Outiot A, as shown on the enclosed plat, is the proposed parcel of land to be transferred to Division of Parks and Recreation in exchange for the north one half vacated portion of Cottage Avenue West, also shown on this ptat. In reviewing this matter, I discovered that an error was made during the previous calculations, regarding the total square feet of land included in the north one half of Cottage Avenue. I had assumed that Cottage Avenue at this point was 66 feet in width, however it has been deternuned by the surveyor that the unimproved portion of Cottage Avenue is only 50 feet wide. Therefore, the portion that we seek to obtain from the City, the north 25 feet (with dimensions of 56.25 feet by 25 feet), caiculated to 1,406 squaze feet. I calculated the amount of land in the outiot A parcel to be 2,968 squaze feet. I would appreciate it if you review this document and advise me if there is anything further that you neecl�from me to present this matter to the Commission on May 12, 1999. Bob Schutnacher is a resident workinL with the Ciry to gain approval for the proposed West Cottage Avenue land exchan�e. 2. - ADVOCACY ISSUES Facility Leasing Commission Anderson questioned the appropriateness of proceedina with a discussion of the proposed changes to the draft leasing policy made by the Commission's Leasing - Subcommittee in light of the fact that many of the individuals who attended the April 14 public hearing had not received a copy of the subcommittee's revisions. Commissioner Danner noted that copies of the proposed revised policy had been sent to District Councils and other parties on the Commission mailing list and that there would be no -1- Saint Paul Parl;s and Recreation Commissioners: 3i11 Danner, Chairperson; Terrence Auntrods, Vice-Chairperson Liz Anderson, Lori Huot. Kenneth Mauer, 7ohn O' Halloran, Altin Paulson, Phil Ravi¢ky, Samuel Verdeja be no harm in discussing the matter at this point. She suggested that copies of the draft policy as revised by the Commission as a whole be sent to everyone who attended the public hearing prior to the June Commission meeting when the policy will be voted on. • Commissioner Anderson inquired about how the public would be informed about leases whose term is from 1-5 yeazs, noting that this was not spelled out in the revised draft policy. Ii was stated that the Division intended to list these leases on Gommission agendas for possible discussion. It was generally agreed that this stipulation should be included in the policy. Commissioner Anderson asked for clarification on �vhat a "management agreement" is. Mr. Witfgenstein responded that a management agreement is one in which an outside pariy operates a facility for Parks and Recreation without acquiring the kinds ownership rights to buildings and property contained in a lease agreement. This is not now and wilI not Iikely be a much utilized arrangement in the future. Commissioner Anderson wondered how standard conditions aze decided upon. Mr. Wittgenstein noted that the Division has a checklist that it refers to when negotiating agreements. Commissioner Anderson suggested that Ianguage be inserted in Policy #2d to the effect that the receipt of unsolicited donations trigger consideration of issuing Requests for Proposals to the public and public employees. It was generally agreed that wording to this effect shouId be incIuded in the policy. • Mr. Hahm observed that a lot of good information and many valuable suggestions were offered by the speaicers at the Aprii 14 pubIic heazing. He noted that many of the concems raised were more properly management issues for staff attention than procedural rules that should be codified in a policy. The provisions calling for Commission review and public hearings at the discretion ofthe Commission in response to specific lease proposals would provide effective mechanisms for reviewing the merits of the proposals on a case by case basis. Commissioner Anderson asked about whether the Division has _ an inventory of Ieases. Mr. Witt�enstein replied that leases aze handled b}� the individuals responsible for overseeing them. Mr. Rossberg stated that efforts are underc� to develop a single inventory. Off-Leash Dog Area Resolution Commissioner Danner explained the terms of Resolution 99-5 concerning the appointment by the Commission of a task force to study the possibiliry of off-leash dog areas in city parks. This resolution substitutes for Resolution 99-4, which was effectively negated by the City Council for reasons concerning problems of form with the related Ciry Cbuncii Resolution. Commissioner Ravitsky moved to accept Resolution 99-5, Commissioner Huntrods seconded the motion. The motion passed by a 6-0-3 vote. Department versus Division ' Mr. Wittgenstein observed that it may be best to table this item until after the appointment of the permanent Superintendent. The issue arose because the City Charter allows for city govemment to have six departments, but with the dissolution of the Department of Community Services there aze cunently only five. Commissioner Verdeja made a motion that the Department versus Division issue be tabled until a new Superintendent is appointed and reconsidered at that time. Commissioner Mauer seconded the motion. The motion passed by a vote of 7-0-2. 