An Rdministrative Reso ution approving the
appeal of Paster Enter rises (Sibley Plaza) .
WHEREAS , on August 6, 198 the Zoning Committee of the
Planning Commission held a p lic hearing upon application
for a sign variance by appellant . Two variances were requested
at that �ime , one for a messa e center sign which would act
as a business sign and tY?e second for an increase in the permitted
height; and
WHEREAS , the Zoning Commi tee approve� the request for
-che message center sign but d nied the request for variance
for height; and
WHEREAS , a;�pellants have appealed to the City Council
from thai determination; now, the efore , be it
RESOLVED, that the Council f the Cit}'r of Saint Paul grants
the appeal o�' appellants and rants a variance for a message
center sign which would act a a business sign and grants a
variance for permii,ted heigh�, said variance being 40 feet
in height subject 'co the followin conditions :
(1 ) That the lower signs shown in the sign drawing as
"Richard' s Foods/Walareens" be el 'minated;
(2) That the sign shall e end no more than two feet over
�he property line on�o ^ity property;
(3) The applicant conform to standards in the proposed
ordinance regarding rnodes and d' splay and numbers of charac�ers
for electronic message borne sig ;
(4) That the electronic essages on the sign shall not

WHEREAS , on November 19 , 987 , the City Council of Saint
Paul , Minnesota , adopted Resol tion approving the appeal of
Paster Enterprises for two varia ces , one for a message center
sign and a second for the increas in the permitted height , which
has been designated as Council Fi e Number 87-1660; and
WHEREAS, subparagraph 6 ther of required a written Agreement
to be filed with the City Cle k within thirty days of the
adoption of this Resolution; and
WHEREAS, a copy of the Res letion and the requirement for
filing an Agreement was never urmished to Applicant or its
attorney, Gerald E. Frisch, of Ni'- v.a arr`d �Frisch, P. A. , and
WHEREAS, on Jun� 1 , �1988, said attorney for Applicant was
furnished with � copy of said xesol�t�io� 'and Applicant now
desires to comply with the� te�u�'s nd' conditions of subparagraph 6
thereof .

Dear Mr . Olson :
On June 1 , 1988, I was attemptin to locate a copy of the
Resolution adopted by the City Counc ' 1 on November 7 , 1987 , in
connection with the above-captioned m tter . This matter involves
a Resolution approving the appeal f Paster Enterprises for
installation of a message center sig at Sibley Plaza Shopping
Center .
My records indicated that I neve received a copy of the
Resolution . I then obtained a copy t ereof from your office ,
Subparagraph 6 of the Resolution required the applicant to file a
written Agreement within thirty da s of the adoption of the
Resolution , which would have been on r before December 17 , 1987 .
My client is extremely disappointed that we were not notified
that Subparagraph 6 of the Resolution required the written
Agreement to be filed as aforesaid .
Enclosed herewith please find written Agreement by Sibley Plaza ,
Inc . , owners of Sibley Plaza Shopping Center , that they will
comply with all of the terms and conditions of this Resolution .
I trust that you will discuss this matter with Jerry Sigal ,
Assistant County Attorney , to determine if this will comply with

OPPOSITION: None.
Dear Sir:
On August 6, 1987, the Zoning Committee of the Planning Commission held a
public hearing on an application for a sig variance. Two variances were
requested, one for the message center sign which would act as a business sign
and the second for an increase in the perm'tted height, 30' is allowed and 35'
was requested. The applicant testified. t the close of the public hearing,
the Committee voted 3 to 1 to approve the essage board variance but to deny
the height variance. Four conditions were added to the approved sign.
On August 14, 1987, the Planning Commissio upheld the Zoning Committee's
recommendation on a vote of 13 to 3.
This appeal is scheduled to be heard by th City Council on October 15, 1987.

WHEREAS, Paster Enterprises, file #10167, ha applied for a Sign Variance under the
provisions of Section 66.201(11) ; 66.202(4) ( ) , and 66.409 of the Saint Paul
Legislative Code, for the purpose of allowin the establishment of (1) an electronic
message center sign which is (2) 35' high on property located at Sibley Plaza, West
Seventh Street, legally described as (see at achment) ; and
WHEREAS, the Zoning Committee of the Plannin Commission on August 6, 1987, held a
public hearing at which all persons present ere given an opportunity to be heard
pursuant to said application in accordance w th the requirements of Section 64.300
of the Saint Paul Legislative Code; and '�'
WHEREAS, Saint Paul Planning Commission, bas d on the evidence presented to its
Zoning Committee at the public hearing as su stantially reflected in the minutes,
made the following findings of fact:
1. Th� applicant is proposing to remove the existing Sibley Plaza identification
sign and replace it with a new sign that includes an electronic message board.
Electronic message boards are currently rohibited outside the downtown area
except if they display public informatio such as time, temperature and the .
like. The applicant is also requesting height variance to permit placing the
sign 5 feet higher that the 30 feet perm tted.
2. The existing Sibley Plaza sign is about 8 feet wide and 16 feet high for
approximately 608 square feet of display area and is 18 feet from the ground.
The total height of the existing sign is approximately 33.5 feet above grade.
The proposed sign is 36 feet wide and 21 feet high for a gross surface display
area of 756 square feet and would be 35' high.

