There may be testimony to this effect at the hearing. Depending upon what testimony is presented and any responses submitted by you, the City Council may consider the possibility of placing conditions upon your business licenses, for the necessity of taking future adverse actions on your license. If the City Council should consider the possible necessity of taking further adverse action on your license, the City Council shall notify you in writing that such adverse action may be taken. Written notice of such a hearing will be provided to you, which will state the date, time, and place of said hearing, and the notice shall further state the issues involved or the grounds upon which the adverse action may be sought or based. Paul , MN 55102 Dear Mr. Carchedi : We have had several complaints regarding the Burger King Restaurant at 1959 Ford Parkway Currently, the drive-thru operation is allowed to be open until 3 : 00 A.M. I believe it is time for the City Council to consider whether those hours are canducive to maintaining a healthy and viable residential neighborhood across the alley from this particular commercial strip . Further, it would appear that these hours violate the intent and spirit of the Noise Ordinance (Chapter 293) as was adopted by the City Council this past spring . Therefore, I would request that , at such time as the license for Bur•ger King is up for renewal , the full City Council review the license . Thank you for your attention to this matter . July 1.5th with the St. Paul City Counci� Members. c. July 20th with the neighbors and Councilman Drew. d. August lOth with the community and Ken Jefferson. e. August 13th with the Planning Council. f. August 26th with the City Council. 3. The following issues were brought up at one or more o€ the meetings (these ase listec� in order of priority) : a. These are the actions we have taken to address these issues and the dates which they were imp�emented: � �- � � a. SYnce before January, 1987 hired security fro� 8:00 p.m. until 12:00 a.m. Fridays and Saturdays. b. June 24 - all deliveries were rescheduled to arrive after . 7:00 a.m. and before 10:00 p.m. c. June 25 - The sound emitted from our drive through speaker was adjusted to a lo�rer volume. On July 15 at 11:00 p.m. , I personally listened from each adjoining neighbor's property line to be assured the volume was not being emitted too loudly. It was not. d. June 24 - Began surveying a one block area of our restaurant to pick up trash two times a week. e. June 30 - Checked into a smoke stack disseminator and found out the cost and effectiveness is very poor. f. July 3 - switched hours of security on Fridays and Saturdays from 9:00 p.m. - 12 :00 a.m. to 11:00 p.m. to 3:00 a.m. and specifically assigned them to lot patrol. The lot patrol included: 1. Staying in the parking lot a minimum of 90� of the time. 2. Allowing no customers to congregate. 3. Offer any noise makers the opportunity to leave or be cited in violation on the noise ordinance. 4. Above all else their #1 goals was to keep it quiet! g. July 10 - added a lip to our dumpster slab to prevent water and debris from spilling into the alley during cleaning. � �r-������ St. Paul Council Members September 22, 1987 Page Three h. July 16 - added security on Thursday night in � addition to Friday and Saturday. � i. July 28 - Added security on Tuesday and Wednesday in addition to Thuraday throuqh Saturday. Also added one additional security officer on Friday and Saturday niqhts. i j . August 1 - Reduced our hours to a 1:30 a.m. clos- ing every night of the week. Our previous hours were a 2:00 a.m. closing Sunday through Thursday and a 3:00 a.m. closing on Fridays and Saturdays. k. Auqust 26 - Added two areas not within our one block area litter pick up to or two time per week trash pick up (the request came at the Auqust 26th City Council me�'t�ng) . l. September 10 - Added a system of removable poles and cables t our parking lot which would enable us to cable off our lot in such a way that all customer entering our lot between 12:00 a.m. , when our dining room closes, and 1: 30 a.m. , when the entire restaurant closes, would be restricted to our drive through lane only. Additionally these same cables will be used to cable off both our entrance and our exit at closing time. This would prohibit any use of our lot after business hours. 