3. SUPERINTENDENT'S REPORT Mr. Wittgenstein reported that the city is facing a$7 million deficit in 2000, $4 million of w�hich will be taken out of the reserve fund and $3 million of which wiil be absorbed as cuts by city departments. Parks and Recreation has been asked to make $380,000 in cuts. As a partial alternative, the Division may seek approval to put residential tree work under a 10% assessment, which would produce a$2-3 annual properry tax increase for residents with a 40 foot lot. - Mr. Wittgenstein stated that there is a good working relationship between the Division of Parks and R�creation and Ramsey County. Discussions between officials from the two govemmental entities are held frequently. Commissioner O'Halloran voiced his concems about the rising participation fees at ice arenas located wifhin ciry limits but operated by the County. Support Services Mana�er Judy Barr's surgery for a throat condition w•ent well. She is recuperating and expects to retum to work on May 24. Mr. Wittgenstein recently leamed that the Division's Forestry section will be one of the first work units in the city to participate in the Compete Saint Paul process. There will be an informational meeting conceming this matter on May 14. -3- Mr. Wittgenstein stated that the Municipal Athletics office has moved from the City Hall Annex to the Rice and Arlington Dome. This will provide better costumer service in the form of easier registration, an extended day of service and on-site training opportunities. 4. COMMISSION STRUCTiJRE/ACTIVITIES Commissioners suggested the following topics for inclusion in the 1999 State of the Parks Report: maintenance; the possibility of off-leash dog azeas in city pazks; the renovation of Hamet Island; Como Park and the proposed Resource Center; tree maintenance; and the Pig's Eye landfill area. Commissioner Danner suggested that the facilities tour be held the month after the new or renewed appointments to the Commission are made by the Mayor. She also sugge'sted that rather than taking a citywide Tour, the Commission consider going on an in depth tour of Como Pazk. These ideas met with a favorable reaction from the Commissioners. _ 5. COMMITTEE AND TASK F`ORCE REPORTS • Commissioner Huot reported on the Bicycle Advisory Board's interest in expanding the - system of bicycle lanes on city streets. • Commissioner Huntrods reported that the Como Zoo and Conservatory Campus Society held its first meeting two weeks ago and will meet again on May 18. Commissioner Andersan suggested that language be inserted in Policy #2d to the e£fect that the receipt of unsolicited donations trigger consideration of issuing Requests for Proposals to the public and public employees. It was generally a�reed that wording to this effect should be included in the policy. • Mr. Hahrn observed that a lot of good infotmation and many valuable su�gestions were offered by the speakers at the April 14 public hearing. He noted that man� of the concems raised were more properly management issues for staff attention than procedural rules that should be codified in a policy. The provisions calling for Commission review and public hearings at the discretion of the Commission in response to specific lease proposals would provide effective mechanisms for reviewing the merits of thz proposals on a case by case basis. Commissioner Anderson asked about whether the Division has - an inventory of leases. Mr. Wittgenstein replied that leases are handled b} the individuals responsible for overseeing them. Mr. Rossberg stated that efforts aze underw�av to develop a single inventory. It was suggested and generally agreed to that the number of times a lease had been renewed be included as an item on the lease checklist. ' It was generally a�reed that a joint letter from the Commission Chair and Di� ision Superintendent thanking the public for its input into the lease policc, notins the merits of their camments and explainins both the Commission's and the Division's support for the revised drafr policy would be helpful. • West Cottage Avenue Land Exchange - Mr. Wirka reported that Saint Paul resident Bob Schumacher had proposed an exchange of small pazcels of land in the Wheelock/Arlington azea of the city. The parczl iVir. Schumacher is willina to give to the city is about tw�ice the size of the one he wishes to receive in return . This exchange will benefit Mr. Schumacher by giving him better _ access to his property and will benefit the city by allowing it to protzct the bluffs. -2- / �� �� v�` Commissioner Ravitsky moved that the Commission endorse the proposed West Cottage Avenue land exchange between Mr. Robert Schumacher and the City of Saint Paul. Commissioner Mauer seconded the motion. The motion passed by a vote of 6-0-3. Off-Leash Dog Area Resolution Commissioner Danner explained the terms of Resolution 99-5 concerning the appointment by the Commission of a task force to study the possibility of establishing off-leash dog areas in city parks. This resolution substitutes for Resolution 99-4, which was effectively negated by the City Council for reasons concerning problems of form with the relafed City Council Resolution. Commissioner Ravitsky moved to accept Resolution 99-5, Commissioner Huntrods seconded the motion. The motion passed by a 6-0-3 vote. Department versus Division . Mr. Wittgenstein observed that it may be best to table this item until after the appointment of the permanent Superintendent. The issue arose because the City Charter allows for city govemment to have six departments, but with the dissolution of the Department of Community Services there are currently only five. Commissioner Verdeja made a motion ihat the Department versus Division lssue be tabled until a new Superintendent is appointed and reconsidered at that time. Commissioner Mauer seconded the motion. The motion passed by a vote of 7-0-2. 