An ordinance amending Chapter 60 of the Saint Paul Legislative Code
pertaining to zoning for the City of Saint Paul and the zoning maps
thereof.
WHEREAS, Pursuant to Minnesota Statutes, § 462.357 and § 64.400 of the
Legislative Code, S. Janet Smith duly petitioned to rezone 13xx Randolph
Avenue, located on the south side between Syndicate and Hamline, from R-4 to
B-2 for the purpose of constructing a garage for accessary storage for the
small business located at 1310 Randoph Avenue; the petition having been
certified by the Planning Division on June 26, 1987 as having been consented
to by at least two-thirds of the owners of the area of the property to be
rezoned, and further having been consented to by at least 67% of the owners of
the property situated within 100 feet of the total contiguous property within
one year preceding the date of the petition; and
WHEREAS, The Zoning Comnittee on July 16, 1987 conducted a public hearing for
the purpose of considering the rezoning petition, and pursuant to Section
107.03 of the Administrative Code, submitted its recommendation to the
Planning Commission that the petition be denied; and
WHEREAS, The Planning Comnission considered the rezoning petition at its --
meeting held on August 14, 1987 and recommended that the City Council deny the
petition; and
WHEREAS, Notice of a public hearing before the City Council on the said
rezoning petition was duly published in the official newspaper of the City on
August 29, 1987 and notices were duly mailed to each owner of affected
property and property situated wholly or partly within 350 feet of the
property sought to be rezoned; and

WHEREAS, A public hearing before the City Council , having been conducted on
September 17, 1987 where all interested persons were heard, and the Council
having conside�ed all the facts and recommendations concerning the petition;
and
WHEREAS, the City Council heard testimony from the staff and the petitioner
that the rezoning is supportd by the Land Use component of the Comprehensive
Plan policy 4.2-1 which supports a diverse commercial activity base by
encouraging small business and Policy 4.2-4 which states that the City will
monitor commercial trends and adjust its land use policies in accordance with
changes affecting the character of commercial areas and adjacent
neighborhoods; now, therefore
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1.
That the zoning map of the City of Saint Paul , Sheet No. 26, as
incorporated by reference in Section 60.301 of the Saint Paul
Legislative Code, as amended, is hereby further amended as follows:
That property located at 13xx Randolph Avenue, being more particularly
described as Lot 7, Block 3, Davern's Rearrangement of Blocks 4,5,6 of
Lexington Park Plat No.10, be and is hereby rezoned from R-4 to B-2.
Section 2.
This ordinance shall take effect and be in force thirty (30) days from
and after its passage, approval and publication.

Dear Sir:
On July 16, 1987 the Zoning Committee of the Planning Commission held a public
hearing on this rezoning. The petitioner testified. At the close of the
public hearing, the Committee voted 2 to 1 to deny the rezoning because it is
inconsistent with the city's comprehensive plan.
On August 14, the Planning Commission upheld the Zoning Committee's
recommendation on a unanimous voice vote.
This rezoning is scheduled to be heard by the City Council on September 17.
Please notify me by September 16 if any member of the City Council wishes to
have slides of the site presented at the public hearing.

WHEREAS, S. Janet Smith, file #10151, has petitioned to rezone 13xx Randolph Avenue
(South side between Syndicate and Hamline) from R-4 to B-2 for the purpose of
constructing a garage for accessory storage for 1310 Randolph Avenue; and
WHEREAS, the Zoning Committee of the Planning Commission on July 16, 1987, held a
public hearing at which all persons present were given an opportunity to be heard
pursuant to said application in accordance with the requirements of Section 64.400
of the Saint Paul Legislative Code; and
WHEREAS, Saint Paul Planning Commission, based on the evidence presented to its
Zoning Committee at the public hearing as substantially reflected in the minutes,
made the following findings of fact: �- ,
1. Petitioner is the owner of Gopher Sign Company, the business adjoining the lot
to the west. The sign company wishes to construct a 2-car garage to be used as
accessory storage for materials needed for the sign business.
2. The Land Use component of St. Paul's Comprehensive Plan classifies the Randolph
and Hamline intersection as a neighborhood commercial center. Land Use Plan
policy 4.2-3 discourages expansion of commercially zoned land in isolated
neighborhood commercial centers.
3. The intent of the B-2 Community Business District is to serve the needs of a
consumer population larger than that served by the "Local Business District" and
is generally characterized by a cluster of establishments generating large
volumes of vehicular and pedestrian traffic. Other uses permitted in the B-2
district besides retail sales includes private clubs, fraternal organizations,
lodge halls; restaurants; theaters, assembly halls, concert halls; business
schools; physical culture and health clubs; mail order houses; and food catering
businesses. .
4. The Schedule of Regulations for the B-2 district requires that all buildings be
set back at least 10 feet from adjacent residential property.

