Mr Glassman welcomed the appellants and explained the procedures, stating that what the Board does is recommends action to the City �`�' Counc i 1 . Minutes of the June 9, 1987 meeting were approved as submitted in writing. Chairman Glassman referred to a letter from Jane A. McPeak, Deputy City Attorney, dated May 18, 1987, and the letter Ron Glassman wrote in answer to "Conflict of Interest". Jane McPeak's reply was the Board could continue the practice, which was to declare their interest at the time the case was presented, then to abstain from voting. However, the Board must follow the procedure set forth in the tetter of May 18, 1987 letter as required by St. Paul Legislative Code 24.03. Bill Tilton stated, in effect, the letter from Jane A. McPeak, is saying that the board can continue there present practice, pertaining to stating there interest, but must also put in writing, "what action it is" , and "nature of conflict. " These must be sent to City Clerk and Chair of the Group. If a member is aware of a conflict before a meeting it should me noted beforehand, if not then after the meeting. Bill Tilton stated that the board would have the power to direct this information be put in the minutes. 1 r ' � . CASE N0. PROPERTY APPEALED APPELLANT 01-87-H 684 Virginia Ave. Stephen Butler (2 units) APPEARANCE Stephen Bulter SUBJECT Appeliant is requesting a waiver from the requirement of vacant building fees. PROCEEDINGS: The property in question is in foreclosure, there is no rent coming in. There also is some default judgements against the property. The vacant building fees and fines total $170.00. Foreclosure is by Cal -Fed, from California. These fees are carried over till the fees are paid and then a permit will be issued. A ticket could be issued for not registering the vacant building, these are issued by the violations bureau. (8 un i ts) Jane Murphy APPEARANCE Jane Murphy SUBJECT Appellant is requesting a variance pertaining to size of 3 sleeping rooms, also a variance altowing passage from one sleeping room through another. PROCEEDINGS Ttiis is a sorority house and presently there are 16 women. The house was recently inspected by the city, rule changes switched from university inspection system to city inspection. The sleeping rooms are just a few square feet shy to meet code. The reason for a variance is that this house must maintain the occupancy level , so as to offer affordable housing in the university area. This is only during the school year, during the summer the occupancy is down. The appellant is also asking for a variance pertaining to going through one sleeping room to another. Grotto; and 325 Dayton Ave. According to Council Resolution 84-645, it only referred to 919 Lafond Ave. Appellant is requesting a variance pertaining to dead bolt locks at 325 Dayton Ave. , because of the nature of this group home. PROCEEDINGS Due to the fact that this was before the board on April 10, 1984 for all three addresses, inadvertently only 919 Lafond was mentioned in the Council Resolution, therefore the case was reopened and the other three addresses are to be included in a variance, pertaining to dead bo�lt locks. PROCEEDINGS Appellant very upset because the tenant wrecked the place then called Fire Prevention Bureau. All these items are near completion. (commercial bldg. ) Michaei Coury APPEARANCE Michael Coury SUBJECT Appellant is requesting a variance on an order to remove a wood burning stove as per letter dated, April 28, 1987. PROCEEDINGS Appellant was notified that he had to remove a wood burning stove. This a commercial building, trucking company. The stove is the only source of heat in the winter. A new stove was installed last winter because of an inspection by the insurance company, which was approved by the insurance company. Pat Fish, from Fire Prevention Bureau stated that Uniforrn Fire Code standards forbids any solid fuel burning appliance, but gas is acceptable. �"' Y ppellant. The shop has 55 gal . : � This shop is onl used by the a �`�"' barrel , which contains drain oil . This barrel could be removed. Pat Fish, Fire Prevention Bureau stated that a variance could be granted with conditions that no flammable liquids be stored in the building at any time. Smoke detectors have been instatled in alt hallways. . Pat Fish, Fire Prevention Bureau stated that if the bed was remove from the sewing room then a variance could be granted on the lower unit bedroom. The other two unit bedrooms escape windows could be granted a variance. The upper unit bedroom windows are the high windows (over 50 inches from the floor) . The appellant was planning to put in a new furnace and water heater this summer, but because of the cost involved to repair the windows to bring them up to code the furnace and water heater will have to wait. The walls in this area are double sheet- rocked. BOARD ACTION Motion made by Bill Tilton to deny the request for variance on the escape window in the lower bedroom, which has a stairway outside the window, however a variance be granted for the other two bedrooms to be used as sleeping rooms. Appellant has been working on the property to make all the repairs. Don Amey has since come out and has approved the safety of the building. All items from a deficiency list letter dated May 29, 1987 are near completion, except for the electrical , which the appellant is requesting more time to complete. If all work is completed, except the electrical this building upon inspection could be rented. Mary Beth Hultman and Gary Grabco have been working with her to put this loan together and be approved since November 1986. While the loan was being processed the city asked the appellant not do the repairs as this was part of the loan package. In the meantime the Health Department cited the building for all kinds of violations. All items on the deficiency list letter dated May 26, 1987 witl be completed.