3. SUPERINTENDENT'S REPORT Mr. Wittgenstein reporied that the city is facing a$7 million deficit in 2000, $4 million of w�hich will be taken out of the reserve fund and �3 million of which w,�ill be absorbed as cuts by city departments. Pazks and Recreation has been asked to make �380,000 in cuts. As a partial alternaeive, the Division may seek approval to put residential tree work under a 10% assessment, which would produce a$2-3 annual property tax increase for residents �vith a 40 foot lot. - Mr. Witt�enstein stated that there is a good working relationship bztw�een the Division of Parks and Recreation and Ramsey County. Discussions between officials from the rivo governmental gntities are held frequently. Commissioner O'Halloran voiced his concems about the risin� participation fees at ice arenas located wifhin city limits but operated by the County. Support Services Manager Judy Barr's surgery for a throat condition went well. She is recuperatinJ and expects to retum to work on May 24. Mr. Wittgenstein recently leamed that the Division's Forestry section will bz one of the first �vork units in the city to par[icipate in the Compete Saint Paul process. There will be an informational meeting concerning this matter on May 14. -�- �°t s� Mr. Wittgenstein stated that the Municipai Athletics office has moved from the City Hall Annex to the Rice and Arlington Dome. This will provide better costumer service in the form of easier registration, an extended day of service and on-site training oppostunities. 4. COMMISSION STRUCTURE/ACTIVITIES Commissioners suggested the following topics for inclusion in the 1999 State of the Parks Report: maintenance; the possibility of off-leash dog areas in city pazks; the renovation of Harriet Island; Como Pazk and the proposed Resource Center; tree maintenance; and the Pig's Eye landfill area. Commissioner Danner suggested that the facilities tour be held the month after the new or renewed appointments to the Commission aze made by the Mayor. She also sugge'sted that rather than taking a citywide tour, the Commission consider going on an in depth tour of Como Park. These ideas met with a favorable reaction from the Commissioners. _ 5. COMMITTEE AND TASK #ORCE REPORTS • Commissioner Huot reported on the Bicycle Advisory Board's interest in expanding the system of bicycle lanes on city streets. • Commissioner Huntrods reported that the Como Zoo and Conservatory Campus Society held its first meeting two weeks a�o and will meet again on May 18. Bob Schutnacher is a resident workinL with the Ciry to gain approval for the proposed West Cottage Avenue land exchan�e. 2. - ADVOCACY ISSUES Facility Leasing Commission Anderson questioned the appropriateness of proceedina with a discussion of the proposed changes to the draft leasing policy made by the Commission's Leasing - Subcommittee in light of the fact that many of the individuals who attended the April 14 public hearing had not received a copy of the subcommittee's revisions. Commissioner Danner noted that copies of the proposed revised policy had been sent to District Councils and other parties on the Commission mailing list and that there would be no -1- Saint Paul Parl;s and Recreation Commissioners: 3i11 Danner, Chairperson; Terrence Auntrods, Vice-Chairperson Liz Anderson, Lori Huot. Kenneth Mauer, 7ohn O' Halloran, Altin Paulson, Phil Ravi¢ky, Samuel Verdeja be no harm in discussing the matter at this point. She suggested that copies of the draft policy as revised by the Commission as a whole be sent to everyone who attended the public hearing prior to the June Commission meeting when the policy will be voted on. • Commissioner Anderson inquired about how the public would be informed about leases whose term is from 1-5 yeazs, noting that this was not spelled out in the revised draft policy. Ii was stated that the Division intended to list these leases on Gommission agendas for possible discussion. It was generally agreed that this stipulation should be included in the policy. Commissioner Anderson asked for clarification on �vhat a "management agreement" is. Mr. Witfgenstein responded that a management agreement is one in which an outside pariy operates a facility for Parks and Recreation without acquiring the kinds ownership rights to buildings and property contained in a lease agreement. This is not now and wilI not Iikely be a much utilized arrangement in the future. Commissioner Anderson wondered how standard conditions aze decided upon. Mr. Wittgenstein noted that the Division has a checklist that it refers to when negotiating agreements. Commissioner Anderson suggested that Ianguage be inserted in Policy #2d to the effect that the receipt of unsolicited donations trigger consideration of issuing Requests for Proposals to the public and public employees. It was generally agreed that wording