The meeting of the Board of Appeals & Review was called to order
by Chairman Ron Glassman, at 1 :40 p.m. September 9, 1987. Mr
Glassman welcomed the appeilant and explained the procedures,
stating that what the Board does is recommends action to the City
Council .
Minutes of the August 11 , 1987 meeting were approved with the
following corrections : Page 3 , paragraph 4, line 8, after the
word "barrier" and before the word " inside" insert the words
"near the" and after the word "inside" and before the word
"the" insert "surface of" , then on Line 9 strike the word "on" and
before the word "the" change the word to "at" . Page 4 at the end
of the first paragraph add ( "Oak Ridqe National Labarator studv
done in Portland Oreaon ") . Page 5, paragraph 7, at the end of
the sentence after the word " insulation" add "for each case. "

�: Chairman Glassman referred to Glenn Gausman's letter pertaining
- to the Council ammending the policy of enforcing the provisions
of the Residential Energy Code with respect to requiring existing
walls above and betow grade be insulated. Mr. Glassman asked for
a motion to forward this letter to the Council . Mr. Schultz
suggested that the members be allowed to review the letter. This
letter will be discussed at the October meeting. At that time the
letter will be sent to the Councilmembers for review.

APPEARANCE : Marty Evenson 8 Milton A. Evenson
SUBJECT: Appeliant is requesting a waiver from the requirement of
vacant building fees , because of financial hardship.
PROCEEDINGS: Mr. Evenson stated he is retired and living on a
limited pension and cannot afford the fees. Mr. Evenson would
rather put the money toward something more productive.
Jim Prill , from Vacant Bldgs. stated the house was condemned as
� unfit by the Health Dept. in 1964, and it has been vacant for 23 �
years. If the appeilant could present some kind of a plan, then
maybe the fees could be waived. The fees were started a few
months ago, fee and fines are $110.00. The fee is only part of a
requirement in the registration ordinance. The other part of the
of the ordinance is to have an approved timetable
If no timetable the owner could be tagged.
Marty Evenson, the appellant's son stated that this property was
before the board once before, regarding vacant building fees. The
Board ruled in favor of the appellant. Marty Evenson stated that
only because of the recent change in legislation that took place,
therefore, this changed the activity relative to the house. This
house was an extension to the homestead. The building is a
couple vacant lots away from the present homestead.
Mr. Shultz asked Mr. Evenson when he acquired the building? Mr.
Evenson stated that he acquired the building in 1965.
Mr. Tilton asked Mr. Evenson why nothing has been done to the
building?
Mr. Evenson stated because of high crime rate and the trouble
with tenants, he does not want the hassle.
Mr. Evenson stated that the building has besn used for storage
� and antiques. The buitding has been burglarized. At one time Mr.
��" Evenson had considered making this his residence.
Mr. Schultz asked Mr. Evenson what the immediate plans were for

� \ the building? The idea behind vacant building fees is to
try and discourage people from keeping vacant property. If there
were tangible p)ans then it would be possible to waive the fees.
BOARD ACTION: Motion made by Bill Tilton to deny the request for
wavier of the vacant building fees. Seconded by David Schultz.

SUBJECT: Appellant is requesting a waiver from the requirment of
vacant building fees, because of financiai har-dship, .
PROCEEDINGS: Mr. Chada acquired the property a year ago and has
done some repairs. A building permit was issued and then the
inspector frorn the area revoked the permit for the reason that no
work had been done on the place in six months.
Mr. Chada stated that he has been working with the city to try
and acquire a loan to fix the place. Mr. Chada has been in touch
with Curt Miller, from the rehab office, still trying to get a

Fees �were imposed on the building July 1 , 1987, amount of fees
and fines are $120. 00.
The reason Mr. Chada has a probiem getting a loan is because of
the irregular employment.
Mr. Glassman suggested that Mr. Chada bring in a partner and then
be able to get a loan to complete the work.
BOARD ACTION: Motion made by Bili Tilton to deny the request for
waiver of vacant building fees, with the stipulation that, if the
appellant does qualify for a loan and takes out a building permit
by October lst, 1987 then the vacant building fees and fines will
be waived. Seconded by Rosie Bostrom.