3. Total sign area for businesses which have frontage on more than one street in
the B-2 zone is two times the total of t lot frontage on the short side plus
one-half the lot frontage on the long si e. In this case, Sibley Plaza has
318.7 feet of frontage on Davern and 1138.76 front feet on Fort Road for a total
sign area of 1776.16 sq. feet permitted. According to the applicant, existing
store signs (10 existing and three pr_opo ed) now total 716 square feet, with
five vacant bays. The total proposed si n area for the shopping center will be
1472 square feet. Approximately 304 squ re feet of sign area would remain for
the vacant bays, about 60 square feet pe bay.
4. The existing sign projects approximately four feet over the public right of way.
The applicant has not shown exactly wher the new sign will be located, except
to say that it will be in the same place as the existing sign. If so, the new
sign will project eight feet over the pu lic right of way. The sign regulations
permit a projection of no more than four feet. The sign would have to be
located at least nine feet from the prop rty line to conform to this regulation.
A setback of the sign post of 13 feet wo ld keep the sign from pro�ecting over
the public right of way entirely.
5. The Planning Commission may approve vari nces of the sign regulations if they
make findings in the following areas:
a. Unique signs or unusual conditions p rtaining to the sign needs for a
specific building or Iot. . .
There appear to be no unusual condit'ons pertaining to the sign needs of the '
building or lot. The lot is level a this point, and the sign is of
sufficient size to be seen from the oadway. There are actually three
sections of signage proposed in this one sign: the shopping center name
sign, the message board, and identif'cation signs for two businesses in the
center. If one of these elements we e removed (possibly the business
signs) , a height variance would not e necessary. There are also crossbars
in the sign poles that could be used for additional signage.

b. Signs would not be contrary to the ge eral intent of this chapter, create a
hazard, or violate Minnesota State St tutes. . .
One of the intents of the chapter is oncern for the visual environment.
The multiple messages portrayed in th's sign would be contrary to this
intent by not providing simple, clear identification signage. If located
where the applicant has indicated, th proposed sign would pro�ect eight
feet over the public right of way, wh ch is contrary to the regulations of
the ordinance and which could create hazardous condition.
c. Wou1d not be objectionable to adjacen property owners. . .
The sign would not appear to be objec ionable to property owners to the
northeast or southwest.
d. Wou1d not adversely affect residentia property through excessive glare and
lighting. . .
The sign does not appear to adversely affect residential property located
across Ford Road.
e. The signs would be in keeping with th general character of the surrounding
area.
Except for the electronic message boa d, the signs are similar to others in
the general commercial area. -
f. The Commission may not grant a varian e that would permit signs within a
zoning district which is not otherwis permitted. . .

The Planning Commission has recently proved two variances permitting
electronic message signs, and the city is considering amendments to its sign
regulations that would permit electro ic message signs in certain
circumstances. The proposed regulatio s and the applicant's ability to meet
them are as follows:
i. Business signs in the B-2, B-3, B- , I-1, I-2, and I-3 districts.
Applicant is proposing a business sign in a B-2 district.
ii. Should be 660 feet from another e ectronic message sign on the same side
of the street.
� There are no other message signs n the area.
iii.Should be 75 lineal feet from a re identisl district and 50 radial feet
from a residential district.
An RM-2 district is located acros the street, 40 feet away. (The

The applicant was present. There was no pposition present at the meeting.
� Ms. Datsko showed slides of the site and eviewed the staff report with a
recommendation for approval of the varian e to allow the electronic message
center sign but denial of the height vari nce.
Gerald Frisch, 2350 West Seventh Street� ttorney represen�ing Paster
Enterprises, stated that the Highland Are Community Council approves the
proppsal. He distributed copies of a let er from Rick Bowie� owner of Sibley
Manor Apartments, approving the electroni message sign. He stated that his
client is attempting to have a uniform si program in a single sign; and that
they prefer the four foot setback to the 3' setback because the latter would
adversely affect the flow of traffic.
Mr. Christenson asked if the Highland Are Community Council considered the
electronic aspect of the proposed sign.
Edward Paster, 2227 University Avenue, st ted that a complete presentation was
made to the community council and they re ommended approval.
Hearing no further testimony, Ms. Morton losed the public portion of the � ,`

G. STAFF ANALYSIS:
The applicant could reduce the size and he'ght of their proposed sign without
hardship. This would leave additional sig area for their business tenants as
the center 'is leased up. Removal of the b ttom row of signs would accomplish
this. Location of the sign 13 feet from t e public right of way would keep the
sign from projecting into the public right of way and competing with traffic
signs in the area. The proposed electroni message sign does not comply with
the proposed ordinance amendments in that t is within 50 feet of a residential
district. If the sign were moved back fro the property line 13 feet, it would
be further than 50 feet from the residenti 1 district.
H. STAFF RECOMMENDATION:
Based on findings 1 through 5 and the anal sis, staff recommends denial of the
height variance and approval of the electr nic message board subject to the
following conditions:
1. The lower row of signs as shown on the ign drawing be eliminated;
2. The sign be set back 13 feet from the p operty line;

regarding the proposed ele tronic message sign at
Sibley Plaza Shopping Cen er. We are very pleased
with the upgrading and exp nsion of the Center and
especially welcome t e addition of a new
supermarket . Our Tena ts have continually
expressed the need for a supermarket at this
location.
The installation of a ne electronic message sign
is the finishing touch to he existing remodelling
underway . As the ow er of S3bley Manor
' Aoartments, I would like t point out that we have
no objection to the inst llation of an electronic
message sign. Furtherinore we do not feel tizat we
would be adversely afFe ted in any way by the
glare of the illuminate signs or electronic
message board.
