The meetinq of the Board of App als & Review was called to order
by Chairman Ron Glassman, at 1 :30 p.m. October 13 , 1987. Mr.
Glassman welcomed the appellan s and explained the procedures
stating that what the Board does is recommends �action to the City
Council .
Minutes of the September 9, 1 t37 meeting were approved as
submitted in writing.
Ron Glassman introduced Roy Bred hl to the Board. Mr. Bredahl
from the Water Department aske to address the board regarding
the Rainleader Ordinance.
Mr. Bredahl , Manager of the Sew r Division for Public Works. As
part of the combined Street 8 Sewer Program, the city is
required to abate pollution, whict� is, abatement of pollution ofi
the river, as a part of the pr gram the city is required under
the permit of the Federal and S a�e Government to eliminate the
extra inflows of storm water int the sanitary sewer system. One
of the sources is from the rain leaders , therefore rainleaders
must be disconnected firom the ombined sanitary system. This
program was implemented two yea s ago as a voiuntarily type of
process, but in April of 19 7, the City Council passed a
� ordinance, that becomes effecti e as of January 1 , 1988. It will
� become mandatory that rainlea ers be disconnected from
residential households and comme cial properties . The City has a

Mike Kasson, Project Manager wo king on the variance process. The
city has developed a variance olicy, which sets forth some of
the criteria that will be sed for granting a variance.
Basicaily, the procedure tha has been set up is that the
property owner wishing to appl for a variance, will provide a
written explanation as to why e/she feels that a variance would
be justitied. "ihe City stafr" ill then go out to inspect the
property, and make a determination as to whether a variance
should be granted. If the star feeis that no variance shouid be
granted, thPn this is where tr� Board of A�peals 8 Review wo�!ld
beceme the Arbitrator. Direct r of Public Works Department can
grant a extension of time pon application. There is no
permnament variance granted, only a two year variance, then these
variances will be reviewed.
Gienn Gausman referred to his letter that was distributed to the
Board Members at the September eeting for review and then have
discussion at the October meeting regarding the Ordinance on Nrall
insulation. �
Mr. Gausman and Mr. Gasterland a tended a seminar on the s�bject
of wall insulation. Mr. Gausma stated that af�ter attending
the seminar, hz is more convi ced not only should there be a
vapor barrier, there should be an excellent job of stopping air
� infiltration into the walls. Th re is nothing in the energy coc�e

or the way it is interpreted. At this point , Mr. Glassman
suggested that the original ordinance be reviewe� and then make
sugestions , as to the changes th Board would like to amend.
Mr. Glassman made a motion to f rward the letter to Councii , at
the discretion of Bi11 Tilton a d Glenn Gausman putting a
closing on the letter as to what the board wishes to enforce on the
ordinance. MOTION CARRIED.

single family residence located near Rice Street. The building
is vacant and boarded. The c rrespondence Mr. Roy received
stated Ms. LaRose is in a nursi g home. The appeal was filed by
Ms. LaRose' s son. This is a financiai hardship. Total incomP
for Ms. LaRose after �aying rent is $55. 00 per month.
City Council passed �he ordina ce on vacant building fees to
discourage owners from keeping uildings vacant, and to recoup
some of the cost i,ncurred in mon 'toring these buitdings .
BOARD ACTION: Motion made by Ha old Knutson to deny the request
for a waiver of the vacant bu lding fees. Seconded by Glenn

neighborhood boarded up does create a negative attitude.

PROCEEDINGS: The Appellant st ted that this building has gone
�.�•� through an expensive rehab proc ss. The remodeling was okayed by
Heritage Perservation. The building was cornpieted an� no mention
of screens, and at that time a ertificate of Occupancy was issued.
At the time of the inspection he appellant was told to update
the sprinkier system, which was done, also installed smoke
detectors.
Hope Abrams , frorn Fire Preven ion stated that Legislative Code
requires that screens be in pla e from June 1 , to October 15.
The Appellant states that the t nants sometirnes do dis�onnect the
door closures. This buildin has a share bath and kitchen
situation, therefore many ti es forgetting their keys in the
room, that is the reason that the door closures were
disconnected.
There are smoke detectors in each unit. The buiiding has a
compiete sprinkler system wi h an alarm system outside the
building.

inspected the building noticed o sprinklers in part of the third
floor hallways . The appellan stated that the sprinklers that
should be in the hallway on the third itoor were put in wrong and
the will be corrected.

SUBJECT: Appellant is requesting a variance from St. Paul
Legislative Code, pertaining t escape windows, Item #3 from a
letter dated March 17, 1987.
PROCEEDINGS: Mr. Olson stated that in 1982 a Certificate of
Occupancy was made on the buildi g, one of the items dealt with,
was the windows in question, wh 'ch are in a large bedroom on the
third ( 16 x 20) . At that time specification were given to the
appellant, and they were in com liance. The escape window is in
a large walk in closet, which dr ps to a porch roof.
�.�, Mike Ricketson, from Fire Preven ion states that the code is that
there must be an escape window i bedrooms. If an adjacent room
has a window that is used as an escape window then the wall must

Safety states that Reentry Se v.ices is no longer in compliance
with St. Paul Legislative Code 34. 11 , therefore the A�pellant is

PROCEEQINGS: Appellant needs a ariance on the number of baths to

- type of clientele Fire Preve-�ti n would recommend a variance.
At this time, Mr. Glassman want d the records to show that he was
involved in the sale of the �ui ding.