The applicant was present. .No opposition was present at the hearing. .
Ms. James showed slides of the site and reviewed the staff report with a
recommendation for approval. District 15 supports the rezoning. Two letters
were received in opposition.
Donna Stee, 88 East Sixth, Cottage Grove, representing the applicant, stated
that Gopher Sign Company needs the garage for storage of a snow blower� a lawn
mower, a pick up truck and miscellaneous equipment needed for the business.
She stated that Mr. Smith has looked into a prefabricated type of stora�e _�� �
building so that if the property is sold, the building can be dismantled.
Mr. Neid asked if the applicant intends to expand the business. Ms. Stee
responded no.
Hearing no further testimony, Mr. Christenson closed the public portion of the
meeting.
Ms. Zieman asked if it is possible to make the storage unit accessory to the
main building without B-2 or I-1 rezoning. Ms. James stated that an accessory
structure is prohibited without a principal structure.

Mr. Neid made a motion to approve but with the condition of a site plan review
by staff. Ms. Zieman seconded the motion. Mr. Christenson stated his
opposition to the rezoning. Ms. Zieman stated her opposition to the extension .
of B-2 zoning as possibly setting a precedent. The motion failed on a vote of
1-2 (Zieman and Christenson) . .

2. The Land Use component of St. Paul's Comprehensive Plan classifies the Randolph
and Hamline intersection as a neighborhood commercial center. Land Use Plan
policy 4.2-1 supports a diverse commercial activity base by continuing efforts
to encourage small business. Policy 4.2-4 states that the city will continue to
monitor commercial trends and ad�ust its land use policies in accordance with
changes affecting the character of commercial areas and ad�acent neighborhoods.
3. The District 15 plan recommends that "small neighborhood retailers should
develop in clusters around existing businesses in order to preserve the
residential/commercial balance of the neighborhood." Opening up of new
commercial or business locations in present residential areas would thus be
discouraged and new strip developments eliminated.
4. The intent of the B-2 Community Business District is to serve the needs of a
consumer population larger than that served by the "Local Business District" and

H. STAFF ANALYSIS: Expansion of business uses into residential areas is not
supported in the Comprehensive Plan as a general rule. In this instance,
however, it seems to be appropriate. The use will be accessory to the existing
business to the west. The zoning code prohibits any future development from
coming closer to the east property line than ten feet. The area seems to be
experiencing no ma�or land use conflicts with the existing B-2 uses.
I. STAFF RECOMMENDATION:
Based on findings 1 - 5 and the staff analysis, staff recommends approval of the
rezoning from R-4 to B-2.

Dear Pat:
I recently received notice of a public hearing for the purpose
of rezoning a property in the 1300 block of Randolph Avenue.
The applicant is S. Janet Smith.
I will not be able to attend the hearing but I want to voice my
objection to a rezoning in that area . It appears to me from
the notice that the only purpose for the rezoning is for the
constuction of a two car garage. I was not aware that R 4
- zoning prohibited a two car garage but, in any case, a rezoning
to B 2 would be detrimental to the neighborhood.
It is my presumption that once the zoning is changed to B 2 the
property can be. used for any community business and I object to
allowance of any additional business this close to my property.
It seems to me that what Ms. Smith really wants is a varience
from the restrictions of the R 4 zoning since the only purpose �
for requesting the rezoning is to construct a 2 car garage. I `
would be in favor of such a varience.
