RESOLVED, that upon the petiti n of the State of Minnesota,
per file no. 10-1987, that part o Aurora Street from Cedar
Street to Robert Street bounded b University Avenue, Robert
Street, Cedar Street and Central Ave ue, hereinafter described be
and the same is hereby vacated nd discontinued as public
property.
That the vacated area be descri ed as. follows:

1. That the vacation be subjec to all the terms and
conditions of Chapter 130 , odified March 1, 1981
of the St. Pau1 Legislative Code, as amended.
2. That the petitioner pay the City of Saint Paul a
$500.00 administrative fe for this vacation
which is due and payable w thin 60 days of the
publication date of this re olution.
3 . That a permanent sewer eas ment be retained on
behalf of the City of Saint Paul, Department of
Public Works, on, under , ver and across that
part of vacated Aurora Street which lies
northeasterly of the s uthwesterly line ,
extended northwesterly of L t 1, Block l, Central
Park subject to the followi g conditions: �,
a. No buildings, structure , or trees are permitted
within the easement rea nor any temporary
structure, material st rage, fixture or other
objects that will pro ibit normal access to
sewer facilities for ma ntenance purposes.

b. No change from the exi ting grade is permitted
without written permission from the Director of
the Department of Publi Works .
c. No change in surfacing ithin the easement area
is permitted without ritten permission from
the Director of the Dep rtment of Public Works .
d. That the petitioner her by agrees to indemnify,
defend and save harmless to the extent
permitted by law , the City of Saint Paul , its
officers, agents, empl yees, and servants from
all suits, actions or laims which shall arise
from any injuries o damages received or
sustained by any break in any service pipe , or
connection in said res rved easement, arising
out of or resulting from any action or
negligence of the pet ' tioner , its employees,
agents or business inv ' tees.
4 . That the petitioner shall ay all costs and expenses for
the abandonment of the se er within the vacated area
lying southwesterly of the southwesterly line, extended
northwesterly of Lot 1 Block 1 , Central Park .
Petitioner shall make app ication for abandonment of
this sewer with the Sewer ivision within 60 days of the
date of publication of this resolution.
5 . That a permanent Water Utility easement be retained on
behalf of the City of Saint Paul Board of Water
Commissioners on , ove , under and across the
northeasterly 250 feet of he northwesterly one-half of
vacated Aurora Street ubject to the following
restrictions :
a. No buildings, structu es, or trees are permitted
within the easement area , or any temporary
structure , material storage , fixture or other
objects that will prohibit normal access to water
facilities for maintena ce purposes .

petitioner , its employ es , agents or business
invitees .
6 . That a specific easement be retained over the
northeasterly 270 feet of the vacated area to protect
the interests of District E ergy St. Paul, Inc .
7. That a specific easemen be retained over the
northeasterly 270 feet f the vacated area to
protect the interests of Co tinental Cablevision St.
Paul , Inc .
8. That the petitioner here y agrees to indemnify,
defend and save harmle s to the extent
permitted by law, the City f Saint Paul, its
officers and employees , ag inst all suits , actions
or claims of any characte brought as a result of
injuries or damages recei ed or sustained by any
person, persons or prope ty on account of this
vacation including but n t limited to a claim
brought because of any act of omission, neglect or
misconduct of said petit ' oner or because of any
claims or liability arisi g from any violation of
any law or regulation mad in accordance with the
law whether by the petitioner or any of its agents
or employees.
