. �eterson moved to overturn the Zoning Administrator's deciaion based on I
Sect�on 60.423(c)(6) in that the 2oning Adminiatrator believed that there were I
24 r�sidents and that testimony given today indicates there were 36 residents ,
all �along. Mr. Osborn amended the motion that any further enlargement would
requ�re a special condition use permit after review by the Planning �
Comm�ssion. Mr. Osborn seconded the motion� which passed on a roll call of 4 ,

� operating as a Community Residential Facility as required by Section 60.423(3f) of the
; Zoning Code because the number of residents has increased from 24 to 36; and
� WHEREAS, the Saint Paul Board of Zoning Appeals conducted public hearings on
; March 10 and April 14, 1987, pursuant to said appeal in accordance with the requirements
� of Section 62.204 of the Lcgislative Codc; and
; WHEREAS, the Saint Paul Board of Zoning Appeals based upon evidence presented at the
� public hearing, as substantially reflectcd in the minutes, made the following findings of
fact:
� 1. Reentry Serviccs runs a correctional halfway house at 847 and 855 West Seventh Street.
; It is currently licensed by the Minnesota Department of Correction for a total of 40
� male client/resideats (28 at 855 and 12 at 847). The number of clients actually living at
� the facility is approximatety 30-36 clients.
� The staff operates in 3 shiPts and does not live on the premises. During the day and
' evening shift there are at least 2 staff people. During the night shift and weekends
; there is normally 1 staff person on duty.
; The typical client is 22-25 year old male. Clients are referred to the program and stay
� an average of 60 to 90 days.
; 2. The City adopted regulations pertaining to community residential facilities, effective
December 22, 1980. At that time, a correctional halfway house was included in the
; definition of a community residential facility and certain standards were imposed. All
; new community residential facilities could only be established by means of a special
� condition use permit issued by the Planning Commission. One of the conditions added
; was "Permission for special condition use applies to the community residential facility
only as long as licensiag, purpose, size or location do not change." (Sec. 60.423.(3)(f).)
; 3. Reentry Services is operating without a Special Condition Use Permit (SCUP) at this
� time. This is because in 1980 when the City established the SCUP system for
; Community Residential Facilities existing operations were not required to obtain a
� permit. At that time an earlier halfway house known as Bremer House was already
operating on the property.
� 4. According to testimony presented to the BZA by individuals involved with Bremer
; House prior to Reentry Services, the houses at 847 and 855 were run as a correctional
halfway house by Bremer House from the early 1970's to 1983, and there were clients
; living at both 847 and 855 during this time: up to 24 at 855 and up to 8 or 10 at 847.

NOW, THEREFORE, BE 1T RESOLVED, by the Saint Paul Board of Zoning Appeals that:
1. The Zoning Administrator erred in his determination that Reentry Services increased
the numbcr of residents at its facilities located at 847 and 855 West Seventh Street (Lots
6, 7, 8, 9 and Lots 1 l, 12, 13, 14 and 1 S lying northwest of West Seventh Street, Block 17,
� Stinson Brown and Ramsey's Addition).
2. Reentry Services may continue to operate a correctional halfway facility with up to 36
; clients/residcnts utilizing both houses on the property (847 and 855 West Seventh Street).
� 3. Any increase in the number of clients/residents beyond 36 will require a Special
Condition Usc Permit.
