WHEREAS, this order informed the then known interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and

demolish the shvcture located on the Subject Property by March 4, 1999; and

Council and the Saint Paul City Council; and

2 WF3EREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul City
3 Council on Tuesday, May 18, 1994 to hear testimony and evidence, and after receiving testimony and
4 evidence, made the recommendation to approve the request to order the interested or responsible parties
5 to make the Subject Property safe and not detrimental to the public peace, health, safety and welfare and
6 remove its blighting influence on the community by rehabilitating this structure in accordance with all
7 applicable codes and ordinances, or in the altemative by demolishing and removing the structure in
8 accordance with all applicable codes and ordinances. The rehabilitation or demolition of the structure to
9 be completed within fifteen (15) days after the date of the Council Hearing; and

BE TT RESOLVED, that based upon the testunony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and Order
concerning the Subject Property at 1047 Arcade Street:

That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
That the costs of demolition and removal of this building(s) is estimated to exceed three
thousand dollars ($3,000.00).
That there now exists and has existed multiple Housing or Building code violations at the
Subject Property.
That an Order to Abate Nuisance Building(s) was sent to the then known responsible
parties to correct the deficiencies or to demolish and remove the building(s).
That the deficiencies causing this nuisance condition have not been corrected.
That Division of Code Enforcement has posted a placard on the Subject Property which
declares it to be a nuisance condition subject to demolition.
That this building has been routinely monitored by the Citizen Service Offices, Division
of Code Enforcement, Vacant/Nuisance Buildings.
8. T4iat the known interested parties and owners are as previously stated in this resolution
and that the notification requirements of Chapter 45 have been fulfilled.

The Saint Paul City Council hereby makes the following order:
The above referenced 'mterested or responsible parties shall make the Subject Properry safe and
not detrimental to the public peace, health, safety and welfare and remove its blighting influence

5 Subject Properiy pursuant to the provisions of Chapter 45 of the Saint Paul Legislative Code.

3. In the event the building is to be demolished and removed by the City of Saint Paul, all personal
propert7 or fixtures of any kind which interfere with the demolition and removal shall be
removed from the property by the responsible parties by the end of this time period. If all
personal properiy is not removed, it shall be considered to be abandoned and the City of Saint
Paul shail remove and dispose of such properiy as provided by law.

Division of Code Enfozcement has declazed this building(s) to constitute a"nuisance" as defined
by Legislative Code, Chapter 45. Division of Code Enforcement has issued an order to the then
known responsible parties to eliminate this nuisance condition by correctin� the deficiencies or
by razin� and removing this building(s).
Inasmuch as this Order to Abate has not been complied with the nuisance condition remains
unabated, the community continues to suffer the blighting influence of this property. It is the
recommendation of the Division of Code Enforcement that the City Council pass a resolution
ordering the responsible parties to either repair, or demolish and remove this building in a timely
manner, and failing that, authorize the Division of Code Bnforcement to proceed to demolition
and removal, and to assess the costs incurred against the real estate as a special assessment to be
collected in the same manner as taxes.

$10 for tire disposal plus the $40 administration fee, which brings the assessment to a
total of $140.

The meeting was called to order at 10:02 am.
1. Summary Abatement Appeal for 805 Central Avenue West (File J9901A2)

Gerry Strathman stated this issue was laid over in order to view the videotape.
(A videotape was shown.)
Mel Allen, owner, appeazed and stated he told the inspector that the materials would not
be removed until the workers completed their work. He informed the inspector to call
him when the items could no longer be left there. The items were not hazazdous.
Guy Willits reported the inspector had given a number of extensions and conec6on
notices on this property. The paperwork indicates a message was left for the owner to
remove the items. Mr. Allen responded he did not receive a call nor was a message
received. The inspector was at a block club meeting in April and indicated there that he
did not call Mr. Allen.
What is the amount of the assessment, asked Mr. Strathman. The total is $415, responded
Chuck Votel: $315 for 1.5 hours, five yazds of refuse for $90, two tires for $10.
Mr. Strathman stated the necessary notification was given and the work was done. Mr.
Allen responded the property was under construction. The neighbors were calling the
inspector because they did not like the condition of the properry. The inspector was
looking for anything to cite Mr. Allen.
Gerry Strathman recommended the assessment be reduced to $90 for trash disposal and

Steven Wold, Beth Lilyquist, and Jeffrey Priemesberger all appeazed. Ms. Lilyquist
stated her client—Mr. Wold—wiIl be in negotiations with Mr. Priemesberger to purchase
the properry. This will be resolved by the end of the week.

