Mr. Glassman welcomed the appellants and explained the procedures, stating that what the Board does is recommends action to the City Council . Minutes of the May 12, 1987 meeting were approved as submitted. Chairman Glassman referred to a letter received from Jane A. McPeak, Deputy City Attorney, dated May 18, 1987, wherein, it refers to St. Paul Legislative Code 24.03, Conflicts of Interest. Ron Glassman stated that in the past any member on the Board who had an interest in a case, announced to the Board regarding this effect, therefore, excusing him/herself from voting on the action to be taken. CASE NO. PROPERTY APPEALED APPELLANT 47-87-H 1485 7th St. East York Manor Apartments Bentley Properties, Inc. APPEARANCE Margaret Barnes SUBJECT Appellant is requesting a variance pertaining to ��� Emergency Lighting, as per letter dated March 30, 1987, because of financial hardship. 1 � ��7-�.��/� ( �` PROCEEDINGS The Appellant stated that she received a notice from Fire Prevention regarding Emergency Lighting to be installed. Ms. Barnes feels because of a high vacancy factor, there is no money to have the system installed. Pat Fish, from Fire Prevention stated that Emergency Lighting was called on this building, because Fire Code requires emergency lighting in a building with 100 or more occupants. The 100 or more occupants is calculated on the square footage in the building, rather than the number of person living in the building at any given time. The building is a 50 unit building, and the number of occupants at present is 56 persons. Because of the square footage (39,000 sg. ft) potentially this building could accommodate 195 people. The cost to install emergency lighting would be $2600. 00. Pat Fish, from Fire Prevention stated that Fire Prevention has given the appellant six months to complete the work. Harold Knutson stated that the idea behind emergency lighting is that if the electricity goes out, then the emergency lighting goes on immediately for at least one hour. BOARD ACTION Motion made by David Schultz to deny the variance, � ��.. but to give the appellant an extension of tirne for 6 months :��` (December 9, 1987) to have emergency lighting installed. MOTION CARRIED UNANIMOUSLY. ---------------------------------------------------------- 48-87-H 391 Grand Ave. Richard 8 Beverly Lachenmayer APPEARANCE NONE SUBJECT Appellant is requesting a variance pertaining to escape windows as per letter dated April 12, 1987. This case has been withdrawn because Appellant and Fire Prevention Bureau have been working together, and have resolved the code violations pertaining to escape windows. Appetlant is requesting the filing fee of $10.00 be refunded. BOARD ACTION Motion made by Dave Schultz to refund the filing fee of $ 10.00. Seconded by Rosie Bostrom. This case has been postponed for 1 month as the Appellant is working with Fire Prevention to solve the code violations. ---------------------------------------------------------- 46-87-H 867 Forest Street Northern Maileable Iron, Co Floyd R. Anderson APPEARANCE None SUBJECT Appellant is requesting a variance pertaining to Item #2 (Provide exits throughout building so that travel distance to reach nearest exit does not exceed 100 ft as per code; Item #5 (Provide one hour fire separation for walls and door openings to protect front and rear stairs of office and second floor luncheon) , as this will create a financial hardship. ��, This case has been postponed for one month as the Appellant and � Fire Prevention Bureau are working with the Appeilant to resolve the code violations. -------------------------------------------------- 51-87-H 1213 Summit Ave. Thomas Mooney APPEARANCE Thomas Mooney SUBJECT Appellant is appealing the orders of a letter dated January 22, 1987, pertaining to an Energy Audit. This will create a financial hardship. PROCEEDINGS Mr. Mooney was never notified that there was to be an Energy Audit done on his property. Appellant finds no problem with the requirement of having to caulk and weatherstrip the windows inside but would like a variance from the requirement of having to insulate the walls. John Betz, from Housing Code Department stated that these Audits are conducted because of a complaint. Health Department receives the Audit report, and then notifies the appellant that the work is to be done, The appellant was given until October 1 , 1987 to complete the work. �.-� Tom Frantzen rentor in the upper unit stated that portions of the upper unit are not usable in the winter, and he feels its because of lack of insulation. 3 , - ��,�-�-ia�r 7 � T David Schultz, Board Member made a suggestion that maybe not grant a variance at this time, but to have the owner and persons from the Energy Consortium meet and discuss the problem, and come up with a solution as to maybe solve the problem. BOARD ACTION Motion made by Glenn Gausman to grant a variance pertaining to insulation of the walls, include in the motion, that the Appellant be given an extension of time till October 1 , 1987 to do the caulking and weatherstripping. Seconded by Harold Knutson. PROCEEDINGS Appellant is requesting a permnament variance on room size for 18 of the 21 rooms in this building. This building has been in existence since 1962. Carolyn Sheppard, from Health Department stated the Health Department has no problem with the board granting a variance. It was suggested that at the July meeting, the board review any cases that are presented. After which time, the Board will have Greg Hubinger and Dan Flaherty, from Minnesota Department of Public Services, along with Julie Close, from St. Paul Neighborhood Energy Consortium speak. The Board is requesting that Councilmember Jim Scheibel be invited to attend this meeting. There will be time allowed for questions and answers. Alice Bijjani , from Heatth Department, Enviromental Section, will be present atso to answer questions.
