THE COUNCIL OF THE ��TY OF SAIIVT PAUL i�OLS ORDAIN: Section 1 . That section 65.102 of the Saint Paul Legislative Code be anci is hereby amended to read as follows : 65.102. Establishment. The Council of the City of Saint Paul does nereby adopt the boundaries of the floodway district, as shown on the four maps entitled "River Corridor Floodway District" , dated 7-6-87 , and a copy of these maps shall be rnaintained in the office of City Clerk for public inspection. The areas within ��he jurisdiction of this chapter are hereby divided into four districts as shown on the maps accornpanying this code , which maps are hereby adopted and are entitled, "River Corridor Overlay Zoning Districts" and are dat2d 7-6-87. Island Plant Site � John Kerwin, who owns the Island Plant Site, has requested that the proposed floodway boundary be moved riverward to include a low peninsula leading to the base of a NSP power tower in front of his property. Staff has recommended against this change since the peninsula is below the normal ordinary high water mark, as estimated by TKDA, and the Department of Natural Resources rules allow no construction or substantial filling ' on it. The proposed change would serve no purpose. At the June 1, City Transportation and Development Committee meeting, Mr. Kerwin questioned the location of the normal ordinary high water mark. He believed it was further riverward� towards the NSP tower. Staff inet with Gregory Korstad, Kerwin's attorney, Jim Hart, City attorney, and Kent Lokkesmoe and John Fax, DNR, to determine the location of the normal ordinary high water mark and the activities which are permitted below the mark. The DNR stated that the normal ordinary high water mark at Kerwin's property is at an elevation of 695 feet. This is landward from the mark as estimated by TKDA. DNR rules prohibit filling below the mark but marina development or shoreline protection could be permitted. Consequently, staff recommends that the floodway boundary not be moved to include the peninsula. Moving the boundary to include the peninsula will serve no purpose since no filling or construction would be permitted on ' it. • � Staff al�s'a�•�eecoft►mends that the floodway be moved to the 695 foot � r elevation (ordinary normal high water mark as determined by DNR) , except upriver from the screen house. Maps The "River Corridor Floodway District" maps which will be adopted as the official boundaries of the floodway district have been reviewed by the DNR against the computer model of the floodway and mapping errors were discovered. These mapping errors were at the Ford Plant� the 35E Highway bridge, down river from the Island Plant Site� and at Pickerel Lake. ' These maps have been changed to correctly reflect the model. The "River Corridor Overlay Zoning Districts" maps which show all four of the river corridor zoning districts have also been changed to reflect the corrected boundaries. Introduction Background. On February 13, 1987, the Planning Commission held a public hearing on the Floodway 40-Acre Study. The study proposes to redefine the floodway overlay zoning district (RC-1) in the Mississippi River floodplain. Mr. John Kerwin, Nicollet Restorations, Inc. , who owns the Island Plant site at the foot of Randolph Avenue in District 9, submitted a letter (attached) and spoke to the Commission. He requested that the staff proposed floodway boundary be moved riverward to include a low peninsula leading to the base of a NSP river tower in front of his property. His proposed boundary is a result of a study which he had commissioned in 1984 from Toltz, King, Duvall , Anderson and Associates (TKDA} . Existinq Conditions. Map 1 is a topographic map of the site showing the various boundaries. The map was made from a 1985 City topographic map and from a property survey map provided by Mr. Kerwin. The map shows the following boundaries. 1. The existing, staff proposed, and Kerwin proposed floodway boundaries. The area riverward from the boundary is the floodway and is the area needed to carry-off the 100-year flood. Here no new main buildings are allowed and only minor filling is permitted. 2. The estimated normal ordinary high water mark (EST. N.O.H.W. on the map) . Riverward of this boundary, the Department of Natural Resources will not allow any construction regardless of floodway locations. 3. The 100-year flood limits without protection. Riverward of this boundary is the area which has flooded in the past during the 100- year flood. 4. Mr. Kerwin's property line. . ��7/�4�' Planning Commission March 12, 1987 Page Two II. Findings 1. As Map 2 shows, the staff proposed floodway boundary will greatly increase the usability of Mr. Kerwin's site. Only 3.3 acres of his site is now outside of the floodway. The staff proposed boundary places an additional 3.0 acres outside the floodway. Put another way, only 43% of his site is now outside of the floodway; the staff proposal places 82% of the site outside of the floodway. 2. The peninsula leading to the NSP power tower base, which Mr. Kerwin wishes to develop as part of his site, is below the normal ordinary high water mark, and the DNR will allow no construction or substantial filling on it. Moving the floodway boundary, as requested by Mr. Kerwin, so as to remove the peninsula from the floodway will serve no purpose. In Mr. Kerwin's letter to the Commission, he states . . "given the 3 year flood criterion for ordinary high water mark shoreline definition, this land is above the mark, and behind the shoreline, and would be the only land in this category in the proposed floodway." Map 1 shows the peninsula is below the ordinary high water mark, not above it. The DNR will allow no construction on the peninsula. 