Chuck Votel reported this is a one story, brick, commercial structure. The City has issued
two summary abatement notices to secure the property. The vacant building fees aze due.
The real estate taxes aze unpaid in the amount of $2,997.10. Ta�cation has placed an
estimated mazket value of $30,000 on ttus property. The building has been vacant since
August 1998. The estimated cost to repair is $20,000; the estimated cost to demolish,
$6,000 to $7,000.
If additional time is granted to complete the properry, stated Mr. Strathman, the City wiil
be asking the owner to pay the vacant building fee, complete a code compliance
inspection, and post a$2,000 bond by June 9. The inspection has been done, said Ms.
Liliquist. Mr. Priemesberger stated he will be out of town for a few days and returning on
June 16. Mr. Votel responded he dces not have a ma}or problem with the bond being
posted by June 23.
Mr. Strathman recommended the owner be given six months to complete the
rehabilitation on condition that the vacant building fee is paid and a$2,000 bond is
posted by noon of June 23, 1999.
3. Itesolution ordering the owner to remove or repair the building at 20 Douglas
Street. If the owner fails to comply with the resolution, Code Enforcement is
ordered to remove the building.
No one appeazed to represent the property.
Chuck Votel stated the owners aze the State of Minnesota Trust Exempt and Judy Leith.
The owners have not discussed their intentions with Code Enforcement. The estimated
cost to repair is over $50,000. The property is very deteriorated.
Gerry Strathman recommended approval.
4. Vehicle Abatement Order for 1183 Arkwright Stree�
Gerry Strathman stated he has received a letter from an attomey representing Donald
Drouin. Mr. Drouin is hospitalized. They have requested a layover for a few weeks.
Guy Willits reported a number of extensions and four correction notices have been given.
There are other issues at this properiy; he is concerned about these other items being laid
over. Mr. Strathman responded the only item being appealed is the vehicle abatement.
Gerry Suathman recommended a lay over to the July 6 Legislative Hearing on the vehicle
abatement order.

by Legislative Code, Chapter 45. Division of Code Enforcement has issued an order to the then
known responsible parties to eliminate this nuisance condition by correctin� the deficiencies or
by razin� and removing this building(s).
Inasmuch as this Order to Abate has not been complied with the nuisance condition remains
unabated, the community continues to suffer the blighting influence of this property. It is the
recommendation of the Division of Code Enforcement that the City Council pass a resolution

The meeting was called to order at 10:02 am.
1. Summary Abatement Appeal for 805 Central Avenue West (File J9901A2)

Gerry Strathman stated this issue was laid over in order to view the videotape.
(A videotape was shown.)
Mel Allen, owner, appeazed and stated he told the inspector that the materials would not
be removed until the workers completed their work. He informed the inspector to call
him when the items could no longer be left there. The items were not hazazdous.
Guy Willits reported the inspector had given a number of extensions and conec6on
notices on this property. The paperwork indicates a message was left for the owner to
remove the items. Mr. Allen responded he did not receive a call nor was a message
received. The inspector was at a block club meeting in April and indicated there that he
did not call Mr. Allen.
What is the amount of the assessment, asked Mr. Strathman. The total is $415, responded
Chuck Votel: $315 for 1.5 hours, five yazds of refuse for $90, two tires for $10.
Mr. Strathman stated the necessary notification was given and the work was done. Mr.
Allen responded the property was under construction. The neighbors were calling the
inspector because they did not like the condition of the properry. The inspector was
looking for anything to cite Mr. Allen.

stated her client—Mr. Wold—wiIl be in negotiations with Mr. Priemesberger to purchase
the properry. This will be resolved by the end of the week.