5. These are the facts on how our actions have effected the issues: a. The amount of calls received by the St. Paul Pol- ice Dept. from neighbors concerning these issues have been reduced by 50� for June, So�� for July, $7�afor August and b�r �o�ofor September (through 9/18) over the same period in 1986. b. There have been no reports of Burger King custo- mers trespassing or climbinq and partying on the hill behind our restaurant. The security people are closely patrolling this area. c. There have been no reports of too much noise from our drive through speaker since we reduced the volume. � ���7-i��� St. Paul Council Members September 22, 1987 Page Four d. There was one incident where our trash hauler arrived before 7:04 a.m. We reviewed the policy for pick up with him and have had no problem since. e. The lip we added to our dumpBter slab to prevent debris from qofng down the alley has worked well with the exception of one incident. A crerir mea- ber was not instructed properly on how to clean the alab and in his attempt to do the job allowed some water to escape into the alley. The crew member has been retrained properly. f. The congregatinq of kids in our lot has been re- - duced to almost never. These kids have gotten the messaqe that they will not be allowed to hanq out, so they don't even attempt it. g. Since we have begun picking up litter in a one block radius of our restaurant the amount of trash we collect on a normal pick up has reduced somewhat even though there did not seem to be a big problem with trash in that area form the start. h. There does not seem to be a cost effective, way to reduce the amount of smoke emitted from our reat- aurant. I have been assured by our Development Department that our smoke emittance is within , code. i. Rats were an issue brought up at one of the meet- ings. It was brought up because of one isolated incident which occurred approximately five years ago (I do not know the details) . Let me assure you that we do not have a rat problem, we are inspected regularly by the health department. We hire a pest control company to inspect our entire property and building twice a month to insure no pest problems present themselves. It is our hope that the facts will show: 1. A genuine concern by Burger King Corporation for the issues presented by the community. 2. These are the four issues which were brought to our attention by the representative of the community: . l. Noise 2 . Litter 3. Rats 4. Smoke I will briefly review the actions we have taken to eliminate the problems as I presented at the meeting. I will begin with noise: 1. We have lowered the volume of emitted sounds from our drive thru menu board. This lowered volume is maintained for all day parts not just after 11: 00 �.m. 2. We have cut our hours back from 2:00 a.m. Sunday - Thursday and 3 : 00 a.m. Friday & Saturday to 1:30 a.m. every night. 3 . We have added off duty police as security to strictly patrol the parking lot. We have one security person on duty Tuesday - Thursday from 9:30 p.m. to 1:30 a.m. On Fridays and Saturdays we have two security people on duty, both strictly patrolling the lot from 9:30 p.m. to 1:30 a.m. These security personnel have the authority and the direction from Burger King to issue citations to any persons violating the noi�e oruinance. 4. We are checking into a program in which the security persons, at the request of Burger King, could issue a citation to a "problem person�� which would ban that person from our premise for 30 or 60 days. There are . a few problems with this program which need to be filtered out before a rollout is possible. We are receiving estimates for installation of a system of poles and cables which would allow us to eliminate all traffic through our parking lot exc�pt that which would use our drive thru. These cables and poles would be used from 12:00 a.m. when our dining room closes until 1:30 a.m. These same cables and poles could then be used to cable off our entrance and exit to eliminate all traffic on our lot after our close of business. How we are addressing litter: l. We are, and have been sending out a Burger Kinq ` employee to collect trash two times a week in a one block radius of our restaurant. 2. These employees are instructed to pick up all trash in that area, not to only pick up Burger King trash. How we are addressing rats: 1. First of all, this issue was brought up because of one isolated problem which I believe occurred some three or more ears ago. 2. Secondly, other than that one incident we have had no problems with rodents. Nor do we have any problems with them now. 3. Thirdly, we have a pest company which services our restaurant once every two weeks. They thoroughly review our entire premise and immediately eliminate any possible problems before they have an opportunity to grow into a real problem. How we are addressing smoke: 1. I �iave checked with our Construction Department on the cost and effectiveness of a smoke stack disseminator. This device is very expensive and it's effectiveness at other Burger King locations proves this to be a poor alternative. 