3. Even if the DNR would allow construction on the peninsula, it would be unwise at this time to do so because construction would use some of the future development potential of the river. DNR regulations allow permitted encroachments into the floodplain which will not increase by more than 0.5 feet the water level of the 100-year flood. This 0.5 foot increase is the development potential which the City has in the "bank" and can use for future development. This potential should be used for proposed developments which are needed in the river corridor and which have firm development plans. Mr. Kerwin's proposed development at this time appears still to be in the conceptual stage. 4. Even if the DNR would allow construction on the peninsula, the large amount of fill needed to bring the peninsula above the 100-year flood protection level would create an obtrusive feature which is out of keeping with the river. The elevation of the peninsula would have to be raised as much as 20 feet (as high as a 2 story building) to bring it above the flood protection level . This high peninsula would protrude 150 feet into the river. 5. One of the reasons Mr. Kerwin wishes to develop the peninsula is to create a marina. Staff suggests any new marina be developed by dredging out part of his site, thereby enlarging the river area, rather than filling the peninsula and diminishing the river area. III. Recommendation Based on findings 1 through 5 staff recommends that Mr. Kerwin request to move the floodway boundary further riverward be denied. ^ . � �7 /� 1� Planning Commission March 12, 1987 Page Three BLUFFS IN DISTRICT 4 At the public hearing, Commissioner Dimond requested that the Commission consider changing the top of the bluff in District 4 from a RC-4 district to a RC-3 district. The work and time of this 40-acre study have focused on the RC-1 floodway district. The study has not considered the appropriateness of the RC-3 and RC-4 districts which protect the river bluff. Staff recommends that no action be taken on Commissioner Dimond's request and that the Commission consider whether it believes the RC-3 and RC-4 districts should be studied for appropriateness. If they should be studied, then this should be done in a separate 40-acre study. Our reason at that time was that there is conaiderable land on the riverside of the line, and there is a lsrge power pole at the end of a poin[ of land. Any developoment on the eit� t�et relatea to the river must address [he interface with the river, and the treatme►it of the land and power pole. if this land remains in the floodway very few optiona are available. In aeveral meetings with the DNR these options were explained as ranging from nothing, which would leave the unsightly, unaccessible p:e�eiit situetior, La d:edging it snd possibly riprapping to provide a breakwater. The TKDA study recommended moving the floodway line [o the ahoreline which is on the riverside of the power pole. A copy is enclosed. I have checked with Mr. Huntrods of TKDA who performed bo[h our and your studies. He stat��s that the revision remains feasible within the reserve of permitted flood stage increases. Furthermore, given the 3 year flood criterion for ordinary high va[er mark ahoreline definition, this land is above the mark, and behind the ahoreline, and would be [he only land in this category in the propoaed floodway. PURPOSE: The purpose of this 40-acre study is: (1) to redefine the floodway district in the Mississippi River floodplain so as to reflect future land use plans, existing land uses, and improved methodology and data used in determining flood flows; and (2) to remove discrepancies in the boundaries of the River Corridor Overlay Zoning Districts. B. BACKGROUND: The Mississippi River Corridor is divided into four overlay zoning districts to provide comprehensive floodplain and river bluff management for the City. The river corridor floodway district (RC-1) is the area of the floodplain which is needed to carry-off a 100-year flood. Its regulations limit any development which will raise the water surface during a 100-year flood by more than 0.5 feet. Within the district, the regulations limit permitted uses to those which have open areas, such as factory parking lots, parks, or apartment building lawns. Uses such as accessory buildings to permitted uses, flood control works, and marinas are permitted as special condition uses. The river corridor flood fringe district (RC-2) is the area of the floodplain which has flooded during the 100-year flood in the past but which may be filled-in because it is not needed to carry-off the 100-year flood. Here, uses are permitted which are elevated above the 100-year flood elevation or waterproofed to withstand flooding. The river corridor urban open district (RC-3) is the area of the river corridor below and above the bluffs where recreational, scenic, and natural resources are to be conserved. Here buildings are limited to 40 foot heights, new and expanded commercial and industrial buildings must be build landward from bluffs, and mining is prohibited. The river corridor urban diversified district (RC-4) is the area of the river corridor above and below the bluff where a variety of uses are encouraged to locate. Buildings may exceed 40 feet in height and may be constructed riverward from bluffs. The delineation of the existing floodway and flood fringe districts (RC-1 and RC-2) was derived by using information gathered in 1972 by Minnesota Department of Natural Resources (DNR), with additional information furnished by the Corps of Engineers and U.S. Geological Survey. The City contracted with Toltz, King, Duvall, Anderson, and Associates (TKDA) to study the floodplain and recommend changes in the floodway district which are consistent with existing land uses, the River Corridor Plan, the Riverfront Commission's Pre-Development Plan, and improved methodology. (A copy of their study is attached.) Based upon their study, staff recommended changes are contained in the following sections. C. 4Q-ACRE STUDY: Minnesota Statutes Section 462.357, Subd. 5 permits St. Paul to amend its Zoning Code without obtaining consent petitions when all of the following conditions are met: 1. The whole area of the city or an area of not less than 40 acres has been surveyed. 