Chuck Votel reported this is a one story, brick, commercial structure. The City has issued
two summary abatement notices to secure the property. The vacant building fees aze due.
The real estate taxes aze unpaid in the amount of $2,997.10. Ta�cation has placed an
estimated mazket value of $30,000 on ttus property. The building has been vacant since
August 1998. The estimated cost to repair is $20,000; the estimated cost to demolish,
$6,000 to $7,000.
If additional time is granted to complete the properry, stated Mr. Strathman, the City wiil
be asking the owner to pay the vacant building fee, complete a code compliance
inspection, and post a$2,000 bond by June 9. The inspection has been done, said Ms.
Liliquist. Mr. Priemesberger stated he will be out of town for a few days and returning on
June 16. Mr. Votel responded he dces not have a ma}or problem with the bond being
posted by June 23.
Mr. Strathman recommended the owner be given six months to complete the
rehabilitation on condition that the vacant building fee is paid and a$2,000 bond is
posted by noon of June 23, 1999.
3. Itesolution ordering the owner to remove or repair the building at 20 Douglas
Street. If the owner fails to comply with the resolution, Code Enforcement is
ordered to remove the building.
No one appeazed to represent the property.
Chuck Votel stated the owners aze the State of Minnesota Trust Exempt and Judy Leith.
The owners have not discussed their intentions with Code Enforcement. The estimated
cost to repair is over $50,000. The property is very deteriorated.
Gerry Strathman recommended approval.
4. Vehicle Abatement Order for 1183 Arkwright Stree�
Gerry Strathman stated he has received a letter from an attomey representing Donald
Drouin. Mr. Drouin is hospitalized. They have requested a layover for a few weeks.
Guy Willits reported a number of extensions and four correction notices have been given.
There are other issues at this properiy; he is concerned about these other items being laid
over. Mr. Strathman responded the only item being appealed is the vehicle abatement.
Gerry Suathman recommended a lay over to the July 6 Legislative Hearing on the vehicle
abatement order.

referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and Order
concerning the Subject Property at 1047 Arcade Street:

Subject Property.
That an Order to Abate Nuisance Building(s) was sent to the then known responsible
parties to correct the deficiencies or to demolish and remove the building(s).
That the deficiencies causing this nuisance condition have not been corrected.
That Division of Code Enforcement has posted a placard on the Subject Property which
declares it to be a nuisance condition subject to demolition.
That this building has been routinely monitored by the Citizen Service Offices, Division
of Code Enforcement, Vacant/Nuisance Buildings.
8. T4iat the known interested parties and owners are as previously stated in this resolution
and that the notification requirements of Chapter 45 have been fulfilled.

Steven Wold, Beth Lilyquist, and Jeffrey Priemesberger all appeazed. Ms. Lilyquist
stated her client—Mr. Wold—wiIl be in negotiations with Mr. Priemesberger to purchase
the properry. This will be resolved by the end of the week.

Chuck Votel reported this is a one story, brick, commercial structure. The City has issued
two summary abatement notices to secure the property. The vacant building fees aze due.
The real estate taxes aze unpaid in the amount of $2,997.10. Ta�cation has placed an
estimated mazket value of $30,000 on ttus property. The building has been vacant since
August 1998. The estimated cost to repair is $20,000; the estimated cost to demolish,
$6,000 to $7,000.
If additional time is granted to complete the properry, stated Mr. Strathman, the City wiil
be asking the owner to pay the vacant building fee, complete a code compliance
inspection, and post a$2,000 bond by June 9. The inspection has been done, said Ms.
Liliquist. Mr. Priemesberger stated he will be out of town for a few days and returning on
June 16. Mr. Votel responded he dces not have a ma}or problem with the bond being
posted by June 23.
Mr. Strathman recommended the owner be given six months to complete the
rehabilitation on condition that the vacant building fee is paid and a$2,000 bond is
posted by noon of June 23, 1999.
3. Itesolution ordering the owner to remove or repair the building at 20 Douglas
Street. If the owner fails to comply with the resolution, Code Enforcement is
ordered to remove the building.
No one appeazed to represent the property.
Chuck Votel stated the owners aze the State of Minnesota Trust Exempt and Judy Leith.
The owners have not discussed their intentions with Code Enforcement. The estimated
cost to repair is over $50,000. The property is very deteriorated.
Gerry Strathman recommended approval.
4. Vehicle Abatement Order for 1183 Arkwright Stree�
Gerry Strathman stated he has received a letter from an attomey representing Donald
Drouin. Mr. Drouin is hospitalized. They have requested a layover for a few weeks.
Guy Willits reported a number of extensions and four correction notices have been given.
There are other issues at this properiy; he is concerned about these other items being laid
over. Mr. Strathman responded the only item being appealed is the vehicle abatement.
Gerry Suathman recommended a lay over to the July 6 Legislative Hearing on the vehicle
abatement order.
