The meeting of the Board of Appeals 8 Review was called to order
by Chariman Ron Glassman, at 1 :30 p.m. , July 14, 1987. Mr
' Glassman welcomed the appellants and explained the procedures,
stating that what the Board does is recommends action to the City

Minutes of the June 9, 1987 meeting were approved as submitted in
writing.
Chairman Glassman referred to a letter from Jane A. McPeak,
Deputy City Attorney, dated May 18, 1987, and the letter Ron
Glassman wrote in answer to "Conflict of Interest" . Jane
McPeak's reply was the Board could continue the practice, which
was to declare their interest at the time the case was presented,
then to abstain from voting. However, the Board must follow the
procedure set forth in the letter of May 18, 1987 letter as
required by St. Paul Legislative Code 24.03.
Bill Tilton stated, in effect, the letter from Jane A. McPeak,
is saying that the board can continue there present practice,
pertaining to stating there interest, but must also put in
writing, "what action it is" , and "nature of conflict. " These
must be sent to City Clerk and Chair of the Group. If a member is
aware of a conflict before a meeting it should me noted
beforehand, if not then after the meeting. Bilt Tilton stated
that the board would have the power to direct this information be
put in the minutes.

SUBJECT Appeltant is requesting a waiver from the requirement of
vacant building fees.
PROCEEDINGS: The property in question is in foreclosure, there is
no rent coming in. There also is some defauit judgements against
the property. The vacant building fees and fines total $170. 00.
Foreclosure is by Cal -Fed, from California. These fees are
carried over till the fees are paid and then a permit will be
issued. A ticket could be issued for not registering the vacant
building, these are issued by the violations bureau.
BOARD ACTION Motion made by Bil�l Tilton to deny the waiver of the
vacant building fee and fines , affirming the order as per letter
dated January 17, 1987. Seconded by David Schultz. MOTION CARRIED
UNANIMOUSLY.

SUBJECT Appeltant is requesting a variance pertaining to size of
3 sleeping rooms, also a variance allowing passage from one
sleeping room through another.
PROCEEDINGS This is a sorority house and presently there are 16
women. The house was recently inspected by the city, rule changes
switched from university inspection system to city inspection.
The sleeping rooms are just a few square feet shy to meet code.
The reason for a variance is that this house must maintain the
occupancy level , so as to offer affordable housing in the
university area. This is only during the school year, during
the summer the occupancy is down.
The appellant is also asking for a variance pertaining to going
through one sleeping room to another.
Carolyn Sheppard stated that the Housing Code Bureau feels
comfortable with granting a variance on both issues.

BOARD ACTION Motion made by David Schultz to grant a variance
pertaining to sleeping room size, also a variance on allowing the
use of one bedroom as a passage way to another bedroom, revoking
the order as per letter dated March 16, 1987. Seconded by Bill

SUBJECT This cas� was before the Board April 10, 1984, requesting
a variance pertaining to dead bolt locks at 919 Lafond Ave; 180
So. Grotto; and 325 Dayton Ave. According to Council Resolution
84-645, it only referred to 919 Lafond Ave. Appellant is
requesting a variance pertaining to dead bolt locks at 325 Dayton
Ave. , because of the nature of this group home.
PROCEEDINGS Due to the fact that this was before the board on
April 10, 1984 for all three addresses, inadvertently only 919
Lafond was mentioned in the Councii Resolution, therefore the
case was reopened and the other three addresses are to be
included in a variance, pertaining to dead bo-lt locks.
BOARD ACTION Motion made by Glenn Gausman to grant a variance
pertaining to dead bolt locks at 325 Grotto St; and 180 So.
Grotto St; and 919 Lafond Ave. , because of the nature of these
home, revoking the order as per letter dated March 27, 1984.
Seconded by David Schultz. MOTION CARRIED UNANIMOUSLY.

SUBJECT Appellant is appealing all items from a corrections list
dated May 21 , 1987, pertaining to mulfunctioning toilet, smoke
detectors, kitchen stove not operating properly, broken windows
and frames, kitchen drain leaking and not vented, living room
ceiling leaking, bathroom sink dripping, Provide screens to all
windows and doors, because of financial hardship.
PROCEEDINGS Appellant very upset because the tenant wrecked the
place then called Fire Prevention Bureau. All these items are near
completion. The appellant needs more time to complete work.