2 . We will look for alternatives to help eliminate some smoke but at this time do not have a cost effective • method to substantially reduce our smoke. . Page Three In conclusion I would like to follow up these actions with the reassurance of Burger King's commitment to work with the community toward making Highland Park a better place to live and work. We have spent much time, money and effort into these actions and i� is our belief that these eff�arts have been very effective in the reduction of the issues as presented by the community. It is Burger King�s recommendation, since there has been no substantiated violation of any law or ordinance by Buraer Kincr, that the City grant us a renewal for the full term of the license with no additional restrictions. This, of course, is along with Burger King's assurance that we will continue to actively pursue all issues addressed to us by the City and the community. We, the ,neighbors who live near the Burger King Restaurant at 1959 Ford Parkway in St. Paul, do hereby petition the St. Paul City Council regarding the •renewal of the license for the Burger King Restaurant at that location. We request: 1. That the City Council restrict the Drive Thru section of the restaurant to those hours that conform to the noise ordinance presently used in the City of St. Paul. Those hours restrict loud noises generated by any means between 10:30 p.m. and 7 a.m. Such noises must not travel past the lot line so as to disturb the neighboring property. At the present time and for many years, it has been difficult for neighbors of the Burger King Restaurant to enjoy a decent night's sleep. A police record will reflect that 121 calls to the police , were made froM January 1986 to August 1987 about the restaurant. 2. That the Burger King Restaurant take such steps as may be necessar�� to curtail the use of their parking lot. The goal would be to alleviate the "attractive nuisance" �that this parking lot has become since the Drive Thru window was initiated in 1976. (Please see the attached St. Paul police list mentioned earlier. From Jan. 25, 1986, through Aug. 4 , 1987, there were 121 calls made complaining about the restaurant and 95 percent of the calls were noise related. ) A neighbor who lives directly behind the restaurant believes he may have made about 500 calls to the police for noise within the past five years, many tir.tes several calls on the same night. Others have made many calls as well, since they are unable to sleep. These calls represent a major drain on the police of the city--not to mention neighbors ' sleep. 3. That the Burger King Restaurant be enjoined to continue their recently adopted policy of sanitation at the site and thesr pickup of refuse in their general area. � 4 . These are the actions we have taken to address these issues and the dates which they were implenented: a. Since before January, 1987 hired security froa 8:D0 p.�. until 12:00 a.n. Fridays and Saturdays. b. June 24 - ali deliveries were rescheduled to arrive after 7:00 a.m. and before 10:00 •�.m. c. June 25 = The sound emitted from our drive through speaker was adjusted to a low�r volume. On July 15 at 11:00 p.m. , I personally listened ' from each adioining neighbor's property line to be assured the volume was not being emitted too loudly. It was not. d. June 24 - Began surveying a one block area of our restaurant to pick up trash two times a week. e. June 30 - Checked into a smoke stack disseminator and found out the cost and effectiveness is very poor. f. July 3 - switched hours of security on Fridays and Saturdays from 9:00 p.m. - 12 : 00 a.m. to 11:00 p.m. to 3:00 a.m. and specifically assigned them to lot patrol. The lot patrol included: 1. Staying in the parking lot a minimum of 90� of the time. 2. Allowinq no customers to congregate. 3. Offer any noise makers the opportunity to leave or be cited in violation on the noise ordinance. 4. Above all else their #1 goals was to keep it et g. The amount of calls received by the St. Paul Pol- ice Dept. from neighbors concerning these issues have been reduced by 50$ for June, �yo for July, 8'�'i�� for August and by ���m for Sep�emhe� (through 9/18) over the same period in 1986. b. Since we have begun gicking up litter in a one block radius of our restaurant �he amount of trash we collect on a norma� pick ug has reduced somewhat even though there did not see� to be a big problem with trash in that area form the start. h. There does not seem to be a cost ef€ective �ray to reduce the amount of smoke emitted from our rest- aurant. I have been assured by our Development Department that our smoke emittance is within code. � i. Rats were an issue brought up at one of the meet- inqs. It was brought up because of one isolated incident which occurred approximately five years ago (I do not know the details) . Let me assure you that we do not have a rat problem, we are inspected regularly by the health department. We hire a pest control company to inspect our entire property and building twice a month to insure no pest problems present themselves. It is our hope that the facts wil.l show: l. A genuine concern by Burger Kfng Corporation for the issues presented by the community. 2.
