99-634Council File # ��� �1 ORIGINAL Presented By Referred To RESOLUTION OF SAINT PAUL, NIINNESOTA C �u��_ �-- �.�i- 2 WHEREAS, the City of Saint Paul and Prom Management Group, Inc. have previously 3 entered into an Agreement dated June l, 1998 granting Prom the privilege of operating the food 4 and beverage service, equipment rental, banquet and meting room rental and catering service at 5 the Como Lakeside Pavilion; and WHEREAS, Prom Catering previously held a Saint Paul liquor license which was used for liquor service at Como Lakeside Pavilion but no longer has such a license; and 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 WHEREAS, Laws of Minnesota 1997, Chapter 129, Art. 1, §19 permits the city of St. Paul to issue an on-sale intoxicating liquor license to the city's division of parks and recreation for the sale and service of liquor on property owned by the city and under the jurisdiction of the division and to authorize the use of said license by persons who have contracted wlth the city to sell or serve liquor on such property; and W�lEREAS, the Saint Paul Parks & Recreation Division has been issued a liquor license far the Como Lakeside Pauilion and wishes to permit the use of said license by Prom Catering for service of liquor at its events at Como Lakeside Pauilion; now, therefore be it RESOLVED, that the Prom Management Group is authorized to use the Division of Parks & Recreation's liquor license to sell or serve liquor at private rental events at the Como Lakeside Pavilion in 1999 under the following terms and conditions: Sale and service of liquor shall be restricted to individuals attending the private rental event at the Pavilion, and shall be limited to the time and date of the event. No alcohol may be served outside the Como Lakeside Pavilion. 2. That Prom Management sha11 be subject to the City of Saint Paul ordinances and State of Minnesota statutes relating to the sale and service of alcohol. Violations of the laws relating to the sale and service of alcohol shall be a basis for denying Prom Management Group the use of the Pazks and Recrearion Division's liquor license for its operations at the Como Lakeside Pavilion. 3. That prudent caze will be taken to insure that no alcohol is served to any person under the age of 21, or to any person who is intoxicated. Green sheet # 6 ��� �Z 1 4. That the Prom Management Crroup shall provide liquor liability �G 2 insurance in an amount of not less than One Million Doliars 3 ($1,000,000.00) for the term of their Agreement with the City. A 4 certificate of insurance naming tl�e City as an additional insured 5 shall be provided to the City's Division of Risk Management, and 6 the policy shall provide for tlurty days notice to the City of any 7 cancellation.
