[,ihereas, under Mirm. Stat. 134.31 it is the policy of the state to ;support the provi�ion of library service and the development of cooperative - 'programs for the shari.ng of resources and servi.ces; and Whereas, L,DS has determined that ane program to implement the state�s �policy is the provisian of an interlibrary loan and reference service to the regional public library systems of Minnesota; and Whereas, the Library is capable of operating a program of interlibrary loan and reference service; ' Now therefor�, the pa.rties hereto agree as follows: I. The Library shatl: A. Receive interlibrary loan and reference reqt�sts via comrnnzicatians rnedia as may be agreed upon by the parties from the regional public library ' systems outside the counties of Anoka, Carver, Dakota, Herniepin, Ramsey, Scott and Washington through comrninications nodes designated by LDS. B. Lend items from its collection in response to requests received heretmder and refer unfilled requests via an established routi�g system ; to other libraries deemed probable seconda.ry saurces including but not limi.ted to other public libraries participating in the Metropalitan Library Service Agency (NIEISA), academic libraries thraugh Cooperatin�g Libraries in Consortitan (CLIC) and the Minnesota Interlibrary ; Telecomrrn.mications Exchange (MINITEX) at the University of Minnesota. � � . i , - 2 - ��7-1�� I C. Maintain a system of reservi items to f' � ill requests received ' hereunder in cases where said items are in use when a request for said ' items is received. iD• Provi.de up to 25 pages of photocopies of library materials without charge in lieu of the loan of an item, such services to be � provided consistent with provisions ofi Title 17, U.S. Code. , E• Provide to LDS monthly reports of the amount of services � _ provided hereunder including the services provided by secondary saurces. � F. Provide to LDS an arinual report of expenditures incurred ' hereunder including pa,yments to secondary sources. G. Pravide to LDS information cancerni.ng problems encountered, recammendativns for improved services and other reasonable and appropriate information as may be mutually agreed to regarding the operatian of the services pravided herewnder. , H. From the amount established in Section II, D., reimburse � secondary sources, except MIDIITEX and CI,IC, at the rate of $1.15 per search and $3.00 per fill, provided that the secondary sources shall ' agree to ma.intain a system for placing rec�uests on a waiting Iist when ' the requested materials are in use. , •II. The Office of Library Develop�nent and Services shall: � A. Develop in consultation with the Library policies and procedures , to implement the program of interlibrary loan and reference service and provide a manual of said policies and procedures to the regiona.l public ' library systems. ' B. Coordina,te the interlibrary loan and reference serviee netw�ork iresulting from this agreement and serve as a commiuiicatian charinel on imatters of policy between the Library ar�cl the regianal public library systems reeeiving services heretmder. , - 3 - �- �7-1�� C. Pravide to the Library a list of regional public library system co�icatian nodes eligible to submit interlibrary loan � and reference requests. , D. Reimburse the Library for services provi.ded hereunder during the state's fiscal year ending June 30, 1988 in the amount of $207,100 which sha1T be paid to the Library in four install.ments provided that no su�ch payment shall be made in advance of the period for which paid. I III. All services provided by the Library pursuant to this a eement � � shall be performed to the satis£actio� of LDS as deteYmined in the � sole discretion of its authorized agent. William G.