2. The number of real estate descriptions affected by the zoning changes and alterations renders the obtaining of written consent impractical. 3. The Planning Commission reports in writing as to the proposal's relationship to the overall needs of the community, to existing land use, or to a plan for future use. r r � � , � File #10046 Page Two 4. A public hearing on the proposed ordinance, changes, or alterations is conducted with notice of the time, place and purpose of the hearing published at least once a week for three successive weeks prior to the public hearing. D. FINDINGS: I. FLOODWAY 1. The area surveyed for the study is 9,760 acres. 2. The number of real estate descriptions affected by this change is over 200, making it impractical to obtain written consent. 3. The overall needs of the City will be better served by the redefined floodway district because the technical advances in computing the flood flows and the use of up-to-date data allows a more accurate calculation of the area of the floodway needed to carry-off the 100-year flood. The TKDA study uses an improved computer program to calculate flood flows, corrects a number of inaccurate data point locations on river cross sections, corrects some inconsistent flood elevations, uses actual bridge plans, and updates the 100- year flood flows through the City. 4. In three areas of the floodplain, the redefined floodway boundary will be brought into consistency with existing land use. a) At Saint Paul Downtown Airport, the new boundary refines the existing boundary and will be consistent with the recently constructed runway. In November, 1983, the Planning Commission granted a special condition use permit to the Metropolitan Airports Commission to place fill in the floodway in order to construct the runway. b) In the Pickerel Lake area of Saint Paul, the floodway boundary will be moved closer to the river. The Chicago Northwestern railroad track is constructed on fill above the 100-year flood elevation. In the area to the south of the railroad track, high ground elevations run parallel to the river and act as submerged ledges during floods. The railroad track and submerged ledges render these areas ineffective as a floodway. c) At the site of Watergate Marina, the floodway boundary will be moved closer to the river's edge from high ground. 5. The proposed boundary of the floodway will be consistent with uses proposed in plans for future land use. a) On the north shore of the river along Warner and Shepard Roads, the boundary will be moved to the water's edge. This will allow reconstruction of the Warner and Shepard Roads as recommended in the River Corridor Plan. The design of the roads is now being detailed in the Shepard/Warner/East CBD Bypass Environmental Impact Statement. b) Along the south shore of the river, from north of the airport to the east edge of Harriet Island, the boundary will be moved from the top of the existing dike to the water's edge. This will allow new land uses to be built as recommended in the River Corridor Plan and is now being proposed in the Riverfront Commission's Pre- Development Plan. c) At Harriet Island the boundary will be moved from the river's edge to the top of the existing dike. Up-river, between Harriet Island and the Chicago and Northwestern railroad bridge, the boundary will be moved from the water's edge to higher ground at the bottom of the bluff. The River Corridor Plan and the Riverfront Commission's Pre-Development Plan recommend park for these two areas. The open space of the park will be used to carry-off floods. d) At the NSP Island Plant site at the foot of Randolph Avenue, the boundary will be brought to the water's edge. The River Corridor Plan recommends reuse of the building and site for commercial or industrial use. � ���:�ir�� � � File #10046 Page Three II. MAP DISCREPANCIES 6. The 23 River Corridor Overlay Zoning District maps should be amended to remove boundary line discrepancies between maps. An additional set of five air photo maps delineating the floodway should be adopted as the official boundaries of the floodway district (RC-1). a) There are areas of the river corridor which are shown on more than one map. In many of these areas of overlap, the river corridor boundary lines on a map do not coincide with the boundaries lines on other maps. The areas of overlap have been removed so that each area of the river corridor is shown on only one map. The boundary line discrepancies have been resolved by using original 1972 DNR maps showing the area to the floodplain. b) The TKDA consultants drew the proposed floodway boundaries on air photo maps of the floodplain. These are the most accurate maps of the floodway because the boundaries can be located using a computer and the maps are larger. G. STAFF RECOMMENDATION: The floodway district (RC-1) should be amended based on findings 1 through 5. The river corridor overlay zoning maps should be amended to remove boundary line discrepancies. The existing and proposed maps are attached. Five maps, entitled "River Corridor Floodway District", should be adopted as the boundaries for the floodway district. State and federal law requires these maps be adopted by the City. The first paragraph of Section 65.102 should be amended as follows: Establishment. The areas within jurisdiction of this chapter are hereby divided into four districts shown on the maps accompanying this code, which maps are entitled, "River Corridor Overlay Zoning Districts" and "River Corridor Floodwav District".
