WHEREAS, based upon the records in the Ramsey County Recorde�'s Office and information

Chaptex 45 of the Saint Paul L,egislative Code an order identified as an"Oxder to Abate Nuisance
Building(s)" dated March 3, 1999; and
WHEREAS, this order informed the then known interested or responsible parties that the
structure located on the Subject Properiy is a nuisance building(s) pursuant to Chapter 45; and
WI�REAS, this arder informed the interested or responsible parties that they must repair or
demolish the structure located on the Subject Properry by Apri15, 1999; and
WHEREAS, the enforcement officer has posted a placazd on the Subject Property declazing this
building(s) to constitute a nuisance condition; subject to demolition; and
WI�IEREAS, this nuisance condition has not been corrected and Division of Code Enforcement
requested that the City Clerk schedule public hearings befoxe the Legislative Hearing Officer of the City
Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance with
the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and purpose of
the public hearings; and

2 Council on Tuesday, June 15, 1999 to heas testimony and evidence, and after receiving testimony and

and the testimony and evidence including the action taken by the Legislative Aearing Officer was
considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and Order
concerning the Subject Property at 503 Belvidere Street East:

That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
That the costs of demolition and removal of this building(s) is estimated to exceed three
thousand dollars ($3,000.00).
That there now exists and has existed multiple Housing or Building code violarions at the
Subject Property.
That an Order to Abate Nuisance Building(s) was sent to the then known responsible
parties to correct the deficiencies or to demolish and remove the building(s).
That the deficiencies causing this nuisance condition have not been corrected.
That Division of Code Enforcement has posted a placard on the Subject Property which
declazes it to be a nuisance condition subject to demolition.
That this building has been routinely monitored by the Citizen Service Offices, Division
of Code Enforcement, Vacant/Nuisance Buildings.
8. That the known interested parties and owners are as previously stated in this resolution
and that the notification requirements of Chapter 45 have been fulfilled.
ORDER
The Saint Paul City Council hereby makes the following order:
The above refezenced interested or responsible parties shall make the Subject Property safe and
not detrimental to the public peace, health, safety and welfare and remove its blighting influence
on the community by rehabilitating this sriucture and cortecting a11 deficiencies as prescribed in
the above referenced Order to Abate Nuisance Building(s) in accardance with all applicable
codes and ordinances, or in the alternative by demolishing and removing the structure in
accordance with a11 applicable codes and ordivauces. The rehabilitation or demolition and
removal of the shucture must be completed within fifteen (1 S) days after the date of the Council
Hearing.

2. If the above corrective action is not completed within this period of time the Citizen Service
Office, Division of Code Enforcement is hereby authorized to take whatever steps aze necessary
to demolish and remove this structure, fill the site and chazge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative Code.
3. In the event the building is to be demolished and removed by the City of Saint Paul, all personal
property or fixtutes of any kind which interfere with the demolition and removal shall be
removed from the property by the responsible parties by the end of this time period. If all
personal property is not removed, it shall be considered to be abandoned and the City of Saint
Pau1 shall remove and dispose of such property as provided by law.
4. It is fiu•ther ordered, that a copy of this resolution be mailed to the owners and interested parties
in accordance with Chapter 45 ofthe Saint Paul Legislative Code.

oriierin� the responsible parties to either repair, or demolish and remove this building in a timely
manner, and failing that, authorize the Division of Code Enforcement to proceed to demolition
and removal, and to assess the costs incurred against the real estate as a special assessment to be

Patricia Whitney, representing Keith Pederson, appeazed and stated Mr. Pederson is not the fee
owner of the property. He owns the mortgage. The actual fee owner is Richard Potvin. This
property is being foreclosed by Mr. Pederson. They have been trying to work with the inspectors,
and maintain the property to the extent they aze allowed. The last address Ms. Whitney has for
Mr. Potvin is 1606 Reaney Avenue, but he does not live there anymore. She requested Mr.
Pederson's nazne be removed as the owner/taxpayer.
Guy Willits reported notice was sent to Mr. Potvin at 1606 Reaney Avenue. The mail has not
been returned, so it is believed he is receiving it.
Roxanne Flink reported Keith Pederson is listed as the owner in the Ramsey County Records.
By law, Real Estate has to notify the person on the tas records. However, an additional notice
can be sent to Mr. Potvin.
Chuck Votel explained Code Enforcement will make a notation in their file that Mr. Potvin is
responsible for the property. It is not a problem to make sure both parties are notified.
Gerry Strathman recommended approval of the assessment.
448 Ashland Avenue (J9902B)
Charles 7ackson, owner, appeared and was concerned about three things: 1) he was not notified
that the property would be boarded up, 2) it was not boarded well, 3) there were still holes on the
outside to be taken care of. Three pieces of plywood were installed and the workers were there
for only one hour.
(Mr. Jackson presented photographs to Gerry Strathman.)
Chuck Votel reported seven boazds are cited on the bill. Unless a board was installed behind
another one, he does not see seven boards in the photographs. Mr. Strathman asked how many
boazds it looks like. Mr. Jackson and Mr. Votel agreed that it looks like three.