to this effect shouId be incIuded in the policy. • Mr. Hahm observed that a lot of good information and many valuable suggestions were offered by the speaicers at the Aprii 14 pubIic heazing. He noted that many of the concems raised were more properly management issues for staff attention than procedural rules that should be codified in a policy. The provisions calling for Commission review and public hearings at the discretion ofthe Commission in response to specific lease proposals would provide effective mechanisms for reviewing the merits of the proposals on a case by case basis. Commissioner Anderson asked about whether the Division has _ an inventory of Ieases. Mr. Witt�enstein replied that leases aze handled b}� the individuals responsible for overseeing them. Mr. Rossberg stated that efforts are underc� to develop a single inventory. Commissioner Mauer seconded the motion. The motion passed by a vote of 6-0-3. Off-Leash Dog Area Resolution Commissioner Danner explained the terms of Resolution 99-5 concerning the appointment by the Commission of a task force to study the possibiliry of off-leash dog areas in city parks. This resolution substitutes for Resolution 99-4, which was effectively negated by the City Council for reasons concerning problems of form with the related Ciry Cbuncii Resolution. Commissioner Ravitsky moved to accept Resolution 99-5, Commissioner Huntrods seconded the motion. The motion passed by a 6-0-3 vote. Department versus Division ' Mr. Wittgenstein observed that it may be best to table this item until after the appointment of the permanent Superintendent. The issue arose because the City Charter allows for city govemment to have six departments, but with the dissolution of the Department of Community Services there aze cunently only five. Commissioner Verdeja made a motion that the Department versus Division issue be tabled until a new Superintendent is appointed and reconsidered at that time. Commissioner Mauer seconded the motion. The motion passed by a vote of 7-0-2. 3. SUPERINTENDENT'S REPORT Mr. Wittgenstein reported that the city is facing a$7 million deficit in 2000, $4 million of w�hich will be taken out of the reserve fund and $3 million of which wiil be absorbed as cuts by city departments. Parks and Recreation has been asked to make $380,000 in cuts. As a partial alternative, the Division may seek approval to put residential tree work under a 10% assessment, which would produce a$2-3 annual properry tax increase for residents with a 40 foot lot. - Mr. Wittgenstein stated that there is a good working relationship between the Division of Parks and R�creation and Ramsey County. Discussions between officials from the two govemmental entities are held frequently. Commissioner O'Halloran voiced his concems about the rising participation fees at ice arenas located wifhin ciry limits but operated by the County. Support Services Mana�er Judy Barr's surgery for a throat condition w•ent well. She is recuperating and expects to retum to work on May 24. Mr. Wittgenstein recently leamed that the Division's Forestry section will be one of the first work units in the city to participate in the Compete Saint Paul process. There will be an informational meeting conceming this matter on May 14. -3- Mr. Wittgenstein stated that the Municipal Athletics office has moved from the City Hall Annex to the Rice and Arlington Dome. This will provide better costumer service in the form of easier registration, an extended day of service and on-site training opportunities. 4. COMMISSION STRUCTiJRE/ACTIVITIES Commissioners suggested the following topics for inclusion in the 1999 State of the Parks Report: maintenance; the possibility of off-leash dog azeas in city pazks; the renovation of Hamet Island; Como Park and the proposed Resource Center; tree maintenance; and the Pig's Eye landfill area. Commissioner Danner suggested that the facilities tour be held the month after the new or renewed appointments to the Commission are made by the Mayor. She also sugge'sted that rather than taking a citywide Tour, the Commission consider going on an in depth tour of Como Pazk. These ideas met with a favorable reaction from the Commissioners. _ 5. COMMITTEE AND TASK F`ORCE REPORTS • Commissioner Huot reported on the Bicycle Advisory Board's interest in expanding the - system of bicycle lanes on city streets. • Commissioner Huntrods reported that the Como Zoo and Conservatory Campus Society held its first meeting two weeks ago and will meet again on May 18. ADVOCACY ISSUES Facility Leasing Commission Anderson questioned the appropriateness of proceeding �vith a discussion of the proposed changes to the draft leasing policy made by the Commission's Leasing - Subcommittee in light of the fact that many of the individuals who attended the April 14 public hearing had not received a copy of the subcommittee's revisions. Commissioner Danner noted that copies of the proposed revised policy had been sent to District Councils and other parties on the Commission mailing list and that there would be no -1- Saint Paul Parks and Recreation Commissioners: Jiti Danner, Chairperson; Terrence Huntrods, Vice-Chairperson - Liz Anderson, Lori Huot. Kenneth Mauer, 7ohn O'Halloran, Altin Paulson, Phil Ravi¢I.y, Samuel Verdeja r ��-S�Z be no harm in discussing the matter at this point. She