Subdivision ?_ . The appointed member who has a conf_lict of
interest as defined in Subdivision 1 of this section shall refrain
from voting on or otherwise participating in the action or decision
with which there is a conflict of interest . An appointec� member
is specifically exempted from the prohibitions of this si�bdivision
when the action to be taken or the decision to be rendered is one
which is solely advisory.
100. 03 . Sanction. Any appointed member violating the pro-
visions of Section 100 . 02 may be removed from the appointive
position by the mayor with the consent of the city council .
Violation of this section may render the action taken voidable by
the cit_y council or by a court of competent jurisdiction. Any
monies paid as a result of such violation may be recovered by a
joint and several action from the parties to the action and the
ap?�ointed member interested in the same.
Section 2 .

An ordinance amending Chapter 60 of the Saint Paul Legislative Code
pertaining to zoning for the City of Saint Paul and the zoning maps
thereof.
WHEREAS, Pursuant to Minnesota Statutes, § 462.357 and § 64.400 of the
Legislative Code, Minnesota Transfer Railway Company duly petitioned to rezone
an irregularly shaped parcel located in an area northwest of the northwest
corner of University and Prior Avenues from I-2 to I-1 for the purpose of
eliminating a split zoning district; the petition having been certified by the
Planning Division on June 3, 1987 as having been consented to by at least two-
thirds of the owners of the area of the property to be rezoned, and further
having been consented to by at least 67� of the owners of the property
situated within 100 feet of the total contiguous property within one year
preceding the date of the petition; and
WHEREAS, The Zoning Co�unittee on June 18, 1987 conducted a public hearing for
the purpose of considering the rezoning petition, and pursuant to Section
107.03 of the Administrative Code, submitted its recommendation to the
Planning Commission that the petition be granted; and
WHEREAS, The Planning Commission considered the rezoning petition at its
meeting held on June 26, 1987 and recommended that the City Council approve
the petition; and
WHEREAS, Notice of a public hearing before the City Council on the said
rezoning petition was duly published in the official newspaper of the City on
July 11, 1987 and notices were duly mailed to each owner of affected property
and property situated wholly or partly within 350 feet of the property sought
to be rezoned; and

WHEREAS, A public hearing la,efore the City Council , having been conducted on
July 23, 1987.where all interested persons were heard, and the Council having
considered all the facts and recommendations concerning the petition; now,
therefore,
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1.
That the zoning map of the City of Saint Paul , Sheet No. 9, as
incorporated by reference in Section 60.301 of the Saint Paul
Legislative Code, as amended, is hereby further amended as follows:
That property located in the area northwest of the northwest corner of
University and Prior Avenues, being more particularly described as That
part of the West half of the Northwest quarter of Section 33, Township
29 North, Range 23 West, Ramsey County, Minnesota lying within the
following described lines:
Commencing at a cast iron monument at the Northeast corner of said West
half of the Northwest quarter; thence S 89°38'47" W (assumed bearing)
along the North line of said Northwest quarter 344.54 feet to the point
of beginning of the lines to be herein described; thence continuing S 89°
38'47" W 47.41 feet; thence S 0°25'53" E 288.04 feet; thence S 6 46'09"
W 271.38 feet; thence S 0°38'06" E 108.03 feet; thence S 27°44'57" W
485.78 feet; thence Southerly along a curve to the left 47.46 feet,
radius of 305.75 feet, delta angle of 8°53'37", long chord of 47.41 feet
bears S 23°18'06" W; thence S 18°51'20" W 220.54 feet to the Northerly

On June 18, 1987, the Zoning Committee of the Planning Commission held a public
hearing on this rezoning. The petitioner testified. There was no opposition
at the hearing. At the close of the puhlic hearing, the Committee voted 6 to 0
to approve the rezoning based on staff findings,
On June 26, 1987, the Planning Commission upheld the Zoning Committee's
recommendation on a unanimous voice vote.
This rezoning is scheduled to be heard by the City Council on July 23, 1987.

WHEREAS, Minnesota Transfer Railway Company, file #10133, has petitioned to rezone
property located in an area northwest of the northwest corner of University and
Prior from I-2 to I-1 for the purpose of eliminating a split zoning district; and
WHEREAS, the Zoning Committee of the Planning Commission on June 18, 1987, held a
public hearing at which all persons present were given an opportunity to be heard
pursuant to said application in accordance with the requirements of Section 64.400
of the Saint Paul Legislative Code; and
WHEREAS, Saint Paul Planning Commission, based on the evidence presented to its
Zoning Committee at the public hearing as substantially reflected in the minutes,
made the following findings of fact:
1. The applicant's parcel is composed of two areas, one of which is designated I-2
and the other as 1-l. The intention is to sell the entire parcel to the Knox
lumber Company to construct a new lumber yard operation; Knox would close its
existing operation which is now located across Prior to the east.
2. The Zoning Code defines a zoning lot in Section 60.212 as "a single tract of
land which, at the time of filing for a building permit, is designated by its
owners or developer as a tract to be used, developed, or built upon as a unit. . .
A zoning Zot sha11 be in one zoning district and sha11 satisfy this code with �
respect to ares, size, dimensions, and frontage as required in the district in
which the zoning Iot is located. . ."
3. It is the intent of the I-1 district to accommodate wholesale and warehouse
activities, and industrial operations whose external, physical effects are
restricted to the area of the district and in no manner affect the surrounding
districts in a detrimental way. Lumber yards are a permitted use in the I-1
zoning district. There are no minimum lot size requirements for an I-1 zone.

4. The City's Comprehensive Plan states in its Land Use Section that "the most
important factor in encouraging industry to stay in Saint Paul is the
maintenance of an ample supply of good industrial sites. Not only must such
sites be kept in use, but new ones should be created where feasible."
The rezoning will facilitate the Knox Lumber Company move which will be
relocating from a three acre site to one over eight acres.
S. Rezoning the pzoperty would be a reasonable extension of the I-1 zone which lies
to the east.
NOW, THEREFORE, BE IT RESOLVED, by the Saint Paul Planning Commission that the
petition of Minnesota Transfer Railway Company to rezone property located
northwestof the northwest corner of University and Prior, more particularly
described as (see attachment) from a I-2 zoning classification to I-1 zoning
classification is consistent with the Comprehensive Plan for the City; and
BE IT FURTHER RESOLVED, that the Saint Paul Planning Commission does hereby