Mr. Votel explained: Code Enforcement authorized Fire Department captains to call the boazding
contractor to board and secure buildings. In this case, a fire was in the attic and the contractor
chazged a$200 trip chazge, $50 per opening/boazd. The total chazge is $550.
Gerry Strathman recommended reducing the assessment as follows: the trip chazge of $200 will
remain the same, the administrafive fee of $40 will remain the same, the cost of the boazds will
be reduced from $350 to $150, which brings the assessment to a total of $390.

Guy Willits reported he spoke to the owner about this case. Mr. Willits is surprised the owner is
not here because he was adamant about this issue. The owner thinks the assessment is high. He
received a few notices to conect the problem.
(A videotape was shown, in which wood pallets, trash bags, and other refuse was removed.)
Ceiry Strathman recommended approval of the assessment citing the property was cleaned up
and the owner was notified.
Resolution ordering the owner to remove or repair the property at 503 Belvidere Street
East. If the owner fails to comply with the resolution, Code Enforcement is ordered to
remove the building.
Chuck Votel reported the current property owners aze James and Florence Jorgensen; they have
not discussed their intentions with Code Enforcement. HiTD (Housing and Urban Development)
is involved as an underlying mortgage insurer. The City has issued three summary abatement
nofices to abate nuisance violations and secure the building. Registration fees and real estate
t�es are paid. The esfimated market value is $33,300; estimated cost to repair, $30,000.
Shapiro and Nordmeyer aze the attorneys for mortgage foreclosure. People involved have been
advised of the hearing today.
Gerry Strathman recommended approval of the resolution.
The meeting was adjourned at 1021 a.m.
The meeting was convened again at 10:28 am.

Jeffrey DeLisle, owner, appeazed and stated the windows were broken, and the City boarded up
the building. Mr. DeLisle was curious as to what happened.
Guy Willits reported this was a break in. The police did not want to leave the scene without the
building being secured so the emergency boarding company was called. A large picture window
was boarded.

Mr. DeLisle stated his phone is posted on the building entrance, but he did not receive a call. Mr.
Strathman explained the city has a contractor that is on ca1124 hours a day. This happened at
10:20 p.m. The police are in a hurry to get back on the street and could not leave the building
unsecured. Mr. DeLisle responded he understands.
Gerry Strathman recommended approval of the assessment.

Patricia Whitney, representing Keith Pederson, appeazed and stated Mr. Pederson is not the fee
owner of the property. He owns the mortgage. The actual fee owner is Richard Potvin. This
property is being foreclosed by Mr. Pederson. They have been trying to work with the inspectors,
and maintain the property to the extent they aze allowed. The last address Ms. Whitney has for
Mr. Potvin is 1606 Reaney Avenue, but he does not live there anymore. She requested Mr.
Pederson's nazne be removed as the owner/taxpayer.
Guy Willits reported notice was sent to Mr. Potvin at 1606 Reaney Avenue. The mail has not
been returned, so it is believed he is receiving it.
Roxanne Flink reported Keith Pederson is listed as the owner in the Ramsey County Records.
By law, Real Estate has to notify the person on the tas records. However, an additional notice
can be sent to Mr. Potvin.
Chuck Votel explained Code Enforcement will make a notation in their file that Mr. Potvin is
responsible for the property. It is not a problem to make sure both parties are notified.
Gerry Strathman recommended approval of the assessment.
448 Ashland Avenue (J9902B)
Charles 7ackson, owner, appeared and was concerned about three things: 1) he was not notified
that the property would be boarded up, 2) it was not boarded well, 3) there were still holes on the
outside to be taken care of. Three pieces of plywood were installed and the workers were there
for only one hour.
(Mr. Jackson presented photographs to Gerry Strathman.)
Chuck Votel reported seven boazds are cited on the bill. Unless a board was installed behind
another one, he does not see seven boards in the photographs. Mr. Strathman asked how many
boazds it looks like. Mr. Jackson and Mr. Votel agreed that it looks like three.

Mr. Votel explained: Code Enforcement authorized Fire Department captains to call the boazding
contractor to board and secure buildings. In this case, a fire was in the attic and the contractor
chazged a$200 trip chazge, $50 per opening/boazd. The total chazge is $550.
Gerry Strathman recommended reducing the assessment as follows: the trip chazge of $200 will
remain the same, the administrafive fee of $40 will remain the same, the cost of the boazds will
be reduced from $350 to $150, which brings the assessment to a total of $390.

Guy Willits reported he spoke to the owner about this case. Mr. Willits is surprised the owner is
not here because he was adamant about this issue. The owner thinks the assessment is high. He
received a few notices to conect the problem.
(A videotape was shown, in which wood pallets, trash bags, and other refuse was removed.)
Ceiry Strathman recommended approval of the assessment citing the property was cleaned up
and the owner was notified.
Resolution ordering the owner to remove or repair the property at 503 Belvidere Street
East. If the owner fails to comply with the resolution, Code Enforcement is ordered to
remove the building.
Chuck Votel reported the current property owners aze James and Florence Jorgensen; they have
not discussed their intentions with Code Enforcement. HiTD (Housing and Urban Development)
is involved as an underlying mortgage insurer. The City has issued three summary abatement
nofices to abate nuisance violations and secure the building. Registration fees and real estate
t�es are paid. The esfimated market value is $33,300; estimated cost to repair, $30,000.
Shapiro and Nordmeyer aze the attorneys for mortgage foreclosure. People involved have been
advised of the hearing today.
Gerry Strathman recommended approval of the resolution.
The meeting was adjourned at 1021 a.m.
The meeting was convened again at 10:28 am.