suggested that copies of the draft _ policy as revised by the Commission as a whole be sent to everyone who attended the public heazing prior to the June Commission meeting when the policy will be voted on. • Commissioner Anderson inquired about how the public would be infortned about leases whose term is from 1-5 years, noting that this was not spelled out in the revised draft policy. It was stated that the Division intended to list these leases on Gommission agendas for possible discussion. It was generally agreed that this stipulation should be included in the policy. Commissioner Anderson asked for clarification on �vhat a ^ "mana�ement agreemenY' is. Mr. Wittgenstein responded that a management agreement is one in which an outside party operates a facility for Parks and Recreation without acquiring the kinds ownership rights to buildings and property contained in a lease agreement. This is not now and wi11 not likely be a much utilized arran�ement in the future. Commissioner Anderson wondered how standard conditions are decided upon. Mr. Wittgenstein noted that the Division has a checklist that it refers to when negotiating agreements. Commissioner Andersan suggested that language be inserted in Policy #2d to the e£fect that the receipt of unsolicited donations trigger consideration of issuing Requests for Proposals to the public and public employees. It was generally a�reed that wording to this effect should be included in the policy. • Mr. Hahrn observed that a lot of good infotmation and many valuable su�gestions were offered by the speakers at the April 14 public hearing. He noted that man� of the concems raised were more properly management issues for staff attention than procedural rules that should be codified in a policy. The provisions calling for Commission review and public hearings at the discretion of the Commission in response to specific lease proposals would provide effective mechanisms for reviewing the merits of thz proposals on a case by case basis. Commissioner Anderson asked about whether the Division has - an inventory of leases. Mr. Wittgenstein replied that leases are handled b} the individuals responsible for overseeing them. Mr. Rossberg stated that efforts aze underw�av to develop a single inventory. It was suggested and generally agreed to that the number of times a lease had been renewed be included as an item on the lease checklist. ' It was generally a�reed that a joint letter from the Commission Chair and Di� ision Superintendent thanking the public for its input into the lease policc, notins the merits of their camments and explainins both the Commission's and the Division's support for the revised drafr policy would be helpful. • West Cottage Avenue Land Exchange - Mr. Wirka reported that Saint Paul resident Bob Schumacher had proposed an exchange of small pazcels of land in the Wheelock/Arlington azea of the city. The parczl iVir. Schumacher is willina to give to the city is about tw�ice the size of the one he wishes to receive in return . This exchange will benefit Mr. Schumacher by giving him better _ access to his property and will benefit the city by allowing it to protzct the bluffs. -2- / �� �� v�` Commissioner Ravitsky moved that the Commission endorse the proposed West Cottage Avenue land exchange between Mr. Robert Schumacher and the City of Saint Paul. Commissioner Mauer seconded the motion. The motion passed by a vote of 6-0-3. Off-Leash Dog Area Resolution Commissioner Danner explained the terms of Resolution 99-5 concerning the appointment by the Commission of a task force to study the possibility of establishing off-leash dog areas in city parks. This resolution substitutes for Resolution 99-4, which was effectively negated by the City Council for reasons concerning problems of form with the relafed City Council Resolution. Commissioner Ravitsky moved to accept Resolution 99-5, Commissioner Huntrods seconded the motion. The motion passed by a 6-0-3 vote. Department versus Division . Mr. Wittgenstein observed that it may be best to table this item until after the appointment of the permanent Superintendent. The issue arose because the City Charter allows for city govemment to have six departments, but with the dissolution of the Department of Community Services there are currently only five. Commissioner Verdeja made a motion ihat the Department versus Division lssue be tabled until a new Superintendent is appointed and reconsidered at that time. Commissioner Mauer seconded the motion. The motion passed by a vote of 7-0-2. 3. SUPERINTENDENT'S REPORT Mr. Wittgenstein reporied that the city is facing a$7 million deficit in 2000, $4 million of w�hich will be taken out of the reserve fund and �3 million of which w,�ill be absorbed as cuts by city departments. Pazks and Recreation has been asked to make �380,000 in cuts. As a partial alternaeive, the Division may seek approval to put residential tree work under a 10% assessment, which would produce a$2-3 annual property tax increase for residents �vith a 40 foot lot. - Mr. Witt�enstein stated that there is a good working relationship bztw�een the Division of Parks and Recreation and Ramsey County. Discussions between officials from the rivo governmental gntities are held frequently. Commissioner O'Halloran voiced his concems about the risin� participation fees at ice arenas located wifhin city limits but operated by the County. Support Services Manager Judy Barr's surgery for a throat condition went well. She is recuperatinJ and expects to retum to work on May 24. Mr. Wittgenstein recently leamed that the Division's Forestry section will bz one of the first �vork units in the city to par[icipate in the Compete Saint Paul process. There will be an informational meeting concerning this matter on May 14. -�- �°t s� Mr. Wittgenstein stated that the Municipai Athletics office has moved from the City Hall Annex to the Rice and Arlington Dome. This will provide better costumer service in the form of easier registration, an extended day of service and on-site training oppostunities. 