Pa 1 ermo ' The meeting of the Board of Ap eals 8 Review was called to order by Chairman Ron Glassman, at 1 :30 p.m. October 13 , 1987. Mr. Glassman welcomed the a�pella ts and explained the procedures stating that what the Board doe is recommends �action to the City Counci �l . Minutes of the September 9, 1987 meeting were approved as submitted in writing. Ron Glassman introduced Rey Bre ahl to the Board. Mr-. Bredahl from the Water Department ask d to address the board regardin� the Rainleader Ordinance. Mr. Bredahl , Manager of �he Se er Division fior Public Works. As part of the combined S�reet Sewer Program, the city is required to abate pollution, w ich is , abatement of poilutivn of the river, as a part of the p ogram the city is required under the permit of the Federa� and tai�e Government to eiiminate the extra inflows of storm wa�er in o the sanitary sewer system. One of the sources is from t:^.e rai leaders , therefore rainleaaers must be disconnected frem the combiried sanita�-y system. This program was implemented �wo ye rs ago as a voluntarily type ofi process, but in April of 1 87, the City Council passed a I ordinance, that becomes effect ve as of January 1 , 1988. It will " become mandatory that rainle ders be disconnected from residential households ane comm rciai properties . The City has a 1 .- . �� , �� � ����<7U� proce�s f�t- variances for tr� c�nditi�n� that are hardship and � _ the like. Mike Kasson, Project Manager orking on the variance process. The city has developed a varianc policy, which sets forth some of the criteria that will be used for granting a varidnce. Basicaily, the procedure t at has been set up is that the property owner wishing to ap ly for a variance, will provide a written explanation as to wh he/she feels that a variance would be justified. The City stafr will then go out to ins�ect the property. and make a determination as to whether a variance should be granted. If the staff feeis that no variance shou !d be granted, thPn this is where the Board �f A;�peais & Rcview would become the Arbitra�tor. Direc or of Public Works Uepartment can grant a extension of time upon application. There is no permnament variance granted, o ly a two year variance, thcn these variances wili be reviewed. Glenn Gausman referrecl to his letter- that was distributed to the Board Members at the Septembe meeting for review and then have discussion at the ,October meeting regarding the Ordinance on Hrail insulation. Mr. Gausman and Mr. Gasterland attended a seminar on the subject of wall insulation. Mr. Gaus an stated that after attending the seminar, he is more con inced not only should there be. a C--� vapor barrier, there should e an excellent job of stopping air :_'-} infiltration into the walls. here is nothing in the energy code or the way it is interpreted. At this . point, Mr. Glassman suggested that the original o dinance be reviewed and then m�ke sugestions , as to the changes he 6oard wouid like to amend. Mr. Glassman made a motion to forward the letter to Councii , at the discretion of Bill Tilton and Glenn Gausman putting a ciosing on the letter as to wh t the board wishes to enforce on the ordinance. Roy received stated Ms . LaRose is in a nur ing home. The appeal was filed by Ms. LaRose' s son. This is a financial hardship. Total incom� for Ms. LaRose after paying i-e t is $55. 0� ner month. City Council passed �#�e ordinance on vacant building fee5 to discourage owners from keepin_ buildings vacant, and to recoup some of the cost i.ncurred in monitoring these buildings. The remodeling was okayed by Heritace Perservation. The building was completed and no mention of scre�ns, and at that time a Certificate of Occupancy was issued. At the time of the inspeci: ion the appellant was told to update the sprinkler system, which was done, also installed smoke detectors. Hope Abrams , from Fire Preve tion stated that Legislative Code requires that screens be in pl ce from June 1 , to October 15. The ApG�llant states that the enants sometimes do disconnect the door ciosures . This buildi �� has a share bath and kitchen situation, therefore many times forgetting their keys in the room, that is the reason that the door closures were disconr:ected. There are smoke detectors i each unit. The building has a complete sprinkler system w th an alarm system outside the bui ldir.g. Hope Abrams , from Fire Preven ion stated that the inspector that inspect�d the building noticed no sprinklers in part of the third floor naliways. Since then St. Paul Planninq Commision granted Reentry Metro a modification of its special c ndition use permit to increasu the number of b�ds from 2z, to 26, since then Department of Fire and Safety states that Reentry Services is no longer in compliance with St. Paul Legislative Code 34. 11 , therefore the A�pellant is requesting a variance to con_inue to operate with the present number of baths. PROCEEDING5: Appellant needs a variance on the number of baths to serve 26 clients. As a rule t ere is never the full amount in the �. = homP at one time, some workin_ days or nights. Under the State `� Department of Corrections Lice sing, stating the number of baths , the home is in complaince and ouid serve 26 people. Zoning allows 22 beds, but M . Wiiliams was before the Council � on June 26, 1987 and received approval to increase occupancy to 26.
