That the vacated area be described as follows: All that part of Winifred Street lying between a line drawn from a point on the south line of Lot 6, Block 66, ten feet west of the southeast corner thereof, to a point on the north line of Lot 1, Block 71, ten feet west of the northeast corner thereof and a line drawn from a point the south line of said Lot 6 , seventy feet west of the southeast corner thereof to a point on the north line of said Lot 1, seventy feet west of the northeast corner thereof, all in West Saint Paul Proper . 1. That the vacation be subject to all the terms and conditions of Chapter 130, codified March 1, 1981, of the St. Paul Legislative Code , as amended. � 2. That the petitioner, its successors or assigns shall dedicate to the City of Saint Paul a permanent easement for alley right-of-way purposes in a form to be approved by the City Attorney and the Director of Public Works described as follows: The westerly 10 feet of the easterly 100 feet of Lots 6, 7 and 8, Block 66, West St. Paul Proper . That the petitioner, its successors or assigns shall pay all costs and expenses for the construction of the right-of-way described above including but not limited to costs related to grading, paving and/or surfacing , curbing , sidewalks and drainage in accordance with all applicable codes and ordinances subject to the approval of the Department of Public Works. 4 . Based upon utility easement Certificates of Intended Non-Use filed voluntarily on behalf of Public Works, Northwestern Bell Telephone Company, Northern States Power Company , the Water Utility , Continental Cablevision, District Energy St. Paul and Western Union and made a part hereof by this reference and filed in the office of the City Clerk of Saint Paul , the City for itself and on behalf of these corporations and departments waives the right to utility easements in that portion of the vacated area, described as follows : ALL THAT PART OF WINIFRED STREET , lying between lines extended Southerly across it, from points 30 feet and 90 feet from the Southwest corner of Lot 6 , Block 66 , West St. Paul Proper , to points 10 feet and 70 feet from the Northeast corner of Lot 1, Block 71, West St. Paul Proper 5 . That the petitioner shall pay $500.00 administrative cost for this vacation which is due and payable within 60 days of the publication date of this vacation. 6 . That the petitioner , its successors or assigns, by acceptance of the terms and conditions of this vacation , agrees to indemnify , defend and save harmless the City of Saint Paul , its officers and employees from all suits, actions or claims of any character brought as a result of injuries or damages received or sustained by any person, persons, or property on account of this vacation including but not limited to a claim brought because of any act of omission, neglect or misconduct of said petitioner or because of any claims or liability arising from any violation of any law or regulation made in accordance with the law whether by the petitioner or any of its agents or employees . 7 .