4. COMMISSION STRUCTURE/ACTIVITIES Commissioners suggested the following topics for inclusion in the 1999 State of the Parks Report: maintenance; the possibility of off-leash dog areas in city pazks; the renovation of Harriet Island; Como Pazk and the proposed Resource Center; tree maintenance; and the Pig's Eye landfill area. Commissioner Danner suggested that the facilities tour be held the month after the new or renewed appointments to the Commission aze made by the Mayor. She also sugge'sted that rather than taking a citywide tour, the Commission consider going on an in depth tour of Como Park. These ideas met with a favorable reaction from the Commissioners. _ 5. COMMITTEE AND TASK #ORCE REPORTS • Commissioner Huot reported on the Bicycle Advisory Board's interest in expanding the system of bicycle lanes on city streets. • Commissioner Huntrods reported that the Como Zoo and Conservatory Campus Society held its first meeting two weeks a�o and will meet again on May 18. JeahKoonce is a member of ROMP who is monitoring the progress of the off-leash dog area issue. Bob Schutnacher is a resident workinL with the Ciry to gain approval for the proposed West Cottage Avenue land exchan�e. 2. - ADVOCACY ISSUES Facility Leasing Commission Anderson questioned the appropriateness of proceedina with a discussion of the proposed changes to the draft leasing policy made by the Commission's Leasing - Subcommittee in light of the fact that many of the individuals who attended the April 14 public hearing had not received a copy of the subcommittee's revisions. Commissioner Danner noted that copies of the proposed revised policy had been sent to District Councils and other parties on the Commission mailing list and that there would be no -1- Saint Paul Parl;s and Recreation Commissioners: 3i11 Danner, Chairperson; Terrence Auntrods, Vice-Chairperson Liz Anderson, Lori Huot. Kenneth Mauer, 7ohn O' Halloran, Altin Paulson, Phil Ravi¢ky, Samuel Verdeja be no harm in discussing the matter at this point. She suggested that copies of the draft policy as revised by the Commission as a whole be sent to everyone who attended the public hearing prior to the June Commission meeting when the policy will be voted on. • Commissioner Anderson inquired about how the public would be informed about leases whose term is from 1-5 yeazs, noting that this was not spelled out in the revised draft policy. Ii was stated that the Division intended to list these leases on Gommission agendas for possible discussion. It was generally agreed that this stipulation should be included in the policy. Commissioner Anderson asked for clarification on �vhat a "management agreement" is. Mr. Witfgenstein responded that a management agreement is one in which an outside pariy operates a facility for Parks and Recreation without acquiring the kinds ownership rights to buildings and property contained in a lease agreement. This is not now and wilI not Iikely be a much utilized arrangement in the future. Commissioner Anderson wondered how standard conditions aze decided upon. Mr. Wittgenstein noted that the Division has a checklist that it refers to when negotiating agreements. Commissioner Anderson suggested that Ianguage be inserted in Policy #2d to the effect that the receipt of unsolicited donations trigger consideration of issuing Requests for Proposals to the public and public employees. It was generally agreed that wording to this effect shouId be incIuded in the policy. • Mr. Hahm observed that a lot of good information and many valuable suggestions were offered by the speaicers at the Aprii 14 pubIic heazing. He noted that many of the concems raised were more properly management issues for staff attention than procedural rules that should be codified in a policy. The provisions calling for Commission review and public hearings at the discretion ofthe Commission in response to specific lease proposals would provide effective mechanisms for reviewing the merits of the proposals on a case by case basis. Commissioner Anderson asked about whether the Division has _ an inventory of Ieases. Mr. Witt�enstein replied that leases aze handled b}� the individuals responsible for overseeing them. Mr. Rossberg stated that efforts are underc� to develop a single inventory. Commissioner Mauer seconded the motion. The motion passed by a vote of 6-0-3. Off-Leash Dog Area Resolution Commissioner Danner explained the terms of Resolution 99-5 concerning the appointment by the Commission of a task force to study the possibiliry of off-leash dog areas in city parks. This resolution substitutes for Resolution 99-4, which was