SUBJECT Appellant is requesting a variance on an order to remove
a wood burning stove as per letter dated, April 28, 1987.
PROCEEDINGS Appellant was notified that he had to remove a wood
burning stove. This a commercial building, trucking company.
The stove is the only source of heat in the winter. A new stove
was installed last winter because of an inspection by the
insurance company, which was approved by the insurance company.
Pat Fish, from Fire Prevention Bureau stated that Uniform Fire
Code standards forbids any solid fuel burning appliance, but gas
is acceptable.
t��� This shop is only used by the appellant. The shop has 55 gal .
�`"' barrel , which contains drain oil . This barrel could be removed. �
Pat Fish, Fire Prevention Bureau stated that a variance could be
granted with conditions that no flammable liquids be stored in the
building at any time.
BOARD ACTION Motion made by Bill Tilton to grant a variance, only
if the oil drum is removed, use only for storage of diesel
vehicle, do not store other flammables in building, this variance
to be granted for the length of time appellant owns the building.

is unnecessary; Item # 10 (Replace single wall gas connection
with approved double wall or ridged connection on dryer) needs an

� PROCEEDINGS The appellant is appealing the item pertaining to the
escape windows in upper unit bedroom and basement windows, she
feets these are adequate for escape. Smoke detectors have been
installed in all haliways. .
Pat Fish, Fire Prevention Bureau stated that if the bed was
remove from the sewing room then a variance could be granted on
the lower unit bedroom. The other two unit bedrooms escape
windows could be granted a variance.
The upper unit bedroom windows are the high windows (over 50
inches from the floor) .
The appeltant was planning to put in a new furnace and water
heater this summer, but because of the cost involved to repair
the windows to bring them up to code the furnace and water
heater will have to wait. The walls in this area are double sheet-
rocked.
BOARD ACTION Motion made by Bill Tilton to deny the request for
variance on the escape window in the lower bedroom, which has a
stairway outside the window, however a variance be granted for
the other two bedrooms to be used as sleeping rooms. Seconded by
Glenn Gausman. MOTION CARRIED UNANIMOUSLY.

from Health Department letter dated May 29, 1987 pertaining to

screens . ) Interior-down (No glass in kitchen window, Bathroom
toilet , Bathroom floor, Bathroom electrical , Bathroom no hand
sink, Electrical outlets throughout. Interior-up (Hallway
ceiling unfinished, Bathroom lacks electrical outlets, Kitchen
area has only one elcectrical outlet, Bathtub and kitchen faucets
drip, Vent pipe from heater is not properly connected to chimney
in wall . General , Cochroach and mice infestation throughout.

�;;;:;� PROCEEDINGS This building was tagged to be condemned, therefore
all the tenants have moved out. Appellant has been working on
the property to make all the repairs. Don Amey has since come
out and has approved the safety of the building. All items from
a deficiency list letter dated May 29, 1987 are near completion,
except for the electrical , which the appellant is requesting more
time to complete. If all work is completed, except the
electrical this building upon inspection could be rented.
BOARD ACTION Motion made by Bill Hite to grant an extension of
time for six months (January 14, 1988) to complete the electrical
work, bringing it up to code. Seconded by Glenn Gausman. MOTION
CARRIED UNANIMOUSLY.

PROCEEDINGS In 1985 the City asked the Appellant to cooperate
with them to rehab this building. Mary Beth Hultman and Gary
Grabco have been working with her to put this loan together and
be approved since November 1986. While the loan was being processed
the city asked the appellant not do the repairs as this was part of the
loan package. In the meantime the Health Department cited the
building for all kinds of violations. All items on the deficiency
list letter dated May 26, 1987 witl be completed. Appellant is
requesting an extension of time.
BOARD ACTION Motion made by David Schultz to grant an extension
of time for 4 months (November 15, 1987) . Seconded by Glenn
Gausman. MOTION CARRIED UNANIMOUSLY.
