�ode is hereby amended to read as follows :
� 140 .07B . Exterior Sign . Bannersor signs may be
affixed to the exterior of skyway bridges . The

and signs :

and signs shall be in conformity with
� the specification f the City De�artment
� of Public Works .

You have asked what was the inte t of Section 140 . 07B(2) of the
Amended Ordinance which Section rohibits the Department of
� Public j•Jorks from affixing or re oving banners or signs to the
iexterior of skyway bridges .

IThe intent was that Public Works be the sole agent for affiYing
and removing such signs , but it ppears that the deletion of the
� word "except" in the final draft ordinance changed the meaning of
� Section 140 . 07B(2) to the exact pposite .
� The Amended Ordinance derived fr m the report and recommendations
� of the Sky�eay Task Force of the lanning Commission tahich, among
; other things , proposed as a draft rule under Section 140 . 06 -
� "The Department of Public � orks , Lighting is the
� preferred agent for the in tallation and removal
of external banners and si ns . There is a fee
j for this service . "
� In an earlier draft of the Amen ed Ordinance Section 140 . 078(2)

Section 140.01 Definitions
I Subdivision 1.Terms.The definitions of this section shall apply in the

j Subd.2."Pedestrian sky ay system"means any system of providing
; for pedestrian traffic circ lation, mechanical or otherwise, elevated
above ground, within d without the public rights of way, and
through or above priva e property and buildings, and includes
� overpasses, bridges, pass geways, walkways, concourses, hallways,
� corridors,anades,courts,plazas,malls,elevators,escalators;heated
, canopies and access and all fixtures,�furniture, signs, equipment,
i facilities, services, and appurtenances. The term shall include
' systems or portions of s stems which are built in the future. For
� purposes of this chapter, a pedestrian skyway system shall include
• i stairways and escalators leading from or into the skyway system
from private buildings a d areas under stairs and escalators leading
I to and connecting conc rse corridors, in addition to stairs and
escalators connecting th concourse corridors to public streets or
� other public property.
� Subd. 3."Skyway gove ance committee."The"skyway governance
committee" shall consist of seven persons appointed by the mayor
j and who represent, resp tively, the Building Owner and Managers
' Association, the Saint aul Police Department, the Downtown
Council, the Downtow Community Council, skyway ,connected
small businesses, a repre entative from,the accessibility.,community
' and a youth representat ve. A chairperson shall be elected by the
I committee to call and preside over its meetings.�`.The 'skyway . _
I governance committee sh 11 in addition to other functions�imposed by
, this chapter, advise the ayor, council and building owners on all
i matters relating to the uccessful public use and enjoyment of the
pedestrian skyway syst m and pedestrian malls, including but not
� limited to lighting, sta dardized signs and directories, improved
communications betwee law enfomement authorities and retail
i merchants, hours of ope ation, and othermatters of public concern
�, relative to the public wa s.The skyway governance committee shall
! be responsible for enfor ing adopted skyway policies, including but
' not limited to hours o operation, levels of maintenance, use of
j skyway space for sales nd performance as provided for by section
' 140.06 of this ordinance and advertising in the skyway conidors as
provided for by secti 140.08 of this ordinance. The skyway
governance committee s ali have the authority to grant variances to
i the guidelines contained in this ordinance, depending on the facts of
the case in question.The kyway governance committee shall conduct
' policy discussions at pu lic meetings, notifying interested parties of

I lottery or chance when circumsta ces required a limit to the number of
permits granted.The rules and gui elines as adopted by the City Council
shall be reviewed periodically, an at least every two years the skyway
� governance committee shall submi its recommendations respecting rules
' changes. , ' I
Sec. 5. Chapter 140 of the Saint Paul TJ;egislative Code is hereby amended by
renumbering section 140.07 as section 140.�8 and inserting as a new section 140.07
the following:
140.07.A. Advertising. Billboa�d-Style or enclosed display case
i advertising is a permitted use in skyway corridors. The following
requirements apply to advertisin�
i (1) The size, shape and placement'of advertising display fixtures should
be such as to not impede pedes�rian circulation in the skyway system.
� (2) Advertising should`be cont�amed in "permanent" non-movable
-fixtures; including but not li�ited to glass display cases affixed to
j �wa11s and kiosks anchored to he floor.
' (3) The'design and initial inst llation of advertising fixture in the
pedestrian skyway system an /or pedestrian malls must be approved
I by the skyway governance ommittee and the affected building
owner. No advertising fixtur shall be installed in an easement area
of the pedestrian skyway ystem or pedestrian mall except as
' authorized by franchise ordi ance duly adopted by the City Council
� which ordinance shall minim lly incorporate the requirements of this
� section. No advertising fixtu e shall be installed in a non-easement
' area of the pedestrian sky ay system or pedestrian mall except
under written contract bet een the advertising installer and the
�i affected building owner hich contract shall incorporate the
i requirements of this section Advertising installers shall contract
with the owner of the builidn in which each advertising fixture is to
� be located for services to b provided from the building for the
' fixture.
I (4) Advertising and displays st�ould be changed at least every other
i month. I
(5) Advertising shall not be perr�itted within the skyway bridges.
(6) Advertising shall be subject o such additional rules and regulations
', as the skyway governance co mittee may determine.
(7) Advertising fixtures, cases a d displays shall be covered by fire and
iextended coverage insura ce and public liability insurance.
� Minimum policy limits shall be replacement cost of the advertising
Ifixtures, cases and displays nd replacement cost of the building in
; which such fixtures are loca ed for fire and extended coverage and
i $1,000,000 single limit cove age for the public liability insurance.
Insurance policies shall be issued by companies licensed to do
� business in Minnesota, sh 11 name the City, the Housing and
, Redevelopment Authority o�the City of Saint Paul, Minnesota(the
I "HRA")and the building ov�ner as additional insureds and shall not
be concelable without thirty 430)days written notice to the additional
� insureds. Endorsements of a�policy or policies issued to the building
owner providing additiona insured coverage to, the advertising
fixture installer and the���y`in coVerages-othercdise meeting"the
� requirements of this subse tion shall'b'e acceptable in lieu of a
Iseparate policy or policies.