effectively negated by the City Council for reasons concerning problems of form with the related Ciry Cbuncii Resolution. Commissioner Ravitsky moved to accept Resolution 99-5, Commissioner Huntrods seconded the motion. The motion passed by a 6-0-3 vote. Department versus Division ' Mr. Wittgenstein observed that it may be best to table this item until after the appointment of the permanent Superintendent. The issue arose because the City Charter allows for city govemment to have six departments, but with the dissolution of the Department of Community Services there aze cunently only five. Commissioner Verdeja made a motion that the Department versus Division issue be tabled until a new Superintendent is appointed and reconsidered at that time. Commissioner Mauer seconded the motion. The motion passed by a vote of 7-0-2. 3. SUPERINTENDENT'S REPORT Mr. Wittgenstein reported that the city is facing a$7 million deficit in 2000, $4 million of w�hich will be taken out of the reserve fund and $3 million of which wiil be absorbed as cuts by city departments. Parks and Recreation has been asked to make $380,000 in cuts. As a partial alternative, the Division may seek approval to put residential tree work under a 10% assessment, which would produce a$2-3 annual properry tax increase for residents with a 40 foot lot. - Mr. Wittgenstein stated that there is a good working relationship between the Division of Parks and R�creation and Ramsey County. Discussions between officials from the two govemmental entities are held frequently. Commissioner O'Halloran voiced his concems about the rising participation fees at ice arenas located wifhin ciry limits but operated by the County. Support Services Mana�er Judy Barr's surgery for a throat condition w•ent well. She is recuperating and expects to retum to work on May 24. Mr. Wittgenstein recently leamed that the Division's Forestry section will be one of the first work units in the city to participate in the Compete Saint Paul process. There will be an informational meeting conceming this matter on May 14. -3- Mr. Wittgenstein stated that the Municipal Athletics office has moved from the City Hall Annex to the Rice and Arlington Dome. This will provide better costumer service in the form of easier registration, an extended day of service and on-site training opportunities. 4. COMMISSION STRUCTiJRE/ACTIVITIES Commissioners suggested the following topics for inclusion in the 1999 State of the Parks Report: maintenance; the possibility of off-leash dog azeas in city pazks; the renovation of Hamet Island; Como Park and the proposed Resource Center; tree maintenance; and the Pig's Eye landfill area. Commissioner Danner suggested that the facilities tour be held the month after the new or renewed appointments to the Commission are made by the Mayor. ADVOCACY ISSUES Facility Leasing Commission Anderson questioned the appropriateness of proceeding �vith a discussion of the proposed changes to the draft leasing policy made by the Commission's Leasing - Subcommittee in light of the fact that many of the individuals who attended the April 14 public hearing had not received a copy of the subcommittee's revisions. Commissioner Danner noted that copies of the proposed revised policy had been sent to District Councils and other parties on the Commission mailing list and that there would be no -1- Saint Paul Parks and Recreation Commissioners: Jiti Danner, Chairperson; Terrence Huntrods, Vice-Chairperson - Liz Anderson, Lori Huot. She suggested that copies of the draft _ policy as revised by the Commission as a whole be sent to everyone who attended the public heazing prior to the June Commission meeting when the policy will be voted on. • Commissioner Anderson inquired about how the public would be infortned about leases whose term is from 1-5 years, noting that this was not spelled out in the revised draft policy. It was stated that the Division intended to list these leases on Gommission agendas for possible discussion. It was generally agreed that this stipulation should be included in the policy. Commissioner Anderson asked for clarification on �vhat a ^ "mana�ement agreemenY' is. Mr. Wittgenstein responded that a management agreement is one in which an outside party operates a facility for Parks and Recreation without acquiring the kinds ownership rights to buildings and property contained in a lease agreement. This is not now and wi11 not likely be a much utilized arran�ement in the future. Commissioner Anderson wondered how standard conditions are decided upon. Mr. Wittgenstein noted that the Division has a checklist that it refers to when negotiating agreements. Commissioner Andersan suggested that language be inserted in Policy #2d to the e£fect that the receipt of unsolicited donations trigger consideration of issuing Requests for Proposals to the public and public employees. It was generally a�reed that wording to this effect should be included in the policy. • Mr. Hahrn observed that a lot of good infotmation and many valuable su�gestions were offered by the speakers at the April 14 public hearing. He noted that man� of the concems raised were more properly management issues for staff attention than procedural rules that should be codified in a policy. The provisions calling for Commission review and public hearings at the discretion