Jeffrey DeLisle, owner, appeazed and stated the windows were broken, and the City boarded up
the building. Mr. DeLisle was curious as to what happened.
Guy Willits reported this was a break in. The police did not want to leave the scene without the
building being secured so the emergency boarding company was called. A large picture window
was boarded.

Mr. DeLisle stated his phone is posted on the building entrance, but he did not receive a call. Mr.
Strathman explained the city has a contractor that is on ca1124 hours a day. This happened at
10:20 p.m. The police are in a hurry to get back on the street and could not leave the building
unsecured. Mr. DeLisle responded he understands.

Patricia Whitney, representing Keith Pederson, appeazed and stated Mr. Pederson is not the fee
owner of the property. He owns the mortgage. The actual fee owner is Richard Potvin. This
property is being foreclosed by Mr. Pederson. They have been trying to work with the inspectors,
and maintain the property to the extent they aze allowed. The last address Ms. Whitney has for
Mr. Potvin is 1606 Reaney Avenue, but he does not live there anymore. She requested Mr.
Pederson's nazne be removed as the owner/taxpayer.
Guy Willits reported notice was sent to Mr. Potvin at 1606 Reaney Avenue. The mail has not
been returned, so it is believed he is receiving it.
Roxanne Flink reported Keith Pederson is listed as the owner in the Ramsey County Records.
By law, Real Estate has to notify the person on the tas records. However, an additional notice
can be sent to Mr. Potvin.
Chuck Votel explained Code Enforcement will make a notation in their file that Mr. Potvin is
responsible for the property. It is not a problem to make sure both parties are notified.
Gerry Strathman recommended approval of the assessment.
448 Ashland Avenue (J9902B)
Charles 7ackson, owner, appeared and was concerned about three things: 1) he was not notified
that the property would be boarded up, 2) it was not boarded well, 3) there were still holes on the
outside to be taken care of. Three pieces of plywood were installed and the workers were there
for only one hour.
(Mr. Jackson presented photographs to Gerry Strathman.)
Chuck Votel reported seven boazds are cited on the bill. Unless a board was installed behind
another one, he does not see seven boards in the photographs. Mr. Strathman asked how many
boazds it looks like. Mr. Jackson and Mr. Votel agreed that it looks like three.

Mr. Votel explained: Code Enforcement authorized Fire Department captains to call the boazding
contractor to board and secure buildings. In this case, a fire was in the attic and the contractor
chazged a$200 trip chazge, $50 per opening/boazd. The total chazge is $550.
Gerry Strathman recommended reducing the assessment as follows: the trip chazge of $200 will
remain the same, the administrafive fee of $40 will remain the same, the cost of the boazds will
be reduced from $350 to $150, which brings the assessment to a total of $390.

Guy Willits reported he spoke to the owner about this case. Mr. Willits is surprised the owner is
not here because he was adamant about this issue. The owner thinks the assessment is high. He
received a few notices to conect the problem.
(A videotape was shown, in which wood pallets, trash bags, and other refuse was removed.)
Ceiry Strathman recommended approval of the assessment citing the property was cleaned up
and the owner was notified.
Resolution ordering the owner to remove or repair the property at 503 Belvidere Street
East. If the owner fails to comply with the resolution, Code Enforcement is ordered to
remove the building.
Chuck Votel reported the current property owners aze James and Florence Jorgensen; they have
not discussed their intentions with Code Enforcement. HiTD (Housing and Urban Development)
is involved as an underlying mortgage insurer. The City has issued three summary abatement
nofices to abate nuisance violations and secure the building. Registration fees and real estate
t�es are paid. The esfimated market value is $33,300; estimated cost to repair, $30,000.
Shapiro and Nordmeyer aze the attorneys for mortgage foreclosure. People involved have been
advised of the hearing today.
Gerry Strathman recommended approval of the resolution.
The meeting was adjourned at 1021 a.m.
The meeting was convened again at 10:28 am.

Jeffrey DeLisle, owner, appeazed and stated the windows were broken, and the City boarded up
the building. Mr. DeLisle was curious as to what happened.
Guy Willits reported this was a break in. The police did not want to leave the scene without the
building being secured so the emergency boarding company was called. A large picture window
was boarded.

Mr. DeLisle stated his phone is posted on the building entrance, but he did not receive a call. Mr.
Strathman explained the city has a contractor that is on ca1124 hours a day. This happened at
10:20 p.m. The police are in a hurry to get back on the street and could not leave the building
unsecured. Mr. DeLisle responded he understands.