PROCEEDINGS: The property was purchased 3 months on a contract
for deed from the Veterans Administration. Mr. Gomez is in the
process of getting a loan from the City of St. Paul . Western
State Bank will be appraising the property in a week. Mr. Gomez
would like an extension of 90 days to complete the work.
BOARD ACTION: Motion made by Bitl Tilton to grant an extension of
time for 90 days on Item 3 , screen doors; Item 5, defective hand
rails; Item 6, front entry door; Item 7, handles on front door
loose; Item 8, water damage in diningroom ceiling; Item 9,

Energy Audit, letter dated July 2. 1987, because of financial
hardship.
PROCEEDINGS: The aApellant is requesting variance on the
crawlspace and insulation of outside foundation because Mr.
Schroetter could not get any bids on these two items. After much
discussion Mr. Glassman made the suggestion that Mr. Schroetter
return in one month with definite bids.
BOARD ACTION: Motion was made by Dave Schultz to allow a one
month extension for Mr. Schroetter to return to the Board with
some definite bids pertaining to crawlspace and insulation of
outside foundation. Seconded by Rosie Bostrom. MOTION CARRIED

20 minute fire-rated doors with self closures. remove
combustibles materials in basement corridors; UPGRADE WORKSHOP:
first floor of 330, provide 2 hour separation between corridor
and adjacent spaces, provide 1 hour fire rated ceiling, provide
1 hour fire rated and la�eled door and frame to corridor. UPGRADE
WORKSHOP: third floor of 228, provide 1 hour fire rated
separation between corridor and adjoining spaces, provide 1 hour
fire rated and labeled door and frame to corridor, provide 1 hour
enclosures of furnace and hot water heater on first floor of 328,
provide doors with 20 minute fire rating and with self-closing
and self latching devices, provide approved venting of furnace
and hot water heater, provide an approved alarm system.
This case was withdrawn as the Appellant and Department of Fire
and Safety have been working together, and were able to resolve
all the code violations.

SUBJECT: Appellant is req�esting a variance pertaining to escape
window in bedrooms, as per letter dated July 1 , 1987.
PROCEEDINGS: Mr. Glaser stated he had instalted new windows into
existing frames, making the window two inches short on the 24
inch height. The new windows are glidder windows, which are
completely removable. Sitl height is ok.
Sue Toskey, from the Department of Fire & Safety stated that
these windows were suitable to live with, but Fire Prevention
could not grant a variance.
BOARD ACTION: Motion made by Rosie Bostrom to grant a variance on
the size of the upper two bedroom windows. Seconded by Glenn
Gausman. MOTION CARRIED UNANIMOUSLY.

apartment, because of the high cost factor.
,�Y����, PROCEEDINGS:. The appellant has not been able to get a person to
�' come to her house. to
give her bids on the stairway that is
requested to be installed. The stairway from the third floor
stops at the top of the roof on the second floor. Ms. Dixon would
like to be allowed to have a ladder attached to the roof that
could be used in case of a fire. Ms. Dixon feels that if steps
were installed to the ground, it could be dangerous and aiso
costly.
Ms. Dixon is appealing the requirement of having to install an
alarm system.
Ms. Toskey, from Fire 8 Safety Div. advised Ms. Dixon that the
buiiding has less than 10 units and does not need an alarm
system. Ms. Toskey advised Ms. Dixon that what the building
needs is a electrical smoke detector system at the top of the
�hird floor stairwell , this interconnected to one in the
basement.
BOARD ACTION: Motion made by David Schultz that an extension of
time for 90 days be granted to install , in lieu of a fixed
staircase, that a secured }adder attached at one end be installed
on the roof, therefore allowing access to ground floor in case of
fire. Also included in the motion an extension to time for 90
days to install a Electrical Smoke Detector at the top stairwell ,
interconected to one in the basement. Seconded by Rosie Bostrom.