of the Commission in response to specific lease proposals would provide effective mechanisms for reviewing the merits of thz proposals on a case by case basis. Commissioner Anderson asked about whether the Division has - an inventory of leases. Mr. Wittgenstein replied that leases are handled b} the individuals responsible for overseeing them. Mr. Rossberg stated that efforts aze underw�av to develop a single inventory. It was suggested and generally agreed to that the number of times a lease had been renewed be included as an item on the lease checklist. ' It was generally a�reed that a joint letter from the Commission Chair and Di� ision Superintendent thanking the public for its input into the lease policc, notins the merits of their camments and explainins both the Commission's and the Division's support for the revised drafr policy would be helpful. • West Cottage Avenue Land Exchange - Mr. Wirka reported that Saint Paul resident Bob Schumacher had proposed an exchange of small pazcels of land in the Wheelock/Arlington azea of the city. The parczl iVir. Schumacher is willina to give to the city is about tw�ice the size of the one he wishes to receive in return . This exchange will benefit Mr. Schumacher by giving him better _ access to his property and will benefit the city by allowing it to protzct the bluffs. -2- / �� �� v�` Commissioner Ravitsky moved that the Commission endorse the proposed West Cottage Avenue land exchange between Mr. Robert Schumacher and the City of Saint Paul. Commissioner Mauer seconded the motion. The motion passed by a vote of 6-0-3. Off-Leash Dog Area Resolution Commissioner Danner explained the terms of Resolution 99-5 concerning the appointment by the Commission of a task force to study the possibility of establishing off-leash dog areas in city parks. This resolution substitutes for Resolution 99-4, which was effectively negated by the City Council for reasons concerning problems of form with the relafed City Council Resolution. Commissioner Ravitsky moved to accept Resolution 99-5, Commissioner Huntrods seconded the motion. The motion passed by a 6-0-3 vote. Department versus Division . Mr. Wittgenstein observed that it may be best to table this item until after the appointment of the permanent Superintendent. The issue arose because the City Charter allows for city govemment to have six departments, but with the dissolution of the Department of Community Services there are currently only five. Commissioner Verdeja made a motion ihat the Department versus Division lssue be tabled until a new Superintendent is appointed and reconsidered at that time. Commissioner Mauer seconded the motion. The motion passed by a vote of 7-0-2. 3. SUPERINTENDENT'S REPORT Mr. Wittgenstein reporied that the city is facing a$7 million deficit in 2000, $4 million of w�hich will be taken out of the reserve fund and �3 million of which w,�ill be absorbed as cuts by city departments. Pazks and Recreation has been asked to make �380,000 in cuts. As a partial alternaeive, the Division may seek approval to put residential tree work under a 10% assessment, which would produce a$2-3 annual property tax increase for residents �vith a 40 foot lot. - Mr. Witt�enstein stated that there is a good working relationship bztw�een the Division of Parks and Recreation and Ramsey County. Discussions between officials from the rivo governmental gntities are held frequently. Commissioner O'Halloran voiced his concems about the risin� participation fees at ice arenas located wifhin city limits but operated by the County. Support Services Manager Judy Barr's surgery for a throat condition went well. She is recuperatinJ and expects to retum to work on May 24. Mr. Wittgenstein recently leamed that the Division's Forestry section will bz one of the first �vork units in the city to par[icipate in the Compete Saint Paul process. This will provide better costumer service in the form of easier registration, an extended day of service and on-site training oppostunities. 4. COMMISSION STRUCTURE/ACTIVITIES Commissioners suggested the following topics for inclusion in the 1999 State of the Parks Report: maintenance; the possibility of off-leash dog areas in city pazks; the renovation of Harriet Island; Como Pazk and the proposed Resource Center; tree maintenance; and the Pig's Eye landfill area. Outlot A, as shown on the enclosed plat, is the proposed pazcel of land to be transferred to Division of Parks and Recreation in exchange for the north one half vacated portion of Cottage Avenue West, also shown on this plat. In reviewing this matter, I discovered that an error was made during the previous calculations, regarding the total square feet of land included in the north one half of Cottage Avenue. I had assumed that Cottage Avenue at this point was 66 feet in width, however it has been determined by the surveyor that the unimproved portion of Cottage Avenue is only 50 feet wide. Therefore, the portion that we seek to obtain from the City, the north 25 feet (with dimensions of 56.25 feet by 25 feet), calculated to 1,406 square feet. I calculated the amount of land in the outlot A parcel to be 2,968 square feet. I would appreciate it if you review this document and advise me if there is anything further that you need from me to present tlus matter to the Commission on May 12, 1999.
