Villaume, III �� Assistant City Attorney DATE: June 22 , 1987 RE: Farmers Insurance Group as subrogree of Mildred Brown v. City of St. Paul Our File No. S84-0087 On December 12 , 1983 , at Public Works dump truck driven by Donald McNaughton collided with a automobile owned and driven by Mildred Brown at the intersection of Marshall and Prior. Mr. McNaughton claims that he was unable to stop for the red light because of icy conditions and slid into the intersection striking Mrs. Brown' s car. Farmers Insurance Group, as the insurer of Mildred Brown, paid $2 , 002 . 91 for repairs to her automobile. In addition, Mrs . Brown had a $120 deductible. Mrs. Brown claims personal injuries arising out of the accident, including a soft issue injury and a loss of sensation to part of her face. She has medical expenses of $1, 434 . 80, which also have been paid by her insurer under the PIP provision of her policy. Farmers Insurance Group has made a subrogation claim for all property damage and medical benefits paid. We have agreed to pay 100% of the property damage and 50% of the medical expenses. This sum totals $2 , 840 .31 and our office recommends approval. Mrs . Brown' s personal injury claim remains outstanding and she is represented by counsel . FEV:paw enc. cc .
